closed the door on same-sex marriage, opting to define marriage as a union between a man and woman. voters overwhelmingly supported a constitutional amendment banning marriage and even civil unions between same-sex couples. 61% voted in favor of the ban. big-name democrats including members of president obama's cabinet and former president bill clinton spoke out against the ban early this week. that did little to sway the vote. north carolina is the 30th state to ban same-sex marriages. this issue of gay marriage remains a divisive one around the country. a new poll out this morning by gallup shows that 50% of americans believe same-sex marriage should be legal. 48% are opposed. support for the same sex unions dropped from last year whether it reached a record high of 53%, and opposition has grown from 45% last year. so far six states and the district of columbia allow same-sex marriage. maryland is sort of on the list. the legislature approved a measure this year, but voters will make a final decision in a referendum in november. governor martin o'malley tweeted, "disappointed to hear about north carolina, but confident that marriage equality will prevail in maryland." a shakeup from decision 2012 primaries this morning. senator richard lugar will be leaving capitol hill. he lost indiana's republican primary to tea party-backed challenger richard murdoch. lugar is considered an institutional in indiana politics. the 8-year-old served six terms as senator. in a statement, president obama thanked lugar for his service and willingness to cross party lines to get things done. murdoch will face democratic congressman joe donnelly in november. mitt romney is about 100 delegates closer to becoming the republican presidential nominee. he won primaries in indiana, north carolina, and west virginia. right now he is 288 delegates shy of the 1,144 needed to clinch the nomination. 4:34. police in mt. pleasant are calling a 76-year-old man's death suspicious. benjamin brown was found dead inside his seat pleasant drive home last friday. his car, a blue chevy caprice, is missing. the home is secured with window bars and an alarm system. neighbors fear brown was taken advantage of by someone he let into his home. >> he didn't ever bother anybody. that man sat on his porch, drank his coffee, water, whatever he had to do. he didn't ever bother anybody. >> police say an autopsy is being done to determine exactly how brown died. police say a child was inside the car used to kill a young fairfax county woman during a road rage incident. gloria mcmillan is accused of hitting and killing shelinda arrington last friday. the child was not hurt. mcmillan is charged with felony hit and run. records show she's also been cited for reckless driving, speeding, and driving on a suspended or revoked license in the past. police need your help finding a man pretending to be a police officer in montgomery county. investigators released this sketch of the suspect. he's described as a man in his late 20s, weighing around 190 pounds and tattoos on both arms. a woman told police the fake officer pulled her over last week in silver spring. the impersonator asked for the driver's i.d. and then ordered her out of the car. the man pretended to search the car. he took her purse and cell phone and took off. if you have information, call montgomery county police. it is a win at home or stay-at-home night for the caps tonight. the rangers come to town for a must-win game six for the caps. washington needs to recover from a heartbreaking loss on monday. the caps were just six seconds from being the team in control of the series, but a late penalty allowed the rangers to force overtime and then snatch away the win just two minutes into that extra frame. you can catch game six on the nbc sports network. the puck drops at 7:30. first round hero joe ward handled the situation with class, but many on twitter did not. ward was once again the target of racist tweets after committing the penalty monday night. the capitals' forward first faced a barrage of racist tweets after he scored the game-winning goal in game [ applause ] >> the search is over. who america welcome back at 4:44. tsa screeners found gun part hidden inside a child's stuffed animals. they made the discovery at a rhode island airport last night. officials say the 4-year-old boy and his father were on their way to detroit. screeners found the disassembled .40-caliber gun and ammunition hidden in a stuffed mickey mouse, rabbit, and teddy bear, all inside the boy's backpack. the father told officials he did not know how they got there. airport police believe it was part of a domestic dispute. agents confiscated the items and allowed the father and son to travel. the matter remains under investigation. today on capitol hill, airport security official will respond to a report that millions of dollars worth of screening equipment is collecting dust in a texas warehouse. questions will stem from a scathing report against the transportation security administration. it states 5,700 piece of equipment are in a warehouse -- pieces of equipment are in a warehouse, some not mentioned in inventory reports. congressman micah of florida says the agency is wasting money and the agency should be scaled down. the joint hearing is with oversight and transportation committees. the penn state football assistant who accused jerry sandusky of sexually abusing children is now suing the school. mike mcqueary filed a notice of a whistleblower lawsuit. he claims he told long-time head coach joe paterno he saw a boy in a locker room shower with sandusky in 2002. the claims led the school to fire paterno, who died last year. right now mcqueery is on paid administrative leave from penn state. sandusky is scheduled to stand trial next month on 52 counts of child abuse. in the trial of john edwards, a former aide who claims edwards knew about money being used to cover up the affair will take the stand. a speechwriter for the former candidate said edwards confessed to her that he knew all along that a wealthy donor provided money to hide his mistress and child while he ran for president. wendy button testified she helped draft a statement for edwards, admitting he fathered rielle hunter's child. she said at edwards' request, it did not mention he knew that his campaign finance chairman fired -- fred baron, rather, had been supporting hunter. edwards has pled not guilty to violating campaign finish laws. a second unidentified masur filed a sexual battery lawsuit against john that volt acclaiming the actor sexually the men in two separate incidents during private massages. the first says travolta harassed and assaulted him in an l.a. hotel last year. the second, who just filed a suit, makes a similar claim but says the abuse happened in atlanta. neither one is giving his name. each is suing for $2 million. travolta's lawyer dismissed the second accuser's allegation saying, "our client was not in l.a. when anonymous doe number one claims he interacted with john travolta." although the same attorney made the fabricated claim for doe number one, there was never any claim made by anonymous doe number two before he filed his specious lawsuit." your next alcoholic drink in the district could cost you a few cents more. the d.c. council member jim graham is considering proposing a wholesale tax increase that amounts to about six cents per drink. that's far higher than in the suburbs. graham says the new revenue would go to social service programs. he also says a tax has not been raised since 1990. the tax could cost city jobs from small breweries in the district. the council will vote in the next few weeks. a debate over a controversial ambulance fee wages on in montgomery county. last night those for and against the fee squared off in rockville. county executive isiah leggett wants those without insurance to pay between $300 to $800 for emergency services. patients with health insurance would be covered as well as patients who fall below a certain income level. the county council approved similar legislation two years ago, but it was voted down in a referendum. 4:48 now. some say noisy neighbors are disturbing a quiet montgomery county neighborhood. [ rooster crowing ] >> people living in takoma park say roosters are crowing at all hours of the day and disturbing the peace and quiet there. several roosters and chickens are kept as family pets. some people don't mind the noise, but emily van loon says she hears the male roosters crow in the daytime. >> i think the roosters are too noisy. i think they're inconsistent. i think they're -- they are bothersome. >> the roosters don't bother me. >> van loon would like the neighborhood to come to a consensus about what to do with those roosters. a northern virginia dog daycare is facing criticism after a dog escaped. it's not the first time either. a dog got out of the just for pets daycare in springfield. the dog escaped when a staff member stepped outside. employees found the pet several hours later. more than a year ago, another dog escaped and ended up dead on the side of the road. the owner of just fur pets is changing the gate system to prevent this from happening again. lamont peterson's lawyer says the local boxer inadvertently failed a recent drug test because he forgot to disclose medical treatment he received last year. lawyer jeff freed sent a letter to the nevada athletic commission saying peterson was treated for low testosterone levels, and that's why he tested positive for synthetic testosterone in march. unless the commission accepts that reasoning, peterson's may 19 rematch against amir khan in las vegas could be canceled. the decision come in as early as today. peterson defeated kahn in a controversial title fight in december. this morning, josh hamilton's name is being added to the history books. the rangers player becomes just the 16th in baseball history to hit four home runs in one game. and his epic performance came against the baltimore orioles at camden yards last year. he's had a public battle with drug and alcohol addiction and says it will take some time for the significance to sink in. hamilton also had eight rbis in the rangers' 10-3 win. quite a feat. congrats to him. >> indeed. tom kierein's here and keeping an eye on what we can expect rainwise today. >> i was hoping for a rainoff for the os -- >> right?
