Lawmakers plan to question her on the Affordable Care act. The Supreme Court hears that case one week after the election. She has been on assignment to the Supreme Court by President Trump, and we know what that assignment is eliminate the Affordable Care act. Reporter democrats are asking the Justice Department for whats missing from her application, a 2006 letter opposing womens reproductive rights. A vote for judge barrett is very simple. Its a vote to take Health Care Away from 20 million americans. Its a vote to strip protections. Reporter judge barrett is expected to attend in person at least four will appear virtually. One tested positive. Others, including Vice President ial nominee kamala harris, are concerned about the lack of precautions. Instead of zoom calls theyll be heading to campus due to lower numbers. They voted on having students head back to class with social distancing measures in place. With the students sitting six feet apart. Teachers and parents objected. The district is moving forward with prek through first starting today and then two weeks later second and third graders, fourth and fifth in november, middle schoolers and High School Students wont head back until january. Now this all comes as california has seen a dip in covid19 positivity rates. Other School Districts such as alameda have been allowed to reopen but districts are Still Deciding how to implement those plans. Two vallejo teachers are on administrative leave this morning after a viral recording seemed to capture them criticizing students. The district interim superintendent released a statement saying the district plans to evaluate policies and procedures for online instruction and regrets if any students were offended. Developing right now, a lot of Unanswered Questions this morning after a driver plowed into an Outdoor Dining area in san jose critically injuring two people. The video shows the chaos just after that happened yesterday afternoon at an Outdoor Dining area in the grand century mall. Authorities say a 69yearold man accidentally hit the gas on his suv which then plowed into the diners injuring eight people sitting at several different tables. Witnesses tried to yell to customers to get out of the way but the car was moving too fast. The back wheels started spinning and smoke started coming out. What is he doing . He jumped the lane. The driver was taken to the hospital with minor injuries. Witnesses say he was despondent offwards. They believe he may have suffered a medical emergency. Indoor dining could return to santa clara county. In just a matter of days. Right now, like most of the bay area, its still in the red tier. The county could move into the orange tier as soon as tomorrow. If that happens more businesses and activities will be able to reopen. Indoor dining would be capped to 25 or 100 people whichever is lower similar to what San Francisco is doing now. In the next 24 hours we should get a better idea if parts of the bay area will suffer through another power shutoff this week because of high fire danger. Pg e says that if the conditions materialize large sections of some of its Service Areas may feel the impact but others in the north bay hills, most of the impacted hills will be east and north of the bay area. New details in a deadly shooting of a rightwing demonstrator by a Security Guard which was all captured on camera in denver on saturday. It happened during protests between rival groups and in the video the victim could be seen spraying mace at that guard before that guard then fired. A local agency now says of the suspect who was hired by the nbc didnt have a record. That suspect is being held without bail. A concord family says pg e caused their air conditioning to malfunction. When the lights came back on, they say thats when the problem started. The power surge caused our air conditioning to malfunction. We sent a claim in to pg e and they denied the claim shortly after. E, we regret we are unable to reimburse you for your damages. They say the power coming back on caused the damage and that was within pg es control. So they turned to us. We reached out to pg e. After some back and forth it agreed to reimburse 325. Thats what they paid to fix the ac. We asked pg e for comment. They only told us we reached out to mr. Gokhman and the issue has been resolved. Whats going on right now . The nimitz is still the problem right now, kari. The nasty nimitz, the nickname. Not because of overnight road work. Northbound at 29th, things have changed. The backup built and the map shows you things over near 29th are getting easier for those Speed Sensors. I think were starting to see the crews move earlier than 6 00. Big rigs have been allowed for westbound 580 because of the backup and an earlier crash which bogged things down. Now we see free throw month with slowing. Well talk about that coming up. Republicans say they are confident that they have the votes to have her confirmed by election day but democrats say the proceedings should be postponed because of the spread of coronavirus on capitol hill. Experts say judge barretts criticism of the courts 2012 ruling on obamacare and her conservative views on abortion will both be hot topics. We are tracking the confirmation hearings of the Supreme Court nominee from start to finish. Decision 2020 and the surge in early voters across america is already unprecedented for this president ial election. More than 9 million americans have already voted. Today in the bays bob redell joins us live in san ramon. Contra costa county is one place thats already experiencing that big surge in voters. Reporter correct, laura. Some people are dropping off their ballots at these boxes. We had two people just pull up here in the Early Morning hours of monday morning. More are mailing them in. We spoke with the Contra Costa County registrar of Voters Office and said as of friday nearly have been returned, almost 10 of the vocounty. Typically by this time in another general election they would have expected between 200 and 500 ballots. Theyre already at 70,000 so you get a sense of how great the interest is in this election. Yesterday a voter did find the door to the ballot dropoff box unlocked in danville and partially open as you can see in the photo. Inside was a bin of ballots. The Deputy Registrar of voters tells us his office had just been at that site, that was an mistake. He doesnt believe anyone tampered with the ballots. I inspected the box. It had about 100 ballots in it that were deposited when it wasnt secured. Im very upset. Its disturbing to see a ballot box left unlocked. This is what were all worried about. Reporter if you deposited your ballot in that box between 11 00 and 1 00 yesterday and have any concerns, you can track your ballot online. Its worth noting yesterdays ballot box incident comes amid increased scrutiny of the mailin ballot process but despite claims of fraud by the president of the United States no evidence to indicate that any has occurred. The Orange County registrar reports unofficial ballot boxes are being set up outside local Republican Party offices. Idate churches in the central valley, in fresno. Breaking news in the south bay right now, also at 5 35, a deadly shooting is shutting down busy roads in san jose. This happened about 2 00 this morning at story and king roads near the 101 680 interchange. San jose police tweeting about the shooting saying the victim is an adult man. There is no suspect description at this point. This is the 33rd homicide in san jose for 2020 and no word yet on when the roadways will be open again. San jose is celebrating its first Indigenous Peoples day after a vote last week. Last week mayor sam liccardo and the city council declared a proclamation. It follows many other cities like berkeley that already changed their celebration date from columbus day to Indigenous Peoples day. Its happening as a lot of activists are calling for statues of Christopher Columbus be removed. One statue near coit tower was removed earlier this year. Not everybody is happy with that decision. The Vice President of the Italian AmericanHeritage Foundation is holding a zoom call. Ken believes its purely political and says he cant believe the holiday was changed during a pandemic when a larger discussion could not happen. Some good news in the north bay. Most all of the evacuation orders and warnings now lifted from the glass fire. Now more than 90 contained after destroying more than 600 homes and damaging numerous wineries in napa and sonoma county. Leaders in the north bay have their eyes helping the homeless make it in the bay. Sonoma county leaders are looking to transform a hotel into Affordable Housing for the homeless. The county has now received nearly 11 million from the state to buy hotel azura located on college and mendocino avenues in santa rosa. The goal is to curb homelessness during the pandemic. Several neighbors have tried to block the sale of the hotel and now have a case pending with the state. Similar programs are already moving forward in other cities like san jose, milpitas and pittsburg. Well, the city of angels may be a little sleepy this morning. They partied late into the night as the team won its first nba championship in ten years. Its got to be so hard, though. Were not supposed to be gathering. You can see a lot of folks who were celebrating were gathered near the staples center. Theyre not really adhering to that advice to keep social distance. Not a lot of masks there in the crowd either. Firefighters say a mother drowned on friday night while swimming near zephyr cove. The woman jumped from a boat with six children onboard. The father then jumped in with a life vest to try to save her as the boat floated to the middle of the lake. Rescuers later pulled him alive from the water but he did suffer from hypothermia. 5 44. Hearings to confirm President Trumps nominee on the Supreme Court get under way this morning. Kamala harris will be one of the senators questioning judge Amy Coney Barrett. Thats right. It would no doubt be a smart strategy for the other democrats on the Judicial Committee to let her take center stage for her party in the nomination process. Harris is well remembered for her tough questioning of brett kavanaugh. Harris is a former prosecutor, former state attorney general. She is good at crossexamination. Coney barretts nomination a fo foregone conclusion. They say they will never prejudge a case and cant comment on whatever hypothetical the senators dream up. Harris could ask her a great deal about the white house event on september 26th. The one dr. Fauci is now calling a super spreader event. Why did she not wear a mask . Why did her family not wear a mask . Does she feel any personal responsibility to protect white house staff . One of the terms you will hear as we talk about the Supreme Court is called court packing. A viewer asked us to explain what that is. The republicans are pushing this nomination through very close to the election. Something they said they would never do in the past. If Coney Barrett is approved. However, the constitution is very vague about the idea of the Supreme Court. It basically just says Congress Needs to set one up but never says how many judges should sit on the Supreme Court. Its nine right now. Theres no rule and if democrats won the white house and the senate they could appoint more judges and realign the court. Now that would be a huge violation of tradition but would not be unconstitutional. Biden for his part has not said one way or the other what he would do saying he will have to wait until after the election to find out whether he will pack the court. We want them to tell us what theyre going to do. You may have seen this ad during the Football Games on sunday. Dr. Fauci appears to be praising the action fighting coronavirus. President trump tackled the virus headon as leaders should. I cant imagine that anybody could be doing more. Well get through this together. He says that was taken out of context.
