what prosecutors and police believe is him robbing and beating a man for just $7. the court records show the victim refused to cooperate. and that case was dropped. >> we have spent the last 24 hours, pouring over court records that are over a foot high, trying to say, what could have been done differently. and our conclusion is that we as prosecutors did everything we could. >> reporter: in pit-karen's case, charging documents reveal merit and wagner were on the hunt to rob someone, and he was in the wrong place at the wrong time, innocently walking back from penn station, on his iphone with his mom, who heard him on the phone. >> she heard screaming at him to give money. and he said, i don't have any cash, here's my wallet. she heard him start like screaming and making noises in pain. >> reporter: police raided this house just around the corner on maryland avenue, where they found the victim's blood on a door and on shoes. the victim's wallet, his iphone and several folding and fixed blade knives. back at the memorial, the victim's friend wrote of their love for him, of their pain now, how they'll never forget him, and their desire to make sure justice is served. and another live look here, pit-karen's mom said that she urged him to take a cab. but he loved to walk. she said the voice that she heard that was most aggressive on the phone was the man's voice. hotel remains closed after a pipe burst, forcing an evacuation. a live look from the marriott from sky eye chopper 13. vic is in the newsroom with the latest. the cleanup continues after the water leak forced nearly 1,000 guests at the hotel last night. the hotel was nearly at capacity. it happened on the fourth floor stairwell, and fled the hotel from the fourth floor down. guests were moved in. the majority of the marriott's guests were in town for a training conference. no word on the status of the conference that was supposed to start today. bge is also assessing the electrical system and elevators at the hotel to make sure all is safe. >> reporter: a former ups worker faces murder charges tonight. and prince george's county murder investigators are calling the man a serial killer. jason thomas scott is charged with two counts of murder. a grand jury indicted him in the 2009 slayings of a nurse and her daughter. the women were found in a burning car in largo. police believed the killing were found in connection with the murder of a mother and daughter. the suspect is already in custody on federal drug and sex charges. a new baby thrown out of a home in a plastic bag. tonight, the mother and baby are in a hospital. mike schuh is live at baltimore county headquarters with details on this crime, and the newborn's condition. mike? >> reporter: mary, there are countless stories of mothers protecting their infants and children even when it puts themselves in danger. when you look at this police report, that's not the case here. >> reporter: we may never know exactly what happened inside the bathroom on the second floor of this tidy reisterstown home. but we do know what police found. >> the bathroom, where she had the baby was covered totally in blood. >> reporter: a 21-year-old woman, rebecca denise hind -- heinz gave birth there. but what police say hind did next is baffling. >> they had had the baby and placed the baby in a plastic bag and thrown it out the window. >> reporter: according to the police report, the woman's sister heard a commotion upstairs, ran outside and around back. there, she found a white, plastic trash bag in the bushes with screens coming out of t. >> windows in which the baby was thrown, was anywhere from 10 to 12-foot high. >> reporter: the baby is unhurt. perhaps cushioned by the thick hedges below. >> the baby has been temporarily placed in the custody of the department of social services. >> reporter: this neighbor finds what police say happened hard to believe. >> that's really out of character for them. they're the most politest little things you have ever seen in your life. >> reporter: the baby right now is in the nicku -- nicu in good condition. sources indicate that the mother's competency is being numbers are out. and political experts are weighing in on what former governor bob ehrlich and governor o'malley need. >> only 100 days until the election. and both candidates have to do the same thing, that is fire up their base and try to win over the undecided voters. whoever does it best will win. the governor's race at a dead heat. martin o'malley barely leads bob ehrlich within the margin of error. some key findings, 18% of registered democrats support ehrlich. but they need more than 25% to win. it's still possible with almost 10% of democrats undecided. >> for the people who are undecided. they are people who are -- >> these are democrats. >> right. and if they were republicans, we'd be, you know, it would be a different situation. so democrats, the fact that there are democrats who are undecided tells us what we need to do is get our message out. >> he needs to clarify who he is with the voters. and the way to do that is to step out from behind the tv ads and get out on the street. >> reporter: so far, o'malley's tv campaign is mostly focused on the economy. 52% of marylanders surveyed call it a big issue. >> the fact is, what the governor can do about the diswrob and the economy. >> reporter: ehrlich leads everywhere else. but only by 15% in the baltimore suburbs. and it's even closer on the shore, a 10-point spread. we asked each candidate about that at a campaign stop in chrisfield last week. >> governor ehrlich's support on the eastern shore is not as strong as previous republicans. is that something you can capitalize on? >> we're campaigning all over the state. >> martin o'malley is not what they want in the shore particularly. so we feel really good about this, about turnout. people are excited. >> reporter: now, today, ehrlich's circuit. alex demetrick has more on what the ntsb's final hearing on the crash revealed. nine dead, dozens injuries. lacks safety procedures producing an ax. >> the layers are troubling and refills systemic problems. >> it responded as if the track had cleared. train automatically began to accelerate. >> possibly three seconds after the train operator had a few fuel, she applied the emergency breaking. breaking action was normal. but there was only enough time to slow it a few miles an hour. >> reporter: some recommended fixes are already in place. trapes are operated manually it has stopped mixing train equipment. changes for victims who gathered last month to remember. >> this past year has probably been the hardest of my whole life. >> and for metro, the years ahead won't be easy. alex demetrick, wjz eyewitness news. and to cover the future costs, d.c. metro has created. vic is in the newsroom too explain the decision from the judge. a judge has found thomas sherrer not competent to stand trial. police believe he stabbed his wife to death. the judge says cheryl will stay in a secure facility for another year. until doctors have a chance to examine him once again. >> prosecutors say sherrer seemed disoriented. a strong storm pops up. on sunday, a maryland jet skier was killed in a race to get away from the storm. as a thunderstorm quickly approached, an emergency call came in, about two people in distress on jet skis, about a half mile south of the bay bridge. it got caught in a severe thunderstorm. waves about 5 to 6 feet. >> reporter: 60-year-old warren smith was killed. as he and friends raced back to the park. >> he noticed has other manner on the jet ski. the tugboat operator called 911. they say smith's deth death is a powerful reminder that before heading out, people need ton what the weather is like. but also what it's like where they're heading. >> andy antonio says he checks the weather forecast and radar several times before he heads out on his jet ski. that, along with safety checks, gives him peace of mind as he sets out for a peace of mind on the bay. >> we have to make sure the weather is nice and calm. and that the rain is what it's going to be like while they're out there. smith and his companion were wearing life jackets at the time of the accident. an exact cause of death is still under investigation tonight. just minutes ago, the family of a missing oregon boy increase reward for a safe return. today, it appears police are close to making an arrest. kiron's stepmother is the last person known to have seen him alive. she is not named a suspect or a person of interest at this time. polygamist leader warren jeffs is behind bars. he's known for his role. today, the utah supreme court reversed his convictions, citing errors in jury instructions from his trial in 2007. jeffs is the leader of a fundamentalist church who fras polygamy in that church. today, autopsies show lisa jones and her older son had taken some sort of drug before last week's fire. investigators quickly determined the flames were intentionally started, and some of the children's throats were slashed. now, they have also discovered jones left an an apology note behind. now they believe jones is the suspect. singer wyclef john want -- wyclef john wants to become its president. he was he was appointed in 2007. he says even if he's not on the ballot this november, he will get involved by encouraging young people to vote. in tonight's report, city dwellers are finding out that bed bugs aren't just make- believe in children's fairy tales. the health department is struggling to control these tests that are causing a real urban nightmare. one female can lay 2,000 eggs a year. >> they're not easy to kill. they can live a long time. >> they hide in sockets, bed frames and cracks in the wall by day. at night, like dracula, they need their simple blood like victims. >> they're more difficult in controlling roaches. >> reporter: a global economy brought them back on the shoes of foreign visitors on luggage. and they set up shop in houses and hotels here. >> reporter: a bed bug expert says often times people who travel overseas, bring the bugs back with them. and if the bugs come from a country that uses harsher chemicals than are allowed in the u.s., they can be very difficult to exterminate. it's darwin's herey. getting rid of them may take up to a year. >> it may take 4 months to control a bed bug population. >> why is that?" because of the places they can hide. there are so many cracks and crevices in a home. >> reporter: in 2009, first six months, they got 200 cawlsz. the first six months of this year, it's up to 236. and the little bugs travel from rowhouse to rowhouse. >> and they need to get rid of anything that could be harboring them. washing laundry, bagging clothing. >> the city health department warns that over-the-counter foggers or bombs don't work to kill bugs. but using heat like a wall paper steamer does. also in tonight's healthwatch, people who use the internet as a weight loss tool tend to be more successful than others. those who logged into an interactive website recorded the weight they lost the most. researchers followed children all the way from infancy to adulthood to determine the impact of a mother's love. psychologists assess the interactions between mother and baby when the child was 8 months old. then they followed up with a child at age 34, now an adult. those who had more maternal affection as an infant, had less anxiety and hostility as an adult. time now will be generally hot to humid. kai? >> bob. thank you. north dakota resident his to take cover when severe thunderstorms dropped monster hail on the area. that hail crashed through car windows and pelted homes. and some places, it was as big as baseballs. there were no reports of injuries in north dakota. but that same storm system killed two people in neighbor montana, when a tornado ripped through a farm house. and a toddler falls onto a power washer and gets a metal screw lodged in his brain. now, he's expected to make a full recovery, as whit johnson reports, it is being called a miracle. a leisurely saturday, nearly turned deadly 10 days ago, when 17-month-old josiah jackson fell from a chair in his home, landing directly on the rod of a power washer, like the one shown here. this was the unbelievable result. the metal rod lodged three inches into his brain. his uncle was with him at the time. luckily, he had training as an emt. >> i just knew to keep his head still. >> reporter: the rod came within a hair's breath of the child's torculla vent. nearly severing blood flow from the brain to the heart. >> this could not have been in a worst place. if it had been inches closer tcould have resulted in massive stroke, it could have resulted in a horrible outcome. >> reporter: doctors told the uncle that chances were grim. >> he didn't sug sugar coat anything. he said, mr. jones, more than likely, we pull the screw out of his head, he's going to bleed to death. so he said that, man, i just lost it. >> reporter: but just a day after surgery, josiah was already recovering as if nothing had ever happened. >> i think we had a lot of help from above. and fortunately, everything went well. so i think he is a miracle baby. >> it's like god gave him a second chance. >> reporter: josiah is set to return home in another day. >> and believe it or not, the family had even more to worry about during diswro si -- josiah's time at unc, his grandfather had to
