FWS Malathion Pesticide Report Condemned by House Natural Resources Committee Chair

The U.S. Environmental Protection Agency (EPA) announced on Tuesday that it is seeking public comment on the U.S. Fish and Wildlife Service’s (FWS) draft biological opinion for the registration of malathion, an insecticide commonly and currently used to control mosquitoes and other insects that attack fruits, vegetables, plants, and shrubs. The biological opinion reportedly follows a January 2017 biological evaluation, which determined that the pesticide would likely have adverse effects on 78 Endangered Species Act-listed species and 23 designated critical habitats.
House Committee on Natural Resources Chair Raúl M. Grijalva (D-Ariz.) assailed the findings, claiming that the draft opinion makes clear that the EPA must ban malathion as soon as possible. In his office’s press release, Rep. Grijalva asserted that the opinion contains “the most severe findings of harm and risk FWS has ever published on a given substa ....

Trump environmental legacy stumbles in court

When a federal court ruled the federal Bureau of Land Management skipped crucial steps in approving resource management plans for Montana last year, it reflected a trend tainting much of the environmental rule-making under the Trump administration.
“They’re having a remarkably low level of success,” Georgetown Law School environmental law professor Bill Buzbee said of the past four years’ regulatory court progress. “Their loss record is 70 to 90 percent under Trump. Those agencies usually win 70 percent of the time.”
He attributed the reversal to a consistent failure by policy makers to check all the boxes necessary to avoid appearing arbitrary and capricious — the standard federal rules get judged under the Administrative Procedures Act. To endure, a federal rule must show it had well-documented reasons for a change and went through a complete public review process. ....
