俩小伙利用优惠券"薅羊毛"45万被捕律师："薅客"行为属于盗窃 |薅羊毛

　　“这明显是商家玩不起了，用户自己注册多个新用户账号，拿走新人优惠价，凭什么说违法就违法了?”有网友这样议论。
　　“平台自身没能力检测到虚假账号，被人薅了羊毛，应该想想怎么完善系统漏洞，而不是拿着法律的大棒挥向消费者。”也有网友打抱不平。“嫌疑人注册大量虚假账号，这已经属于欺诈了。”有网友说，“平台给用户发放福利是给广大消费者的，不应被专业的一两个薅客利用海量账号拿走。”“有的平台推出活动，老用户推广新人注册就发100元红包。我拉了好多亲朋好友注册平台，最后我领到了红包，可我这些亲朋好友并没有在平台上消费，反而注册完后就卸载了，我这不算违法吧。”有网友说。
　
　　7月13日，华商报记者注册了一款买菜App。该平台提供了价值108元的新人优惠券，其中有100元减免30元的优惠券一张。使用该优惠价购买原价159元的某品牌花生油，实际只用支付129元，优惠了30元。如果将这桶花生油以140元转手给需要的人，对方则节省了19元，而抢到优惠券的赚了11元。至于发放优惠券的平台，并没有因低价促销赚到新的用户。
　　在多个购物平台上记者注意到都有针对新用户的大额优惠券，甚至有的平台会有专属于新人的优惠价。“通常一款购物平台，发展一名新用户的成本在50元至100元。”曾就职于某购物App运营的小张说，“购物平台在推广期往往是赔钱赚吆喝，自己贴钱来发展用户，并将新用户转化为老用户。如果这些新用户并非真实消费者，而是被专业的‘薅客’利用平台漏洞，注册海量虚假账号薅走了平台推广期发放的福利。平台方补贴了巨额资金，却没发展到真实用户，这无疑是对平台造成了巨大损失。而且真实的新用户也会因为大量虚假账号抢走了本应属于他们的福利。”
　　
　　针对一些网友所说“薅客”只是利用了平台程序漏洞，“薅羊毛”不应承担法律责任的说辞，国浩律师(西安)事务所张兴茂律师说：“如果按照一些网友的逻辑，那就是在鼓励黑客技术合法化。现行法律，利用计算机程序漏洞牟利本身就属于违法行为。”
　　“商家发放推新优惠券，针对的是真实广大的新用户。而拥有大量虚假用户的‘薅客’，抢走这些优惠券，其行为属于盗窃。”张兴茂说，“普通人注册新购物平台抢优惠券，并没有什么不妥。商家也乐于真实用户注册消费。但这起案例，嫌疑人注册大量虚假账号，抢优惠券后转手倒卖，已经成为了他们的为生手段，而且谋取了巨额利益，已经触犯了刑法，构成盗窃罪。”
　　“根据刑法，诈骗罪是指以非法占有为目的，用虚构事实或者隐瞒真相的方法，骗取数额较大的公私财物的行为。”中国法学会会员张允光认为，在“薅羊毛”案件中，判断行为是否构成诈骗罪的关键是，行为人是否具有非法占有的目的，且采用虚构或者隐瞒真相的手段。
　　“普通消费者薅羊毛，是真实用户，购买也是真实的，消费行为属于参加商家低价促销，是合法的。”张允光说。
　　陕西恒达律师事务所高级合伙人赵良善认为，电商时代“薅羊毛”盛行，“羊毛党”已经成为一种互联网生存现象。如果仅仅是单纯利用规则漏洞的获利不构成犯罪，建议由商家自行修改活动规则，防范风险;如果“羊毛党”是通过假冒身份、虚假注册、修改软件等手段，以非法占有为目的，则构成盗窃或诈骗。根据《关于审理诈骗案件具体应用法律的若干问题的解释》规定，个人诈骗公私财物2000元以上的，构成诈骗罪。根据《最高人民法院、最高人民检察院关于办理盗窃刑事案件适用法律若干问题的解释》规定，盗窃1000元以上的，构成盗窃罪。诈骗数额低于2000元的，盗窃低于1000元的，可根据《治安管理处罚法》第49条规定，对其治安处罚。
　　赵良善还表示，如果行为人通过购买、交换或网络下载等方式获得私人手机号码等个人信息，用以在网络平台注册换取首单优惠等，还构成侵犯公民个人信息罪。
