>> certainly the campaign is going to use this. they always send out a question of the day for that biden campaign and the question today on the day of the debate is whether he will double down on this idea that he was not involved or did not even speak to hunter biden about his business dealings. in terms of this coming up tonight at the debate, i think for the moderate sake it would be good for her credibility to bring it up because it is a story. there are people on the record. we have document evidence. the fbi is involved, for her to bring it up would be good for her credibility especially give what we've seen in previous debates. this is not necessarily just about hunter biden as his been asked lane or used as an excuse to not cover the story, joe biden has been specifically saying for a long time now on the record multiple times that he was not involved with this, did not talk to hunter biden about this. that is clear and obvious that there are allegations and dominium that he was very much involved and he owes the american people an excellent nation about why his story has changed and why the evidence shows about what him saying about not being involved isn't true anymore. >> sarah, you know, i'm looking at tony bobulinski and the information we have come up wit his military background. he has self has said i'm grandson of intelligence officer . the brother of a 28 year career naval officer. as serve our country for four years and left the navy as lieutenant bobulinski. how much of that matters in terms of what is unfolding in your point of view? >> i think it lends some credibility to his story. like brett said, it makes it a news story now that you have someone out there that is on th record validating some of these accusations and pointing to specific exchanges that he had that both implicate hunter and joe biden. i think the big take away is no just that it exposes hunter biden's corruption, but it potentially exposes joe biden's corruption paid it gives the president i think a great momen two kind of retake the race and change the conversation back to despite the fact that he's an incumbent, to change the conversation back to him being the outsider, the disruptor, th change agent in washington. if we want to continue down the path we been on under the last four years of the president's leadership, the prosperity, safety, insecurity, we have a person for that. if we want to go backwards to the way that washington has always operated, the corrupted status quo, their is a person for that great i think that's the conversation the president should be happening tonight is reframing this race and reminding people that despite the fact that he is the incumbent, he is still the outsider and they change agent that will shake up washington a he has done the last four years. >> so the job of the president tonight as sarah just laid it out will be decidedly different for joe biden. he is doing well in the polls, but it looks free pretty good for your guy and some places. this could sink him, or not? >> i'm not sure how it factors in. i think it's baked in the cake, this was not a surprise it was going to come out of committee. it's not a surprise that judge barrett will get a vote on the floor where thinking monday. and it's not a surprise that sh will be a justice on the u.s. supreme court. this was more about the dramatics, the rhetoric around the election, and obviously democrats feel this process was not the right way to go around it but if you flip it around an democrats had this vacancy and control of the senate, they would be doing exactly the same thing. the only thing they did by walking out today was republicans and oaken open mic two kind of talk about what the wanted to talk about. >> so, marie, is that right? more than 40 million people hav already voted during this process, so it's a little different. with marit garland, that was in march, not a late october situation. so what do you think about that? would we be looking at somethin similar if the shoe was on the other foot? >> you cannot overestimate the anger and frustration the democrats feel watching 12 days before a presidential election when as you said, over 40 million americans have already voted, contrasted with in 2016 when there were months and months before american started voting and republicans refused to take up marit garland . for the democratic base, the democratic voters, this is such a visceral issue that i don't think you can overestimate that. but it is true, this is going t go through. i think democrats would've move forward with it as well. they tried to move forward with marit garland. so i think after the election, their will be a lot of talk about the court and they are going to hear naca case very soon after the election. they are hearing cases that impact every american and every part of american life. with this justice the court is shifting judicially further to the right which has been mitch m cconnell's goal for decades. >> as we listen to all of that, sarah, what we also know is wha the former and out late justice ruth bader ginsburg said, a president as a president for four years. boom, that's it, not three and half as it was back in the time of marit garland and not three and three quarters as it is right now. >> and i think she's absolutely right not only is the president the president for four years, but voters came out in 2018 and added to the republican majorit in the senate i think they have a constitutional obligation to fulfill their role they have a majority in the senate. the president should be able to nominate and confirm a supreme court justice. let's not forget to how qualified, how highly respected judge barrett is. it's not like they're putting someone who doesn't deserve and shouldn't be on the supreme court. she is one of the most highly respected legal minds in the country by people on both sides. she has every right and should be on that court. i look forward to watching her confirmation take place on monday and for every one of those angry democrats that are out there on the left, their ar hundreds of enthusiastic republicans and conservatives that care about the constitutio and want to see it upheld by people like judge barrett that will be voting on november 3rd is well. i think it will be something that helps puts more of them to come out and vote for the president. >> katie, i want to slide to almost like part two of this discussion and that's whether o not democrats and joe biden would try to pack the court if they are in office after november 3rd. let's watch the democratic member as eventual nominee britt . >> all put together a national commission a bipartisan commission of scholars, constitutional scholars, democrats and republicans, liberal, and conservative and i will ask them to over 180 days come back to me with recommendations as to how to reform the court system because it's getting out of whack. it's not about court packing. there is a number of other things that are constitutional scholars have debated. >> that is i believe from an upcoming episode of 60 minutes. you know, it's interesting because joe biden has said he wasn't going to talk about this and then the issue just blew up it's like he put a blowtorch right on it because he said he wasn't going to answer it. now again on debate day, he's probably going to be asked abou this. >> i actually really like this idea, bipartisan republicans, democrats, liberals, conservatives because he's right , there's been a lot of debate about a whole host of issues including adding appellate courts around the country because the appellate courts are so overworked. about may be making supreme court be term limited so every time one becomes available, it' not political armageddon and we're not relying on when peopl die to fill the seats. i actually think he's saying this isn't important enough issue that we need everyone on both sides of the aisle to look at it and not just for cheap political points by saying yes to court packing or no two cour packing. i think it's a pretty interesting idea. >> katie?
