Arkansas Senate Overrides Governor's Veto Of 2A Sanctuary Bill

Gov. Asa Hutchinson’s veto of a Second Amendment Sanctuary bill was handed down last Friday, but the governor may end up not getting his way on the bill. On Monday the Arkansas State Senate voted to override Hutchinson’s nixing of the Arkansas Sovereignty Act 2021, and now the bill heads back to the House for a final vote on the measure.
SB 298 originally passed the Senate by a vote of 28-7, and while the override vote was closer, 21 members of the state Senate still chose to buck the governor and his veto. The original vote in the House was an even more lopsided 76-18, and it’s likely that the votes are there to overturn Hutchinson’s veto of the legislation.

The final day of the regular session was a virtual shootout over a variety of gun bills aimed at correcting a controversial measure vetoed by Gov. Asa Hutchinson.
Last Friday, Hutchinson vetoed SB 298, a bill that would allow local and state law enforcement to not cooperate with federal law enforcement in certain instances. SB 298, the Arkansas Sovereignty Act of 2021, was sponsored by Sen. Gary Stubblefield, R-Branch, and Rep. Brandt Smith, R-Jonesboro. On Monday, Stubblefield led the Senate to override that veto after lawmakers argued for an hour on the issues raised by the veto.

LITTLE ROCK, Ark. (KAIT) - A possible override of a veto on a 2nd Amendment-related bill and the state’s budget will be major issues lawmakers will tackle as they head back to the Capitol Monday.
An attempt to override a veto of the Arkansas Sovereignty Act of 2021 is expected Monday after Gov. Asa Hutchinson vetoed the bill Friday.

Governor Vetoes Arkansas Gun Bill Over Concerns Of Federal Law Enforcement

Gov. Asa Hutchinson vetoed SB 298, the Arkansas Sovereignty Act of 2021, over concerns it would hinder local and state law enforcement cooperation with federal law enforcement entities. It is Hutchinson’s third veto of the session.
“The partnership between state and local law enforcement officers is essential for the safety of Arkansas citizens. This bill will break that partnership and put the safety of Arkansans at risk,” the governor said.
Citing several legal precedents on gun laws enumerated in the bill, Hutchinson also said its implementation would have the effect of giving opportunities for violent criminals to circumvent prosecution.

Governor has constitutional concerns on gun bill involving state, local law enforcement


The measure specifically addresses federal requirements to register or track firearms, any prohibition against possession or ownership of a firearm or accessory, or the confiscation of firearms or ammunition. 
“All acts, laws, orders, rules, and regulations of the United States Government, whether past, present, or future, that infringe on the people’s right to keep and bear arms as guaranteed by the Second Amendment to the United States Constitution and Arkansas Constitution, Article 2,§5, are invalid in this state, shall not be recognized by this state, are specifically rejected by this state, and shall be considered null and void and of no effect in this state,” the bill reads.
