一审判决：程某某死亡情形不符合《工伤保险条例》应当认定为工伤或视同工伤的法定情形
一审法院认为，《工伤保险条例》第十四条“职工有下列情形之一的，应当认定为工伤：（一）在工作时间和工作场所内，因工作原因受到事故伤害的；（二）工作时间前后在工作场所内，从事与工作有关的预备性或者收尾性工作受到事故伤害的；（三）在工作时间和工作场所内，因履行工作职责受到暴力等意外伤害的；……（六）在上下班途中，受到非本人主要责任的交通事故或者城市轨道交通、客运轮渡、火车事故伤害的；……”第十五条第一款第（一）项“职工有下列情形之一的，视同工伤：（一）在工作时间和工作岗位，突发疾病死亡或者在48小时之内经抢救无效死亡的。
前述情形中“工作时间”、“工作场所”、“工作岗位”以及“受到非本人主要责任的交通事故或者城市轨道交通、客运轮渡、火车事故伤害的”等要件是应当认定为工伤或视同工伤的必要前置要件情形之一，如不符合相关要件情形，则不属于相应的应当认定为工伤或视同工伤的法定条件。
无论程某某事发当天是否在工作时间和工作岗位有不舒服或突发疾病的事实，但当时其并未有到医院进行诊治治疗，其并无发病、抢救、死亡的连续完整不间断过程，程某某是径行下班后在驾车途中突发疾病送院抢救无效死亡，本案现有证据显示程某某死亡与其工作时间、工作岗位的相关事实并不具有法律上的直接因果关系，该情形并不符合“突发疾病死亡”或“突发疾病在48小时之内经抢救无效死亡的”两种视同工伤的任一情形。
综上所述，一审判决如下：驳回原告的诉讼请求。
