Federal court orders Arizona Department of Corrections to trial over inadequate healthcare

The US District Court for the District of Arizona Friday ordered the Arizona Department of Corrections, Rehabilitation and Recovery (ADC) to trial for failure to make agreed-upon progress toward prison healthcare reforms.
The case against ADC was initially filed in 2012 by 15 people incarcerated in Arizona facilities on behalf of all the other inmates. Among other things, they alleged “inadequate nutrition, medical, dental, and mental health care, and access to exercise, as well as ‘extreme social isolation. ”
The case stalled in February 2015, when the court approved what appeared to be a “fair, reasonable, and adequate settlement.” This approval was based on a stipulation from the parties which required a “specific period of monitoring and possible enforcement” by ADC. ....

A federal judge has scrapped a six-year-old class action legal settlement over inmate health care, blasting the Arizona Department of Corrections for not complying with its obligations.
U.S. District Judge Roslyn Silver said millions of dollars in fines and repeated judicial warnings haven t forced the state to comply with the agreement. So she is ordering a trial.
Defendants have in the past six years proffered erroneous and unreliable excuses for non-performance, asserted baseless legal arguments, and in essence resisted complying with the obligations they contractually knowingly and voluntarily assumed. Silver said in her 37-page July 16 order. The present situation must end. ....

Mobile: A south Alabama hospital that vaccinated thousands of people against COVID-19 plans to send a team to do immunizations in Peru, which has been hit hard by the pandemic. USA Health said more than 20 volunteers will travel to the country’s Cusco region. CerviCusco, a nongovernmental agency in Peru, sought the assistance, the health system said in a statement. “Our plan is to travel to Peru in mid-August, establish processes and protocols for safe and efficient vaccine distribution in the region with a goal of providing 5,000 doses to the people of Peru,” said Natalie Fox, assistant administrator and chief nursing officer for USA Health Physicians Group.
