China's Top 10 Cases of Administrative Trademark Adjudication

Wednesday, May 5, 2021
On April 26, 2021, China’s National Intellectual Property Administration (CNIPA) released the Top Ten Cases of Administrative Trademark Adjudication (2020年度商标行政保护十大典型案例).  Administrative adjudication in China is an alternative to conventional civil litigation and can be quicker and less expensive than litigation. That said, generally only fines and injunctions are issued in administrative enforcement actions.  Those seeking damages should file litigation at a People’s Court instead or in addition.
The following are approximate translations of the summaries of the cases and expert comments as published by CNIPA.  The original text (Chinese only) is available here: 2020 年度商标行政保护十大典型案例.

EWC Insights: China Seminar featuring Dr. Dru Gladney

This talk examines the rise of the “Xinjiang Problem” in Sino-US relations and the recent events involving the Uyghur in China’s Northwest Region.  Some have suggested that China has already engaged in a “genocide” in Xinjiang as early as the July 5, 2009 riots in Urumqi.  While the state media attribute the Uyghur activism to radical Islam and separatism, none of the protestors have called for jihad or an independent “Eastern Turkistan,” and the former US Secretary of State Michael Pompeo on his last day in office formally listed the treatment of the Uyghur as “genocide.” President Biden’s administration has not backed away from this designation. Internationally, the Uyghur diaspora helped to call global attention to the “education camps” that Chinese media initially denied, then attempted to re-shape as “vocational centers” through carefully edited reporting and selective coverage.  This t ....

China's Crackdown on Muslims Extends to a Resort Island

China’s Crackdown on Muslims Extends to a Resort Island
The Utsuls of Hainan island were once celebrated by the government for their links to the larger Muslim world. Not anymore.

SANYA, China — The call to prayer still echoes through the alleys of Sanya’s nearly 1,000-year-old Muslim neighborhood, where crescent-topped minarets rise above the rooftops. The government’s crackdown on the tiny, deeply pious community in this southern Chinese city has been subtle.
Signs on shops and homes that read “Allahu akbar” — “God is greatest” in Arabic — have been covered with foot-wide stickers promoting the “China Dream,” a nationalistic official slogan. The Chinese characters for halal, meaning permissible under Islam, have been removed from restaurant signs and menus. The authorities have closed two Islamic s ....

There are
three aspects to a local discussion on China, the role of China in Sri Lanka,
the role of China in the world and the role of China in Marxism. Let us start
with the last item.
The latest development
in Marxism is ‘Socialism with Chinese Characteristics,’ said analysts.
    China is now projecting its
brand of Communism as a possible model for other countries and western economies
should take a look at it.
China has
developed a socialist economy, where government and state-owned enterprises
have played a prominent role in promoting industrialization and agricultural ....
