Berkeley has become the first city in the United States to declare itself a sanctuary city for cannabis users. The city council anoon unanimously approved the measure last night. It is modeled after a sanctuary city policy. Cannabis sales become legal in california on january 1st. It puts the state in front of federal law that still lists marijuana has a class 1 drug. Once the resolution was passed, the mayor tweeted that berkeley may be the first city in the country to declare itself a Sanctuary Cannabis city. They also are reducing the tax on marijuana sales from 10 to 5 . That was in response to licensed cannabis dealers who couldnt compete with unlicensed sellers who dont pay taxes or comply with regulations. Last night in san jose, friends of the 19yearold woman who died after being stabbed and dumped on a rural road near livermore gathered for a vigil to remember her kindness and strength. The struggle to survive the woman touched a lot of people. They gathered at the great oak skate park in san jose. She was new to skateboarding but loved the sports challenge. Friends say they will always remember how determined lissette was and they believe that kept her alive long enough to tell authorities who killed her. She fought like until the end. Just to get also the people who did this to her. So just to honor her courage and her like her will to get justice former. Investigators say she knew the couple that is charged with killing her and she willingly got into the car with them. But officials dont know why she was killed. The two suspects are 19year old daniel gross and his 25 yearold fiance melissa leonardo. They were arrested in modesto at a home they share. Theyre scheduled to be charged this afternoon with murder and are being held without bail at the santa rita jail in dublin. Now to hercules where five young people are under arrest on suspicion of car breakins. Police responded to a breakin on Willow Avenue just before 11 00 last night. Officers were told that the suspects ran to a nearby Church Parking lot and police were able to track all five of them down. The suspects range in age from 15 to 18. Officers recovered a bb gun and devices that small holes in car windows. A former uc berkeley who was removed from a Southwest Airlines plane in 2016 after he spoke arabic has filed a lawsuit against the airline claiming his civil rights were violated. Back in april of 2016, he was seated on a Southwest Airlines flight at lax and was waiting for the plane to take off for oakland. He called his uncle and a passenger who heard him speaking in arabic reported him to the airline crew. He was escorted off the plane and interrogated and searched by the fbi. After he was cleared by the fbi, southwest refunded his plane ticket but refused to book him on another flight. Now, in a previous statement back in april of 2016, southwest said the passenger who made the complaint also spoke arabic and asked the flight crew to investigate what were perceived to be threatening comments. Well, southwest said, and im quoting, it was the content of the passengers conversation, not the language used, that prompted the report leading to our investigation. Sonoma county is trying to take lessons from last years wildfires and apply them to possible disasters in the future. Work crews are installing rain and stream level gauges in parts of the county that burned. They could provide information which shows which burn zones are in danger of mudslides and flooding during winter storms. There are concerns because of the rainfall. People are to clear all bush within 30 feet of their home. That could be extended to a wider area. Now survivors of the wildfires are selling their property instead of rebuilding. Now the county is hoping to make it easier and less expensive to get the permits need today rebuild homes. More than 2,000 Housing Units were lost in the fires in unincorporated parts of Sonoma County. Now they can go to a Resiliency Center where the permits will be processed quickly. Fire survivors come here with every service they need under one roof. People are moving through the entire permitting process in one to three days. Theres a lot of people around us who are selling and leaving because it is so difficult. Sonoma county officials hope that having all of the permitting services in one place will help more people stay in the neighborhoods. The center is expected to stay open for about three years. New from overnight, a Vallejo Police officer shot and killed a suspect after a violent struggle. Ktvus alex savidge is live in vallejo where investigators are looking into the circumstances of what led to that gunfire. Reporter and gasia, a relative is telling us that the man who was shot and killed may have been wanted for questioning in connection with a Domestic Violence call earlier in the night. He was riding his bike in this neighborhood in vallejo when an officer tried to stop him. He ditched his bike and started running down carolina street just off of marin. And the officer chased after that man, caught up with him near an apartment complex on the left hand side of the street. There was a struggle and then gunfire. The shooting happened at about 7 40 last night. The officer was involved in what authorities describe as a violent physical struggle with the man who had been on the bike. During the altercation, the officer fired his gun, striking the man who ultimately died here at the scene. According to a relative, again, this all began with some sort of a domestic dispute between that man on the bike and the mother of one of his children. She apparently called police for help. And thats when the officer spotted the man nearby on his bike and there was the chase and that led ultimately to this deadly shooting by the vallejo officer. The man who was killed has not been identified yet by authorities. The officer who opened fire last night has been put on leave and in an email statement sent out, Vallejo Police tell us that the officer who opened fire last night did so in self defense. Of course there will be a full investigation that is done. That will include investigators from the Vallejo Police department as well as the Solano County District Attorneys Office and they will try to determine the circumstances here of this deadly shooting by Vallejo Police officer, trying to figure out, gasia, if in fact he was justified in opening fire. The white house says President Trump has been briefed and we will bring you more details as we get them. The president s personal attorney is now saying he used his own money to pay an adult film star who claim today have a sexual relationship with donald trump. Michael cohen says he gave Stormy Daniels 130,000 back in 2016 according to a New York Times report. It was to keep her from publicly discussing the affair during the president ial campaign. Cohen says the payment was lawful, adding he was not reimbursed by the Trump Organization or the trump campaign. Another legal set back for President Trumps plan to end the daca program. A federal judge in new york ruled that the Trump Administration did not announce enough reasons for ending the program on march 5th. The Justice Department says daca is illegal because it went around congress. But the federal judge says the program is legal and therefore the administration doesnt have a legitimate reason to end it. However, the judge says his ruling doesnt mean that the government should be force today allow more people into the program. It simply means the current daca participants should stay protected. Now, on friday, the Supreme Court may announce if it will hear the case. In the meantime in the u. S. Senate, the immigration debate continues today. Yesterday there was very little progress at the u. S. Capitol. Senate republicans are pushing for plans that address things like chain migration reform and sanctuary cities. Democrats, they want a bill that is more specific to the young people in the daca program. Still, Senate Leaders from both sides seem optimistic there could be a deal. Were waiting to hear from the San Francisco Unified School District for an update on the students conditions this morning. We know ten had to get medical attention. Five had to go to hospital. According to firefighters from the scene, at least one of the students had severe reaction to whatever substance these students consumed. Lets show you the video. You can see sky fox overhead as one of the students was being wheeled into an ambulance. The other big question this morning, what exactly did the students eat to make them sick . We are waiting to get that information as well. We havent been updated on that. Firefighters said they would be working with the district and the hospital and local poison control officials to answer that question. Several students told ktvu and their parents that a female student had passed around what may have been marijuana laced candy and Prescription Medication as well. Thats what a student told ktvu yesterday around 1 00 in the afternoon. Again, what the students consumed that made them sick is still under investigation. We spoke with a parent who said she was planning to have a good talk with her taught to make sure that this sort of thing doesnt happen to her. It was kind of upsetting. Like i dont really it is weird to know that people my age are doing drugs and stuff. A little panicked driving over here. Because she wasnt texting me back. And the school wasnt answering. And i get news alerts and texts from other patients. Other parents. Reporter the School District will have counselors on hand to talk about the students about what happened and encourage them to avoid this thing in the future. Theyre accused of running a rental scam for years. Mohammed and abi were arrested last month. They face 45 felony fraud and id theft charges between them. A woman who doesnt want to be identified says her family rented out a 2 million home to the brothers but their deposit and their rent checks bounced. Now, when the brothers were being evicted, they dragged out the case in court for months and basically lived rent free. And they knew how to gain the system with at least at least Alameda County. What would allow them to basically blow off going to court and prolong their stay. Now, police say once the brothers finally moved out, they pulled the same scheme two streets over. His Defense Attorneys are asking the court to dismiss one of the charges because they are too similar. His Defense Attorneys are accusing the Trump Administration of targeting her white house saying they want to politicize the issue and make him an example of immigration reform. San francisco supervisors approved a 250,000 payout to a firefighter involved in the response to the plane crash at sfo in 2013. Investigators say firefighter aleece duckett ran over a teenage was ejected from the plane and lying on the ground covered in Fire Fighting foam near the plane wreckage. According to the lawsuit, she was being made a scapegoat for larger failures in the Fire Departments rescue efforts. City of san jose has picked three possible locations for a Tiny House Community for the homeless. In chicago, an Investigation Continues into yesterdays deadly shooting where an off duty Police Commander was killed while chasing a suspect. Paul bower was in Downtown Chicago for a meeting when he spotted a man that Police Officers were running after. The 53yearold commander confronted that suspect. Officials say he was shot several times as he struggled with the suspect. Chicago Police Superintendent Eddie Johnson was choking back tears as he talked about the 31 year police veteran. I got a brief update from a School District spokesperson who says they are waiting to get an update on the condition of the five students from James Lick Middle School that had to go to the hospital yesterday after consuming an unknown substance. At least one of the five students had a stronger reaction to whatever they ate compared to the others. The big question this morning is what exactly did they eat that made them so sick. You can see with sky fox overhead, they had to wheel one of the students into an ambulance on the way to the hospital. Firefighters said they would be working with the district, the hospital and the local poison control officials to answer the question of what did they eat. Several students at the school told ktvu and their parents that a female student was passing around what may have been a marijuana laced candy and possibly Prescription Medication as well that. Is according to several students who were at school when it happened. Parents at james lick yesterday were understandably upset by what happened. And one parent said she would be talking to her daughter about the whole situation. These are babies. This is a middle school. My kid is in 6th grade. Now i have to be im going to be on bart explaining the whole situation to her, exactly what they could have consumed and how she needs to look out and make sure that she never consumes it. Reporter the district plans to have counselors on hand today to talk to the students about what happened and encourage them to avoid this sort of thing. Again, the only thing that we have heard from skull district officials this morning is that they are waiting for updates on the students condition. Ten got sick and five went to the hospital. Happening today the couple suspects of stabbing and killing a young woman and leaving her on a remote road in Alameda County will make their first court appearance. The couple will be charged with murder when they appear in court this afternoon. They were arrested in modesto at the home they share after the defendant was left to die. Friends of cuesta remembered her kindness and strength. They gathered at the great oak skate park in the city. She was new to skateboarding but loved the sports challenges and the connection to the sport. Cuesta demonstrated her determination as she struggled to stay alive long enough to tell authority whos killed her. She fought to the end to get the people who did this to her. So i guess just to honor her courage and her like her will to get justice for her. Investigators say cuesta knew the suspects and she willingly got into the vehicle with them. What they do not know yet is why she was killed. The Solano County d. A. s office and Vallejo Police are investigating a Deadly Police shooting, one that happened at 7 40 last night. A Patrol Officer conducted what was described as an have egg tiff stop at marin and florida streets. Authorities say the suspect tried to run away and the officer gave chase. Were told there was a violent struggle. The officer says he then fired his gun in self defense. The suspect was pronounced dead at the scene. There is no word on the suspects name or gender even. The officer was placed on administrative leave pending the results of the investigation which is standard protocol. Were monitoring a developing story of a shooting at the National Security agency outside of washington, d. C. Shots were fired at a black suv at the entrance of the facility this morning. There were bullet holes on a front windshield. The Associated Press reports that a suspect was stopped at the gate and wounded. And has since been transported to the hospital. There were earlier reports that as many as three people were hurt but there is no official word that there were injuries. The time is 8 07. Quite a scare for passengers on a flight from sfo to hawaii yesterday after an engine cover fell off over the pacific ocean. Look at the pictures taken bypass engineers. San francisco supervisors have approved a payout to a firefighter involved in the plane crash at sfo in 2013. Investigators say firefighter aleece duckett ran over a teenage was thrown from the plane during the crash. The coroners report later said the teenager was still alive on the ground covered in Fire Fighting foam near the wreckage. According to the lawsuit she says she was being made a scapegoat for larger failures in the rescue efforts. The teenager died along with two other people. A former uc Berkeley Student who was removed from a Southwest Airlines plane after he spoke arabic has filed a lawsuit against the airline claiming his civil rights were violated. He was seated on a southwest flight at lax waiting for the plane to take off for oakland. He called his uncle and a passenger who heard him speaking in arabic, reported him to the airline staff. He was escorted off the plane and interrogated and searched by fbi agent. After he was cleared by the fbi, southwest refunded his ticket but refused to book him on another flight. In a previous statement back in april of 2016 southwest said the passenger who made the complaint also spoke arabic and asked the flight crew to investigate what were perceived to be threatening comments. Southwest said it was the content of the passengers conversation not the language used that prompted the report leading to our investigation. They watched the video from the saves body camera and say he was wrongfully killed. Bart police say officer joseph mateo responded to shots fired. Police say the officer said he was fighting with another man who had already been shot and that mateo warned him several times before he started shooting. The officer started shooting. His hands were coming up. And he gets shot, boom, boom, boom. Falls back on the ground like this. And nothing in his hands. He didnt drop anything. We will continue to get the facts. Relatives of the man who was shot and killed last night by this vallejo officer are telling us that he was not armed and in the Police Account of what happened, there is no mention of the man having a gun. According to his uncle who i just spoke with, the man who was killed last night was 32 yearold ranel foster. The father of two young children. According to authorities, a Vallejo Police officer was trying to stop foster as he was riding his bike in the neighborhood last night. According to police, he ditched his bike and then he took off running. The officer caught up to foster, behind some apartments in this area. And thats when there was gunfire. Shots fired 415 carolina street. Is the officer okay . Confirmed. Im okay. Reporter now, this shooting happened around 7 40 last night. Again, along carolina street just off marin. The officer was involved in what authorities are describing as a physical struggle, violent. Near the apartments the officer fired his gun, striking foster who ultimately died here at the scene. Now, according to relatives, this may have all stemmed from some sort of a domestic dispute between foster and the mother of his children. And that is why that Vallejo Police officer was trying to stop foster and potentially question him about what happened. Again, that officer spotted foster nearby on his bike. That led to a chase and then ultimately to this deadly shooting. Shooting. He never carried a gun. He never carried a gun. No. He was on a bike. We were told that he jumped off his bike and ran. And they shot him. Reporter and they shot him. Reporter again, relatives are telling us the man who was shot and killed last night by Vallejo Police was 32yearold ranel foster, a father of two. The officer who fired his gun last night has been put on leave. In a statement emailed to us, Vallejo Police say the officer fired in self defense. We know there will be a full investigation that will happen. It will include the Vallejo Police department as well as the Solano County District Attorneys Office and obviously investigators will be trying to figure out if the shooting was justified. According to his familys gofundme page, alex was shot during a robbery. Police found the novato man unconscious with life threatening injuries at about 9 15 sunday night in the area of 59th near horton street. The family says he is still in Critical Condition and has a long recovery ahead. Police are asking for anyone on the information on the shooting or a possible suspect to call him. Another set back for President Trumps plan to end the daca program. The judge says that there were not adequate reasons for announcing the program would end on march 5th. The federal judge says the program is legal and therefore the administration doesnt have a legitimate reason to end it. However, the judge also said that his ruling does not mean the government should be forced to allow more people into the program. It simply means the current daca participants should stay protected. On friday, the Supreme Court may announce if it will hear the case. In the meantime in the u. S. Senate the immigration debate continues. Yesterday there was little progress at the capitol. Senate republicans are pushing for plans that request chain migration reform and sanctuary cities. Democrats want more protection for those in the daca program. Today the senate is expected to officially start drafting an immigration plan. Berkeley has become the first city in the United States to declare itself a sanctuary city for marijuana users. The becky City Council Unanimously approved a measure last night prohibiting City Employees and police from cooperating with federal agent enforcing marijuana laws. Berkeley resolution is modeled after the sanctuary state policy that protects undocumented immigrants. It pits the state against federal laws that still classify marijuana as an illegal drug. Once the resolution was passed the mayor said it was the first city in the country to declare itself a cannabis sanctuary city. They will also lower the sales tax from 10 to 5 for cannabis.
