Arzelle Lewis Had a Game Plan for His Father, Starting With Clemency

A towering presence at 6’4”, Harris had played a semester of college ball in Texas before dropping out of school. Now he could reach his son in ways that others couldn’t, sticking an elbow in Lewis’s back and swatting his shots away one moment, pumping him up the next. Lewis was already tough, but as his sessions with his father continued, he showed new self-determination and faith in himself.
But then Harris vanished. When Lewis finally found out where his father was and how long he would be gone this time, it “felt like he died,” he remembers.
Charged with possession of 4 ounces of cocaine in Denver, Harris had expected a slap on the wrist. Maybe ten years, max. Defense attorneys estimated something closer to twelve years. But prosecutors played off Harris’s past cannabis convictions, and the judge sentenced him to 96 years in prison. ....

Colorado Governor Grants Clemency to Man Sentenced to 96 Years Because of Marijuana Offenses

But times change, and so does the criminal justice system. According to the attorneys working on behalf of Harris, he likely would ve received a sentence of something closer to eight years if he were convicted under today s laws, since those marijuana offenses, though still illegal, aren t typically used to enhance sentences, as they were twenty years go.
I’m not saying that I’m innocent. I just want the sentence to reflect the charge. Two of the felonies are marijuana charges. Marijuana is now legal in Colorado. After twenty years of incarceration, I now realize after thorough reflection of myself, I can see that my past was crippling to society, my family and children, and also myself. I’ve paid greatly; my family members have died and moved on; my children have grown up without me, which affected them mentally and emotionally. I have grandchildren that know me not, Harris wrote in a letter to Governor Jared Polis. ....

Colorado inmates, relatives call coronavirus a death sentence, urge more early releases

At 84 years old, Anthony Martinez is nearly blind and deaf. He can no longer walk on his own and his kidneys are failing. He struggles to write his own name, his niece says, a sign of brain deterioration after more than 30 years in prison.
And though he seemingly poses little threat to anyone, he remains confined at Sterling Correctional Facility, among those at highest risk of falling victim to COVID-19, which has sickened hundreds of his fellow inmates and killing six at the northeast Colorado prison.
“I’m afraid the first time I see my uncle is going to be at his funeral,” said his niece, Kelly Brasier, who has been working to secure his early release.  ....
