Vanuatu: Legislative changes raise media freedom concerns

The Pacific Freedom Forum has warned that legislative amendments passed by the Vanuatu Parliament could be used to attack journalists who publish critical reports on politicians and government policies.

It has come to the Pacific Freedom Forum’s attention that the Vanuatu Parliament has recently passed a bill amending their Penal Code Act.
The amendment to the Bill for the Statute Law (Miscellaneous Provisions) Act No. of 2021 stipulates that Threatening language, Criminal Libel and Criminal Slander on any public platform could warrant a criminal offence and offenders could face three (3) years imprisonment.

Vanuatu Parliament summoned for later this month

There are six bills listed for discussions. These include; Bill for the Public Health (Amended); Bill for the Value Added Tax (Amended); Bill for the Tax Administration (Amended); Bill for the Statute Law (Miscellaneous Provisions); Bill for the Citizenship (Amended) and Bill for Dangerous Drugs (Amended).
During the session, parliamentarians are also expected to debate three written motions.
They include the Motion for Indemnity for AstraZeneca (Covid-19 vaccines), Motion for the Re-establishment and Appointment of Members to the Parliamentary Standing Committees and Motion to establish the Ad-Hoc Committee to consider the Bill for the Commercial Government Business Enterprise Act.

Bid to steer universities away from certificate courses flops

A second attempt to stop universities from offering bridging, diploma and certificate courses has failed after the High Court dismissed a case that would have locked out learners from transitioning within the institutions.
Justice James Makau in his judgment in a case filed by Robinson Kioko, said that the law is clear on what qualifications each student should have to be enrolled for a course as well as the number of contact hours of study.

'Cocktails to go' order gets pushback from NC sheriff's group. Governor can't override the law, says attorney.


Why not start 2020 with a dry month?
The N.C. Sheriff's Association is questioning the legality of how cocktails and other mixed adult beverages can be transported through the carryout service permitted by Gov. Roy Cooper.
On Monday, Cooper issued Executive Order No. 183, which permits businesses to offer carry-out and delivery of cocktails between 9 p.m. and 2 a.m.
Businesses offering the option must hold permits from the state ABC Commission. The order lasts through at least 5 p.m. Thursday.
Meanwhile, state Treasurer Dale Folwell is citing Cooper's order as another example of the governor giving Council of State members little heads-up when seeking agreement for a statewide order.

Kenyan government takes another shot at infringing privacy and digital rights

The Kenyan government has signed a new bill that will let it demand access to data from its citizens’ cell phones, laptops, and other ICT gadgets which it believes has implications for national security. 
On December 12, 2020, Kenya’s President, Kenyatta Uhuru, assented to the Statute Law (Miscellaneous Amendments) Bill, 2020 that amends the country’s Official Secrets Act, 1968, among other laws. 
The Bill states that Kenyans with mobile phones or other communication devices will be required to provide emails, WhatsApp messages, SMS or any other data which the government deems a threat to national security. 
Those who refuse to provide the data upon demand run the risk of serving a one-year jail term and/or paying a fine of Ksh1 million (~$9,000).
