A very good day two of you from msnbc headquarters in new york. welcome to alex witt reports. we begin with some breaking news. new confirmation today of a department of justice investigation. reportedly related to the nationwide baby formula shortage that we all remember. and specifically about abbott labs. joining me now is msnbc legal analyst and not a criminal defense attorney. as well as nbc s kathy clark. welcome to you both. i want to start with you here. what are you learning about this investigation? this is the country s largest baby formula maker. yeah. alex, this is some big news. the wall street journal was the first to report that the company is now under a criminal federal investigation. the doj is now investigating ....
Instead of the real ones and that would hand the election to trump in that day. here is the question. this search of jeffrey clark s house, is it about that? is it about the fake electors? we know there is an active federal criminal investigation of the fake electors. we have seen all the subpoenas go out including to at least three different state party republican chairs, as they look into the fake elector scheme. the fake electors thing has an active federal criminal investigation, we know. what is clark s relationship to that? he had kind of a tertiary role in that. part of his plot for using the justice department to overthrow the government is that he had that justice departments tell the state that they should give legal recognition to those fake trump electors. okay. he planned to do that, he wrote a draft letter that was never sent about that. is that enough of a connection of him to the fake electors thing? that we should be able to conclude that his house getting search is re ....
Discern if this search warrant basically being effectuating that mr. clark s house is related to the fake elector scheme? or if this is a public sign of some other federal criminal investigation that we don t yet know about? i don t think we can answer that question, whether they are linked. although, it does seem if you are going to do all these events on the same day, oftentimes you do that because you don t want one to tip off the other. so, the nine simultaneous subpoenas on the same day as the search warrant, it does make sense that one has something to do with the other. because you don t want anybody tipping off anybody else. but the fact that they have taken this over step in that they had sufficient evidence to show to a judge that they had probable cause to believe a crime has been committed suggests to me that we are closer to the end than the beginning of an investigation, at least as to jeffrey clark. because you have to amass sufficient evidence to show probable cause. ....
Correspondence that shows that eastman was very aware of klukowski s presence inside the department and that he did not want to highlight that presents because ken was very new there and he didn t necessarily want people to know that he was at the department. needed to protect his cover. it was a variation of that idea. barb, let me ask you, though how you view the importance of this search warrant being evacuated at mr. clark s house. it wasn t clear from much of the day today whether it was in fact a warrant, whether this was indeed federal agents, weather but it seems pretty clear now that this was part of some sort of criminal federal investigation. absolutely. i know that the word raid gets used frequently. but it s actually a search warrant, which means a judge found probable cause to believe that evidence of a crime would be found in that location. excuse me. and so, i think that s a very important development, in a criminal case. and the tie that this other revelation we ....
Focused, in part, on jeff clark. we knew to expect that today we would learn a lot about what the investigation found about mr. clark and what party allegedly played in trump s parts efforts to overthrow the government. but we did not know before today, though, is that in addition to the january 6th investigation in congress, being interested in him, apparently federal criminal investigators have been focused on him too. and it shall indications are that, in, fact the january six investigators in congress were just as surprised as the rest of us today, to learn about this predawn search of jeffrey clark s house yesterday. federal agents, among other things, apparently seized his electronic devices while executing that search warrant. so, we are going to be talking tonight about that bombshell development, later on this evening. we will be talking about, that what it means, how it relates to the committee s work. we will also be joined by a member of the january six investigation to tal ....
