Counsel disagree on whether new Trademark Modernization Act rules will deter bad actors
Counsel are divided over whether the USPTO’s proposed
guidelines on the Trademark Modernization Act could deter bad actors from
abusing it, Managing IP reported yesterday, May 27.
The act, which was passed in December 2020 and will go into
effect in December 2021, was enacted to help clear the registry of marks not
being used in commerce.
The pending guidelines, ‘Changes To Implement Provisions of
the Trademark Modernization Act of 2020’, were published on May 18. They set
out how the USPTO would oversee the act’s new ex-parte expungement and ex-parte ....

The trio won the appeal after Iron Oak challenged an earlier Patent Trial and Appeal Board (PTAB) ruling on patent 5,699,275, which describes a method for remotely delivering operating system upgrades. Iron Oak is currently pursuing claims against all three of the tech giants in Texas courts, and yesterday s nonprecedential decision could affect that.
Named “system and method for remote patching of operating code located in a mobile unit,“ the 1995 patent describes a method in which a central server could transmit an operating system patch to a remote computer through a communications network. The remote machine would then merge the patch with the underlying operating system and switch to the updated code. ....

Fed. Circ. Backs Microsoft, Others PTAB Wins Over Patch IP
Law360 (May 24, 2021, 11:51 PM EDT) The Federal Circuit on Monday handed a win to Microsoft, Google and Samsung, upholding three Patent Trial and Appeal Board decisions invalidating a single claim in an Iron Oak Technologies LLC patent for updating computer software remotely.
In a nonprecedential opinion, a three-judge panel rejected Iron Oak s argument that the PTAB s decisions should be reversed because the board misinterpreted a key phrase in the patent. The decision comes after the Federal Circuit upheld the PTAB s invalidation of a related Iron Oak patent earlier this year, and could affect multidistrict litigation in Texas in which Iron Oak accused Microsoft, Google and Samsung. ....
