A federal judge has dismissed a motion from the Michigan Association of Non-public Schools that asked for to be allowed to reopen high schools despite the state order prohibiting it.
An appeal of Maloney’s ruling is unlikely, since the plaintiffs got what they wanted in having schools reopen, said attorney Thomas Rheaume, who represents MANS. The group still plans to fight the state in court about the constitutionality of the order, he said.

Michigan officials need to take their own advice and “follow the science,” said attorney Richard Thompson, who is representing St. Michael Academy in a lawsuit fighting the state’s temporary prohibition of in-person high school classes.
It’s the second lawsuit filed in U.S. District Court Western District of Michigan by Catholic school officials targeting the state’s closure order in the past week. The Michigan Association of Non-public Schools filed a similar lawsuit last week.
The Michigan Department of Health and Human Services in-person learning ban is in effect through Dec. 20 due to COVID-19.

In response to Michigan’s temporary ban on in-person high school classes, a group of Catholic high schools filed a lawsuit claiming their religious freedom is being trampled.
Attorneys for the state argue the ban applies to all high schools, both private and public, secular and religious, and so it doesn’t violate the First Amendment freedom of religion.
The Michigan Association of Non-public Schools (MANS), an organization of 400 schools with 90,000 students, filed the lawsuit in federal court on Monday and requested a restraining order be issued against the state to halt the ban on in-person classes for religious high schools.
