Elsewhere, i knew juan merchan was not going to sentence trump before the election. To put him in prison before the election would guarantee a trump victory almost. That's what i think. Let's see what former federal prosecutor andrew thinks. Welcome, andrew. Hunter biden ped a plea and avoids the trial tax and pleading guilty this way, does he get credit for cassioppi cementing responsibility. Is it too cute when it cops for the judge to enter a sentence? jot only credit he deserves from his family likely and that's them thanking him for not dragging them through the mud again just as he had done for the gun case. This deal or the plea in the end saw no benefit to him and he was trying to play games all the way to the finish line and long history of that and i think in the final days he was just talked out of fighting something to which there was no reasonable chance of winning whatsoever. Trey: given your judgment and experience, will he get active term of confinement and his numbers are up and dollar amount is big in the tax case and is he actually looking at a term of confinement at sentencingsing? looking at gun case and running the federal sentencing guidelines and there should be some amount and the judge has a flexibility and combining that gun case and a prior conviction on the calculator and look at number and length of the tax charges here, it definitely calculates likely into the multiple years and i think somewhere in the 18 month to 30 month category and it could go up but not down much. Trey: i want you to remember this and i'm old and i'll forget and guarantee you his father commutes the sentence for pa pardons and i do remember and i'm likely to have forgot it. Move to juan merchan, if he did put tram nap prison, it would have put donald trump in prison. The reason juan merchan postponed the sentencing and going for them and really had no choice at all and there's too much legal work to be done between now and the sentencing and at the appellate courts and efforts to pause that and very important legal issues and the least of which is the immunity issue and it's litigated and likely all the way through the supreme court. So that case was not going to make it to sentencing. I think had merchan tried to put on a show and tried to make that happen, it would have been an issue. We have 20 remember this case is terrible from the beginning and should have never been brought against donald trump and going for them when you see this much appellate issue going on, can you imagine them putting it all before the election and it's just not right. All though the jury reached a verdict as they did in this case. There's dozens and dozens of bases for appeal before donald trump is given a sanction or sentence for the crime undoubtedly. Trey: looking forward to the senate and that's prosecutor trump and you're not supposed to be penalized for going to trial. You're supposed to be rewarded for pleading guilty. The reality is you get more time usually if you go to trial. President trump still denies the wrongful conduct and he's classed with the judge before and new york is not known for sending lot of people to prison for nonviolence offenses and what do you think will happen in late november when he is sentenced? this case can't be compared to any're case and in the relationship between donald trump the department and the judge juan merchan in this case can't be compared to any other case. You have to take into account the animas that's grown over time and amount of actions that juan merchan engaged in that were beyond what you have with the policy strikes called in the courtroom and calling one after another for trump and i think pushing for sentencing after the election and opens more of a door for juan merchan to actually issue a sentence of jail time and i don't think the new york sentencing guidelines call for it and i think you run this every which way from a standard perspective and especially given this is a particularly, again, novel case that was brought in the first place and a paper case that was cut and i don't think it deserves it at all and juan merchan set himself up and indicated it's going to see each other for the middle of the road and issue a harsh sentence. A sentence of confinement ahead of the election if donald trump is elected would be very catastrophic to the country but a possibility. Trey: yeah, i hope i'm wrong and i hope you're wrong. This judge wants to put donald trump in prison and feels freer to do so if trump loses the election. It'll be a little dicier if trump wins.
