PHOTO: AFP ISLAMABAD: The apex court has ruled that a government servant reinstated to his post will be entitled to all the “back benefits” but an employee who had started some other “gainful” job or business during the period of his dismissal may face partial withholding of the benefits. "In case, the dismissal/removal of a civil servant is declared illegal for a defect in disciplinary proceedings without attending to the merits of the case, the entitlement to back benefits may be put off till the inquiry is conducted in the matter finally determining the fault of the civil servant.

PHOTO: FILE ISLAMABAD: Supreme Court's Justice Qazi Faez Isa on Thursday maintained that Supreme Judicial Council (SJC) members former top judge Asif Saeed Khosa and Justice (retd) Sheikh Azmat Saeed were biased against him. A 10-judge larger bench headed by Justice Umar Ata Bandial took up a review petition against the apex court's June 19 order wherein the Federal Board of Revenue (FBR) was directed to proceed against the undeclared properties of Justice Isa's family members. During the hearing, Justice Isa accused SJC members, especially former CJ Asif Saeed Khosa and Justice (retd) Sheikh Azmat Saeed, of being biased against him.

Headed by Justice Umar Ata Bandial, the bench will also comprise Justices Maqbool Baqar, Manzoor Ahmad Malik, Mazhar Alam Khan Miankhel, Sajjad Ali Shah, Syed Mansoor Ali Shah, Munib Akhtar, Yahya Afridi, Qazi Mohammad Amin Ahmed and Amin-ud-Din Khan. On March 18, the full court had reserved its ruling on an application moved by Justice Isa seeking permission for live streaming of the hearing of review petitions in his case against the Supreme Court’s short order of June 19, 2020 and the detailed judgement on the filing of presidential reference against him.

PHOTO: EXPRESS/FILE ISLAMABAD: Supreme Court (SC) on Monday referred the matter of Justice Qazi Faez Isa and superior bars’ plea regarding the inclusion of three minority judges in the bench hearing the review petitions against the June 19, 2020 order to Chief Justice of Pakistan Gulzar Ahmed. Apex court Judge Justice Umar Ata Bandial announced the summary judgment whose written order is yet to be issued. Justice Manzoor Ahmad Malik disagreed with the verdict and would write his dissenting note. A six-judge larger bench, headed by Justice Umar Ata Bandial, on December 10, 2020, reserved the decision on the plea filed by Justice Isa, his wife and other petitioner bars regarding inclusion of three judges – Justice Maqbool Baqar, Justice Syed Mansoor Ali Shah and Justice Yahya Afridi – in the bench hearing review petitions against a judgment wherein the Federal Board of Revenue (FBR) was directed to conduct an inquiry into the matter regarding non-disclosure of SC judge’s family members’ assets abroad.
