before, and that can have an impact. it just shows you the unpredictability of how this law play out. >> right? right. and another fascinating point about that poll you mentioned, there's only about a third of voters who thought he did something illegal in this particular case we're close to half of voters think he did illegal. on the other three cases. so you do see how, at least in the court of public opinion this particular criminal case isn't seen particularly as seriously as the other charges he's facing and in the district and florida and in georgia, which is i think partly why the prosecutors have tried to brand this, not as a hush money case before the election interference case, to try to bring the gravity of this of these charges of what trump is facing more to the public eye. but i do think it'll be really interesting to see what happens if there is a verdict and if that verdict is guilty, obviously, could go through a lengthy appeals process as well but of the pool that you mentioned, 47% of independents did say that this would make him unfit to serve the democrats and republicans are in their partisan corners, even on that question. but we're

and they believe that at the end of the day, despite people say thing that they can be impartial, that there is going to be some sort of political bias. they know that the defendant is incredibly polarizing as well as the fact that he's a former president and incredibly well-known but what they're looking for is can they find one sympathetic jury? >> juror? can they get a hung jury that is the ultimate goal here, because as you've said, had an acquittal exactly. >> and i don't know well, that they necessarily think they're going to get an acquittal. so sure. that is the ultimate goal, but the realistic goal for them might more be leaning towards getting a hung jury. >> now remember for the prosecutor bhushan and the defense team, it has been show time since the very first juror in the pool walked in that courtroom, they're going to have to now tailor their oral arguments that might happen as early as monday and day to those 18 jurors. now, we know the court of public opinion looms large and we have a lot of conversations. but for them, they're going to present their case to these jurors. so every detail they learn luck in the way might be useful exactly. >> that's exactly right. i just remember that the trump team also has a jury consultant

continue to say that the finding and the new york attorney general case is a witch hunt and unfair. i think you will hear very similar things to what we've heard before. >> as a prosecutor, almost on the one hand wanting to see, if you can poke the baer and get him to not to the attorneys party line and the other hand, it will become rabbit hole after rabbit hole, if he is allowed to testify on all these matters, you can't really constrain them in the same way, but in the court of public opinion, so to speak. even for these jurors, who will have to know just what's in front of them. >> they might know a great deal of this already, and he might be enticed into trying to change their mind. there's no question that donald trump sees himself as his best salesman. and we saw that in the e jean carroll case. the second one where there was a jury and then he was present for and he was clearly trying to make eye contact. he was trying to smile at people. he believes he is his own best salesman and that he thinks that some of these folks are his supporters. now what we saw in the e jean carroll case is it took that jury exactly a few hours to render a judgment of $83

the jury selection process. now, the question is, what is judge merchan going to do about this? there's going to be a hearing on tuesday. the prosecution wants to add these additional examples since monday as evidence in that hearing. and he could fine the former president. he could go as far as threatening him with jail time. i'll leave it to the lawyers to get to the details of what actually makes sense in a case like this. we have known since this gag order came into place that this was going to be a challenge given the former president often prioritizes what happens in the court of public opinion over what happens in the actual court, chris. >> thank you so much, dasha burns. now, to that split screen. you've got donald trump on trial in new york. president biden is out on the campaign trail in pennsylvania, just getting a big endorsement. nbc's monica alba is reporting from philadelphia. what happened where you are?
