three years after the capitol attacks, about two weeks before the iowa caucuses. prosecutors think it will not take more than four to six weeks to present their evidence. then trump will get to go. this could mean trump will be in the courtroom and on the campaign trail at the same time. the former president's codefendants appeared in court today to face new charges in the mar-a-lago documents investigation. trump body man and his official codefendant walt nauta pleaded not guilty. but once again the court is facing a delay as carlos de oliveira, the latest codefendant who was added in that superseding indictment showed up without a florida licensed attorney. his arraignment has been postponed to next week. you don't see trump in those videos along side the attorneys and two codefendants. he also pleaded not guilty to the charges against him, but we waived his appearance at today's hearing. joining me now, jennifer rogers, and david kelly, former u.s.

but they put together a very dense, detailed indictment supporting these charges. now, i also want to read one quote from the indictment, they alleged that, quote, for more than two months, following election day, the defendants spread lies that there had been outcome determinative fraud in the election and that he had actually won. and they sort of preempted his defense in the court of public opinion, which right now is that he has a first amendment right and they're infringing on his first amendment right. in the first few pages of the indictment, they say that, look, you have every right to claim fraud, to claim the election was stolen, but you can't then go and attempt to steal it. these are the charges that they're using right now to pursue that and there could potentially be additional charges added going forward. >> very interesting. we'll be looking for that. paula, thank you for taking us through all of that. special counsel jack smith says the january 6th capitol attacks that they were fueled by, quote, lies told by trump. the 45-page indictment lays out some of them in detail and cnn's

our role is in that. >> can you decode that for us? [ laughter ] >> there was a lot of sidestepping. >> there was a lot of effort there to not provide the sound bite, saying that no, he does not think donald trump should be president again. but, look, mike pence is in a very tricky political spot, frankly. he wants to run for president. if you talk to people who are close to him, it's pretty clear that's the track he is on. he has used this book that he has released to detail the ways in which he broke with trump over specifically january 6th, saying that the administration that he was part of did not end well. he is trying to take credit for some of the things the conservatives accomplished or they see as accomplishments, whether it's taxing or putting conservatives on the supreme court, et cetera, while still being able to say i don't approve of what happened there. we shouldn't lose sight of the fact this midterm was the first national election we had in the wake of the january 6th capitol attacks.
