Alabama Passes REDEEMER Act to Help Ex-Offenders - Employment Screening Resources


The REDEEMER Act will take effect in July 2021. “Beginning in July, when the law takes effect, people who qualify for the break will be able to petition the court for the expungement. Judges will make the determination based on factors like the nature of the offense and how long ago it occurred,” WALA Fox10 News reported.
“The expungement option is not open to everyone. Violent felons and people convicted of sex offenses will not be able to apply. But people with misdemeanors and certain nonviolent felonies can get the records sealed. It is also open to people who have committed some more serious offenses and later won a pardon,” WALA reported. ....

Kentucky Law Protects Employers Hiring Ex-Offenders - Employment Screening Resources


On April 5, 2021, Kentucky Governor Andy Beshear signed into law House Bill 497 (HB 497) that will create a certificate program to give employers protection from legal barriers and civil liabilities for hiring qualified ex-offenders who have prior criminal records and are trained for a job. The new law will take effect in July 2021.
HB 497 – which was unanimously passed by the Kentucky Legislature in March 2021 – requires the Department of Corrections (DOC) to issue ex-offenders documentation of their criminal history, institutional history, and a “certificate of employability.” The law also encourages the DOC to provide support in preparing job resumes.
Under HB 497, eligible incarcerated individuals may receive a certificate of employability by completing certain vocational and/or educational requirements and passing a skills assessment test administered by the DOC. ....

EEOC Files Lawsuit in New York for Equal Pay Violation - Employment Screening Resources


On March 26, 2021, the U.S. Equal Employment Opportunity Commission (EEOC) – which enforces federal laws prohibiting employment discrimination – filed a lawsuit that claimed a School District in New York violated federal law by paying lower wages to a female superintendent than to a male superintendent performing the same work.
According to the EEOC’s lawsuit filed against the Hunter-Tannersville Central School District in New York, Dr. Susan Vickers had over 26 years of work experience in education and educational leadership, as well as a doctorate in education. Still, the school district paid her less in salary and benefits than her male predecessor. ....

Illinois Amendment to "Ban the Box" Law Would Impact Employers - Employment Screening Resources


In January 2021, the Illinois legislature passed Senate Bill 1480 (SB 1480) to amend the Illinois Human Rights Act (IHRA) that would impact employers under the state’s “Ban the Box” law that prevents employers from asking job applicants about criminal histories on applications. The bill was sent to Governor J.B. Pritzker to sign into law.
SB 1480 would make using conviction records in employment-related decisions a civil rights violation unless there is a “substantial relationship” between the criminal offense and the position or involve an “unreasonable risk” to property or the safety of individuals or the general public. President Biden Appoints EEOC Chair and Vice Chair - Employment Screening Resources


In January of 2021, the U.S. Equal Employment Opportunity Commission (EEOC) – a government agency that advances opportunity in the workplace by enforcing federal laws prohibiting emp­loyment discrimination – announced that President Joe Biden had appointed Commissioner Charlotte A. Burrows Chair of the EEOC and Commissioner Jocelyn Samuels Vice Chair of the EEOC as part of the Commission of the EEOC.
Burrows had served as an EEOC Commissioner since 2015, having been initially nominated by President Barack Obama. In 2019, she was re-nominated and unanimously confirmed for a second term ending in 2023. “I am deeply honored to be chosen by President Biden to lead the Equal Employment Opportunity Commission,” Chair Burrows stated in a press release about the appointments from the EEOC. ....
