Jennifer Christian, a former employee of Umpqua Bank, alleged she was sexually harassed by one of the bank’s customers in violation of Title VII and Washington state law. Among other things, the customer dropped off “small notes” stating that Christian was the “most beautiful girl he’[d] seen” and that he “would like to go on a date” with her. After Christian informed the customer that she was not interested, the customer sent her a long letter stating that she was his “dream girl” and they were “meant to be together.” Flowers and references to their being “soulmates” soon followed. The availability of a reasonable accommodation is an element of a claim under the Fair Employment and Housing Act for failure to engage in the interactive process.
The Workers’ Compensation Act does not bar emotional distress damages where those damages arise from an employer’s failure to provide reasonable accommodations or engage in an interactive process, rather than because of a physical injury suffered at work. 
Facts: Plaintiff Anahit Shirvanyan, an assistant kitchen worker for Defendant Los Angeles Community College District, was diagnosed with nerve damage and carpal tunnel in her wrist in 2014. Superior Court, Case Number B298318 (2020), reversed itself and, following the California Supreme Court’s guidance in Ward v. United Airlines, Inc. 9 Cal.5th 731 (2020) and Oman v. California Wage and Hour Laws Extend to LA Offshore Workers

Which state’s wage and hour laws apply to Louisiana employers whose employees applied and interviewed for their jobs in Louisiana, acknowledged receipt of employment documents in Louisiana, and resided in Texas, Mississippi, and Ohio while they worked offshore?  The answer, according to the California Court of Appeals, is California if the employees are based in California.
In 
Gulf Offshore Logistics, LLC et al. v. Superior Court of Ventura County, employees worked on a vessel that provided maintenance services to offshore oil platforms located outside California’s boundaries. The vessel docked in a California port, and employees reached it by flying into and out of Los Angeles. The vessel sailed through the Santa Barbara channel (which is within California’s state law boundaries), but also sailed outside of California waters including to the oil platforms where employees performed their work. ....
