ભારત સાથેના રાફેલ સોદાની જ્યુડિશિયલ તપાસમાં ભારતીય બિઝનેસમેન અને રિલાયન્સ ગ્રૂપ ઓફ કંપનીઝના ચેરમેન અનિલ અંબાણીની રાફેલ સોદામાં ભૂમિકા પર ધ્યાન કેન્દ્રિત કરવામાં આવશે. ફ્રેન્ચ ઇન્વેસ્ટિગેટિવ વેબસાઇટ મીડિયાપાર્ટના જણાવ્યા અનુસાર રાફેલ સોદામાં શંકાસ્પદ ભ્રષ્ટાચારના હાર્દમાં અનિલ અંબાણી છે. મીડિયાપાર્ટના રિપોર્ટમાં દસોલ્ટ એવિએશન અને રિલાયન્સ દ્વારા ૨૦૧૭માં રચાયેલી દસોલ્ટ રિલાયન્સ એરોસ્પેસ લિમિટેડ (ડીઆરએએલ) વચ્ચેની ભાગીદારીની વિગતો જાહેર કરાઇ છે. અત્યંત સુરક્ષિત દસ્તાવેજોનો અભ્યાસ કરતાં જણાય છે કે દસોલ્ટ અને રિલાયન્સ વચ્ચે ભાગીદારી માટે ફક્ત રાજકીય કારણો જવાબદાર હતાં. તેના લીધે દસોલ્ટ દ્વારા રિલાયન્સને સંયુક્ત કંપની સ્થાપવા માટે લાભકારક આર્થિક શરતો ઓફર કરાઇ હતી. સામાન્ય રીતે સંયુક્ત કંપનીના ભાગીદારો એકસમાન મૂડીરોકાણ કરતાં હોય છે. પરંતુ ૧૬૯ મિલિયન યૂરોની સંયુક્ત કંપનીમાં દસોલ્ટ ૧૫૯ મિલિયન યૂરોનું રોકાણ કરવા તૈયાર થઇ ગઇ હતી જ્યારે રિલાયન્સના ભાગે ફક્ત ૧૦ મિલિયન યૂરો જ ઉપલબ્ધ કરાવવાના આવ્યા હતા. તેમ છતાં સંયુક્ત કંપનીમાં દસોલ્ટનો હિસ્સો ૪૯ ટકા જ્યારે રિલાયન્સનો હિસ્સો ૫૧ ટકા રખાયો હતો. આમ આ સંયુક્ત સાહસમાં અનિલ અંબાણીની કંપનીનું ફાઇનાન્સિયલ કે ટેકનિકલ કોઇ યોગદાન જ નહોતું. ફક્ત રાજકીય પ્રભાવના કારણે આ સાહસની રચના કરાઇ હતી. પોતાના ઇન્વેસ્ટિગેશનમાં મીડિયા પાર્ટે દસોલ્ટને સવાલો મોકલી આપ્યા હતા પરંતુ કંપનીએ તેનો કોઇ જવાબ આપ્યો નહોતો.
રાફેલ સોદો થયો ત્યારે અનિલ અંબાણીના રિલાયન્સ જૂથ પાસે એરોનોટિક મેન્યુફેક્ચરિંગનો કોઇ અનુભવ નહોતો અને જૂથ ગંભીર આર્થિક સંકડામણમાં સંકળાયેલું હતું. તેમ છતાં અનિલ અંબાણી આ સંરક્ષણ કરાર મેળવવામાં સફળ રહ્યા હતા.
મીડિયાપાર્ટ મુજબ, જોઇન્ટ વેન્ચર માટેના દસોલ્ટ અને રિલાયન્સના કરારમાં નાણાકીય વિગતો ગુપ્ત રખાઇ..! ભારત અને ફ્રાન્સની સરકારો વચ્ચે ૩૬ રાફેલની ખરીદી માટેનો કરાર થયાના બે મહિના બાદ દસોલ્ટ અને અનિલ અંબાણીની રિલાયન્સે ભાવી જોઇન્ટ વેન્ચર માટે શેરહોલ્ડર એગ્રીમેન્ટ કર્યું હતું. પરંતુ તેની ફાઇનાન્સિયલ વિગતો એટલી સંવેદનશીલ હતી કે કોન્ટ્રાક્ટમાં તેનો સમાવેશ જ કરાયો નથી અને કોન્ફિડેન્શિયલ સાઇડ લેટરમાં સામેલ કરી તે જ દિવસે હસ્તાક્ષર કરી લેવાયા હતા. આ સાઇડ લેટરમાં જેટલી રકમનો ઉલ્લેખ કરાયો છે તે અનિલ અંબાણીની રિલાયન્સને ભેટમાં અપાઇ હોવાનો આરોપ મુકાયો છે.
અનિલ અંબાણીને ભાગીદાર બનાવવા હિન્દુસ્તાન એરોનોટિક્સનો એકડો કાઢી નખાયો
૨૦૧૨માં તત્કાલીન યુપીએ સરકારે ટેન્ડર જારી કર્યા બાદ ૧૨૬ રાફેલ વિમાનની ખરીદી માટે દસોલ્ટની પસંદગી કરી ત્યારે ભારત સરકારની માલિકીની હિન્દુસ્તાન એરોનોટિક્સ લિમિટેડને દસોલ્ટની મુખ્ય ભાગીદાર કંપની બનાવવામાં આવી હતી. તેમાં હિન્દુસ્તાન એરોનોટિક્સ દ્વારા ૧૦૮ રાફેલ યુદ્ધવિમાનોનું એસેમ્બ્લિંગ કરવાની જોગવાઇ હતી. જોકે ૨૦૧૪માં કેન્દ્ર ખાતે એનડીએની સરકાર આવ્યા પછી ૧૦ એપ્રિલ ૨૦૧૫ના રોજ અચાનક અસલ ટેન્ડરની શરતોને રદ કરી દેવાઇ હતી અને એનડીએ સરકારે ફ્રાન્સ પાસેથી સીધા ૩૬ રાફેલ વિમાનની ખરીદી કરવાનો નિર્ણય કર્યો હતો. સૌથી ગંભીર વાત તો એ હતી કે ભારતના સૌપ્રથમ સ્વદેશી યુદ્ધવિમાન તેજસના નિર્માણમાં પણ દસોલ્ટ અને રિલાયન્સને સામેલ કરવાની યોજના હતી. દસોલ્ટ અને રિલાયન્સ તેજસના નિર્માણ માટે ડિઝાઇન કન્સલ્ટન્સી કરવાના હતા. ખરેખર તો તેજસ વિમાનની ડિઝાઇન અને ઉત્પાદન એચએએલ અને સંરક્ષણ મંત્રાલયની એરોનોટિકલ ડેવલપમેન્ટ એજન્સી દ્વારા કરાઇ રહ્યું છે.
ભારતીય કંપનીઓને મળી શકે તેવા ૪ બિલિયન યૂરોના કોન્ટ્રાક્ટ રિલાયન્સને મળ્યાં
રાફેલ સોદામાં દસોલ્ટ સાથે ભાગીદારી થવાના કારણે દસોલ્ટે ભારતીય કંપનીઓને આપવાના હતા તે ૪ બિલિયન યૂરોના કોન્ટ્રાક્ટ આપોઆપ અનિલ અંબાણીના રિલાયન્સ ગ્રૂપને મળી ગયા હતા. આમ હિન્દુસ્તાન એરોનોટિક્સની બાદબાકી બાદ ભારતની અન્ય ઉત્પાદક કંપનીઓનો પણ એકડો સોદામાંથી નીકળી ગયો હતો.
ભારત સરકારના નિર્ણયથી રિલાયન્સને દસોલ્ટની પાર્ટનર બનાવાઇ હતી : પૂર્વ ફ્રેન્ચ પ્રમુખનો આરોપ
મીડિયાપાર્ટને આપેલા એક ઇન્ટર્વ્યુમાં રાફેલ સોદા સમયે ફ્રાન્સના પ્રમુખ ફ્રાન્કોઇસ ઓલાન્દેએ જણાવ્યું હતું કે, ભારત સરકારના નિર્ણયથી અનિલ અંબાણીની રિલાયન્સ કંપનીને દસોલ્ટની ઔદ્યોગિક ભાગીદાર બનાવાઇ હતી. તેથી ફ્રાન્સ પાસે આ મામલામાં બીજો કોઇ વિકલ્પ નહોતો. જોકે ભારત સરકાર, દસોલ્ટ અને અનિલ અંબાણીની રિલાયન્સે આ આરોપ ફગાવી દીધો હતો.
ઓલાન્દેની ગર્લફ્રેન્ડની કંપનીએ અનિલ અંબાણીની કંપનીએ ૧.૬ મિલિયન યૂરો આપ્યા હતા
એક આરોપ એવો પણ મૂકવામાં આવ્યો હતો કે રાફેલ સોદા પર હસ્તાક્ષર થયાના થોડા મહિના પહેલાં જાન્યુઆરી ૨૦૧૬માં અનિલ અંબાણીના રિલાયન્સ ગ્રૂપની એક કંપની દ્વારા ફ્રાન્સના તત્કાલીન પ્રમુખ ઓલાન્દેની પર્સનલ પાર્ટનર અને અભિનેત્રી જૂલી ગાયેટ સાથે મળીને એક ફિલ્મનું નિર્માણ કરવા માટે ૧.૬ મિલિયન યૂરો અપાયા હતા.
દસોલ્ટને ૧૪૩ મિલિયન યૂરોના ટેક્સની માફી આપવાનો પ્રમુખ મેક્રોં પર આરોપ
રાફેલ સોદો થયો ત્યારે હાલના ફ્રેન્ચ પ્રમુખ ઇમેન્યુઅલ મેક્રોં પૂર્વ પ્રમુખ ઓલાન્દેના નાણામંત્રી હતા. તેમના પર ફ્રાન્સના અખબાર લે મોન્દેમાં આરોપ મુકાયો હતો કે રિલાયન્સ સાથે ભાગીદારી કરી રહેલી ફ્રેન્ચ કંપનીને ૧૪૩ મિલિયન યૂરોના ટેક્સ એડજસ્ટમેન્ટ ક્લેમમાં માફી આપી દેવાનો આૃર્યજનક નિર્ણય મેક્રો દ્વારા લેવાયો હતો.
