that is tonight s last word. the 11th hour with stephanie ruhle starts now. tonight, hunter biden guilty in his federal gun case. what s next for the president s only living son as he awaits sentence thing and what it could mean for the race. then my exclusive interview with john bolton. why he thinks we are not taking the former president s threats seriously enough. plus, pride month under attack. why progress is being lost as the 11th hour gets underway on this tuesday night. good evening once again, i am stephanie ruhle and we are now 147 days away from the election and today the president son, hunter biden, was convicted on all counts in his federal gun trial. the jury deliberated the three counts for just three hours. president biden says he accepts the outcome of the case and will always be there for his son. here is my colleague ryan nobles with more. reporter: tonight president biden arriving in delaware, hugging his son on the tarmac after hunter biden became the first child of a sitting president found guilty in a criminal trial. no one in this country is above the law. reporter: it took three hours of deliberations for 12 jurors to unanimously determine hunter biden guilty of three felony counts. for lying about his drug use on a federal background check to buy a gun. special counsel david weiss, who oversaw the prosecution, saying this is not a case about hunter s struggles with crack, but his decision to break the law. s choice to lie on a government form when he bought a gun and then to possess that gun. it was these choices and the combination of guns and drugs that made his conduct dangerous. reporter: inside the courtroom, the president s 54- year-old son did not react as the verdict was read. he left the courthouse holding the hand of the first lady, later releasing a statement saying i am more grateful today for the love and support i experienced this last week from melissa, my family, my friends, and my community then i am disappointed about the outcome. the verdict comes after four days of testimony from people who are or were once close to hunter biden. many testifying about his drug use around the time he filled out the background check saying he was not a drug user. his ex-girlfriend testified she witnessed hunter smoking crack every 20 minutes or so. the prosecution also using clips from hunter s own book. i have no plans beyond the moment. reporter: the defense argued hunter biden did not knowingly lie on the form. tonight we spoke to juror number 10, who asked that we conceal his identity. separating the politics from the case a absolutely. for us it was not politically motivated. politics never played into anything that we said in the jury room. reporter: president biden, who said he would not pardon his son, writing, jill and i love our son and we are so proud of the man he is today. jill and i will always be there for hunter and the rest of our family with our love and support. nothing will ever change that. with that let s get smarter with the help of our leadoff panel this evening. mike memoli is here. he has covered president biden and his family for more than a decade. susan glasser joins us, staff writer for the new yorker and harry litman, former assistant attorney general. mike, you know this president and his family better than any other reporter out there. how are they all reacting to this? biden has a lot of family expressions and one i have heard him invoke so often is that family is everything. it is the beginning, it is the middle, and it is the end. in the more than decade of covered president biden i have seen them come together to celebrate their greatest triumphs. the election, the inauguration most recently. i have also seen them have to endure some of the most difficult and tragic moments as a family. this is one that yet again has brought the family together. to really take stock of a very difficult moment. really the past week and a half has been so difficult to have to relive through this trial the most difficult moments of their family, starting with the death of beau biden and what it did to hunter biden, leading to the addiction to drugs. as i have been talking to people close to the family tonight i have been struck by a tone of defiance about what comes next. there has been concern about what this might mean politically, but also personally for president biden. he is 21 weeks away from his last election. 16 days away from a consequential debate against donald trump, but the tone i am hearing from people close to the president is that they are so proud of their public service as a family and nothing is going to stop them from achieving the goal that is set out in front of them. they know they have a difficult task ahead. the politics, the legal situation does not get easier from here but they are determined to face this together as a family. harry, you wrote in the l.a. times that the jury decision was right, but the prosecution was wrong. i don t think i know what that means. let me try. department of justice guidelines, stephanie, have ways of handling cases and cases like this in which someone lies on a form but does not do any other crime with a gun or part of a gang or whatever are universally dismissed or not treated with the severity that david weiss treated this one. that is how david weiss first proposed to treat this one about a year ago when the gun charges were going to be the subject of a diversion agreement if hunter biden kept clean for two years. it would go away. so the screaming question, not the jury verdict but the question to charge presents and i don t know what the answer is. what happened to change his view of what was the proper punishment and treatment of hunter biden to take it outside how gop practice would normally treat it. because he is a special counsel no one in the doj supervisory structure which normally would say we don t do that to these cases, here is how we handle these cases. no one was there to say that and i think it is certain for whatever reason that hunter was treated more severely than another defendant with the same facts. you have written that you don t think a game changer could change voters minds about this election so i assume you think this verdict won t have much of an impact. we are getting to the point that you are anticipating me too well. look, if donald trump s conviction and becoming the first convicted felon in american history who was a former president, if that was not a radical change in the election, i don t see the conviction of a private citizen, even one who was the son of a current president to be a game changer in this race. it was that close. there was a minor, incremental shift at best toward biden. it is not entirely clear how this conviction of biden s son will play politically. certainly republicans were immediately questioning this, saying this is really just a distraction and all sorts of instantaneous conspiracy theories. default setting from some of trumps public supporters and defenders. you know, hunter biden is not running for president and that s the bottom line. there is no evidence that years of investigations of him, of dragging his name around, has really affected biden s political standing and i don t anticipate this would, either. hunter biden is not running for president. we should remind our audience he has no role in our government, past, present, and no plans for the future. harry, what could he be looking at as far as sentence goes? the standard guidelines would dictate a sentence between 15 to 21 months, based on the conduct and lack of criminal history. those are just recommendations and my best guess, consistent with what i was saying about how people who don t do anything else other than lie on the form are treated is that he will receive a fair bit less than that from the judge. remember however that there are still the tax charges he has to face and david weiss made it clear that the investigation is ongoing and he may be targeting some of hunter biden s conduct in 2014 or so in china, in business dealings. for this charge i expect him to get a sentence that is a matter of months, not the 15 to 21 that the guidelines would otherwise dictate. even if it is just a few months, hunter biden, unlike most people in his situation has secret service protection. so how does that work? your guess is as good as mine, though we have been thinking about it and we know the secret service prepared a plan when it came up with donald trump. trump would have his own wing and people would be there. there would be a lot of cooperation with local authorities. here it is easier because it is federal authorities, bureau of prisons and secret service. that will be worked out one way or another. i think that is sort of the least of the practical issues that this conviction poses today. michael, you laid it out for us, how close the biden family has. how to finance the president is when it comes to protecting his family, how he talks about the family. around this time last year i interviewed the president. much to his teams chagrin, anger, fury, i asked about hunter and he said my son is an innocent man, my son is a good man. the president is now headed deeper into this campaign into the debate stage. how is he going to handle the questions he is asked, the narrative around hunter now that we have this guilty verdict and a president who does respect the rule of law and decisions made by a jury? just think about the gauntlet that is ahead. i mentioned 16 days from now is the first debate. preparation is critical. the president tomorrow is leaving for an important foreign trip. meeting with other key leaders as well as pope francis. you know how close this president is with that hope. it will be an interesting meeting, but then he comes back and has a little over a week to prepare for that debate. we have never in modern history scenery match between combatants like trump and biden and we know the strategy on the part of the former president is very likely to try to get under president biden skin and use this against him. the biden team looks at 2020 when, yes, hunter biden was a frequent political cudgel that trump tried to use against him and the president s advisers say it did not work then and it actually backfired on donald trump. they are presenting this as do this at your own peril to donald trump, but i think it is a concern to people close to president biden that as important as the debate is and as important as preparation is, will he be able to focus on the task at hand? the answer from those i ve spoken to today is that is not going to be an issue. susan, i m sure you remember this question. former president trump and his friends at fox news said it over and over and over. where is hunter? they said it for days, weeks, months. it seemed like years. yet after today s verdict the trump campaign was basically silent, saying it is just a distraction. what in the world is going on here, susan? well, first of all i guess now that donald trump himself where s the label of convicted felon and has been at the spearhead of the most kind of concerted assault that we have ever seen, i think, by one political party in this country against the very legitimacy of the legal system. it is not exactly a comparison that is favorable where you have democrats on down today saying listen, we respect the rule of law. biden isn t going to issue a pardon for his own son. as painful as this is we think that the jury system works and things like that. the contrast with trump is obviously one that is very unfavorable and i am struck by how quickly trumps allies immediately reverted to conspiracy theories and make- believe. i can t stress that enough. they are still in burnet down mode when it comes to our legal system and that includes, you know, trying to imply that this case is a distraction from the real secret being covered up, the real case that should be brought against hunter biden. whatever the conspiracy theory is, it is part of a purposeful plan to rip down the authority and the legitimacy of the legal system, because of donald trump. because of one man. republicans like to say the current president weaponize is the justice department, but i want to share with democrat jim mcgovern had to say about that very thing. watch this. apparently when a republican is convicted it is weaponization, but when a democrat is convicted, the president s son no less, that is justice. give me a break. hunter biden was found guilty by a jury of his peers, just like donald trump. the divide is stunning and it is a great reminder that one political party remains committed to the rule of law and the other doesn t. jim mcgovern bringing a rational thought to a political party. crazy to do these days. michael, there are a lot of apolitical people. it seems like what you laid out with the a clear contrast for voters. is it? it is interesting because what we didn t hear from the president, from those around him tonight, was criticism of a trump appointed judge that presided over this trial or the prosecution from the trump appointed special counsel. there was none of that in the statement before the trial began and today when the try was over, he reiterated his respect for the rule of law and freedom and democracy have been an important part of the president s campaign. that is an example he is showing not just through those words, but the words we saw in another interview last week. the president has the power after this difficult moment, this difficult verdict, to free his son of any potential jail time. he can issue a pardon as soon as the sentence comes down and he has said he will not do that. if ever there was an opportunity for a president to put their finger on the scale of the justice system and given how close he and his family are, it would seem to be in this moment and he said he is not going to do that. thank you all for starting us off on this very serious news evening. when we return this man once worked in the trump administration and a cabinet level position. now one of his biggest critics. john bolton talks the verdicts in both trump and hunter biden s trials. later the biden campaign has an aggressive strategy to brand trump as a felon. how the president s sons verdict could complicate that. the 11th hour, just getting underway on a tuesday night. da. revenge does take time, i will say that. sometimes revenge can be justified. sometimes it can. look, when this election is over, based on what they ve done, i would have every right to go after them and it is easy, because it is joe biden. you see all of the criminality. i know a lot of republicans want retribution. we are going to see what happens. the former president has been vague on details, but there is no doubt that revenge has been top of mind for donald trump. nbc news noting, quote, trump has done at least five interviews since his guilty verdict. in all five he has talked about possible retribution. his former national security advisor john bolton has been warning about this for years. in february, 2023 he wrote trump really cares only about retribution for himself and it will consume much of his second term. john bolton joins us now. ambassador, thank you for being here. i wanted to talk to you because donald trump is clearly not shy about saying he would get revenge on his perceived enemies in a second term. are we taking his threats seriously enough? i don t think enough people are. when you hear trump saying things like people are saying that retribution can be justified, what he really means is i am saying that retribution can be justified. i think he has a long list of adversaries he wants to go after, but i think the justice department under the trump administration will be in continuing chaos as he tells his political appointee is to go after people whether there are grounds to do it or not and what those lawyers do will tell you a lot about their legal integrity. i think it will put the judiciary under real pressure. you might be on the perceived enemy list. are you concerned at all for your safety? i m concerned about a lot of people that i think he made clear he wants to go after. he tried to suppress my book. he tried to get a criminal investigation started. both of those have been settled and taken out of the picture because they were utterly without merit, but i don t think those technicalities stand in trumps way. he said for example he wants to prosecute the former chairman of the joint chief of staff s for daring to have a conversation with his chinese counterpart in the run-up to january 6, to assure the chinese that they need not worry. trump says that his treason and he reminded people that the death penalty used to apply. i think he is very serious. he may joke about it a little bit, but this will be a retribution presidency and i think the justice department will be where the rubber meets the road. you called the new york verdict a fire bell in the night and you urged your party to nominate somebody else at the convention. do you think that is something that could realistically happen? is there a group behind the scenes potentially working on this? i don t think it is realistic, but i think people ought to have a gut check one more time. for most americans voting for a convicted felon, i think, is going to be a real obstacle. you can say all you want that this was the result of political discrimination against trump. he will be able to raise the selective prosecution argument on appeal. when the case was put in front of 12 regular americans, new yorkers like donald trump used to be, they found him guilty. i think the facts the prosecution presented were clear and that is a problem the party will have and could affect senate candidates, house candidates, gubernatorial candidates. i think if he is elected, electing the first convicted felon as president of the united states will cause real damage to the united states and how we are perceived abroad. given the guilty verdict today for president biden son, hunter biden, what do you say to those republicans who say joe biden weaponized the department of justice and made it his political tool? right and basically shot his son in the process. it is a conspiracy theory. i speak as an alumnus of the department of justice. you could not do in that department what trumps supporters say has been done and not have it leaked to every major media outlet in the country. it is possible to be the victim of selective prosecution and unfairly so and also be guilty. i think certainly that is probably true in trump s case. in hunter biden s case they are not done with him yet. there will be an income tax case and the u.s. attorney, special counsel investigation into hunter continues. so i would like to see what the impact of this case is on the election. it will have an election impact, even though it is not joe biden. it is his son. and see what people think when trump says poor donald trump, the whole world is against him. apparently against hunter biden, too. do you think donald trump is a threat to democracy? we keep hearing that phrase. i want to know if you believe it and if so, practically, tangibly what does it look like? i don t think it is a threat to democracy or our system. i think it will cause enormous damage and a term of confusion and turmoil. but the idea that donald trump is going to overthrow the united states constitution, overthrow the republic as an existential threat to democracy gives him too much credit. i think it is important to state the threat accurately. not to overstate it, not to understate it, but to understand what the nature of the threat is so people who oppose it can combat it more effectively. overdoing it i think gives trump a break and that s a mistake. you said that donald trump doesn t have the brains for dictatorship. even though he said that he would be a dictator on day one. does that make him any less dangerous if he is not that smart but still wants to be a dictator? i think it goes to the point that while donald trump has an infinite span of attention when it comes to the greater glory of donald trump, his attention span on most other issues is about he will to a fruit fly. so that his opponents and even some of his supporters who try and move him away from the most dangerous things that he does will have plenty of room to try to step in. i m not trying to minimize what i see donald trump doing. i think what he was doing at the end of his first term is where it will pick up the day he is inaugurated and it is serious. when you say the republic itself will fall like the roman republic well, really? people think donald trump is equal to julius caesar? give me a break. he may not be, but this time around he won t have the safety guards of you, h.r. mcmaster, the list goes on. are you concerned about the people that are in his current orbit and what they are capable of doing and how they can influence him? yes, i think any administration in a second term does not attract the quality of people it does in the first for the very practical reason that the runway in the second term is shorter. trump will be a lame duck the minute he is sworn in and he has a lot of people around him. basically the people who stayed in the government after january 6 who were second and third rate at best. i think the bigger danger is that trump will insist on staffing a second term on personal loyalty to him above all. he is coming up with his decision for his vice presidential nominee and i think the two questions are, number one, do you think the 2020 election was stolen? and number two, if i told you in a similar situation to do what i told mike pence to do, would you do it? unless the answer to both questions is yes, then that person will not be considered for vice president. i think you will see something similar in all of the key positions. that is a very dangerous circumstance and to the extent the senate republicans included take the confirmation process seriously. if they see people who are more loyal to donald trump than they are to the constitution, that alone is grounds against them. is there a certain person that you see as highly dangerous who you are worried about? i would not want to give any of them academy awards. i think there are bright people including people in the house and senate who have joined this cult of personality and the smarter they are, the more dangerous they are. you are giving us some very serious warnings and things to take seriously, but something i m going to say is not that serious. a write in vote. this election is going to be joe biden or donald trump. in 2020 you wrote in dick cheney. you said you would do it again. are you really giving a clear and honest warning if you are willing to do another right in that won t help anything? look, i bought that argument in 2016 when hillary clinton ran against trump and i voted for trump in 2016. hillary and bill were a year ahead of me in law school and i like to say i ve been burdened with them a lot longer than the rest of the country. after working for trump i could not vote for him, but i did not vote for joe biden in 2020 and won t this year because i don t think he is fit to be president either, for different reasons. when you have two people who don t cross the bar of acceptability, i think it is legitimate to cast a protest vote. a lot of republicans told me a year ago that they would not vote for trump. that they will look at biden and choose what they considered to be the lesser of two evils and i hear other republicans and some democrats say the opposite. it is an unhappy time for america when these are the two people we nominated and it will be a bad four years for america, whichever of them wins. then are these concerns that you have that serious? they can t, stephanie and i think we are already seeing previews of how they will contort themselves and make the reach that, oh no, this hunter biden verdict is unique in and of itself. completely different from what is happening to trump and that is not the reality. i think republicans will still try to say that even though it has been demonstrated that they have nothing to gain here. they tried and failed repeatedly to use hunter biden as a political football and the responses today show that they fully understand that it is nothing for them to win here. i think we were describing trump statement as a distraction. so i don t expect them to stop at that, right? they will keep with the trump lies, but when we look at this broadly we have to keep in mind that that is not going to have an impact in the selection. throughout the afternoon we ve heard it repeated that hunter biden is not running for election, donald trump is. we ve also heard the contrast from president biden who fully says he accepts the jury decision. he respects the justice system, compared to trump saying it is rigged and i think that is a contrast that will be replayed again and again and that will be something that captures voters attention more than the verdict specifically on hunter biden. hunter biden is a one off. menendez s legal bills would disagree. the president has started to use the term, convicted felon, calling trump that over and over. now that his son is in that camp, does it make it harder for him to do that? no, because he is not talking about his son. he s talking about the guy running against him to be the next president of the united states. hunter is not running for anything. hunter is taking care of business and will have another casey will have to deal with, just as donald trump is taking care of his business and will have three or four other cases to deal with. from the president s perspective it is smart politics to call the thing what it is. why would you run away from that? honestly he is a convicted felon. we watched our friends on this network countdown each count, one through 34. i think for the biden team it is an opportunity for them to lean into the politics and this is a political campaign. what candidate in the country, in the world for that matter, would not use this kind of weakness that is self-imposed by his opponent? remember this is all because of what donald trump did. joe biden was not in that hotel room with stormy daniels. donald trump was. the reality of it is, that is the reality. that s the truth. those are the facts and why not talk about it when the moment presents itself? judging when and exactly how each time may be a matter of some decision, but lean into it and call the thing what it is. i want to talk about somebody else that talks about politics today in the presidential race. a republican we don t hear from often, paul ryan, he was on fox news and here is what he said. he said he is a populist and authoritarian narcissist. it is a job that rick myers the kind of character he just does not have. that s pretty strong. that s the way i feel. i agree with that. i don t support biden, either. i think his policies are terrible. a lot of republicans make this argument. we heard john bolton saying basically the same thing on the show. michael, what is your response to that? my response is okay. to a certain extent, to each his own, but at a certain point it has to become about the country. going back to your discussion with john bolton, the reality is this is a big deal. you have an individual who is running for president who says he wants to be a dictator. i don t know. that is not what we do or have done. that is not what we are inclined towards. yet we may have had folks in america who danced with this idea back in the 30s. and in the 1950s with john birch society, but leaders in this country and ultimately the american people said that is not who we are. i am not forsaking the future of my kids and my grandkids to some fool who wants to be a dictator, because i know what history has taught me about dictatorships and that is not who we are. so at a certain point the paul ryan s and john bolton s may sit and go, i can t do that. but what i am asking my fellow republicans to do and center- right voters to do is think about the country for once. think about the bigger issue. think about your kids and the importance of this. there are a lot of things about the biden administration policies i could disagree with all day long, but they are not a threat to my freedom. they are not a threat to my family and my future. i get up every morning and have that fight with the administration. i can t have that fight with thugs from a former dictator knocking on my door. i m at a disadvantage there as an american citizen. so there are some important points to be made about this election. i happen to think that is one of them. i hope paul ryan and others will come around and at the end of the day what they do in the privacy of the voting booth is their business, despite what they may say publicly. i m guessing right now mitch mcconnell is tucked into his bed, nodding and agreeing with everything michael is saying. in public he is going to be welcoming donald trump later this week along with fellow senate republicans. how do you think this will go? i m not seeing that as much. i am seeing that headline. i work with over 300 fortune 500 countries and they are actually not pulling back. i think as a result from last year s pride and the bruhaha over bud light and target. what they are doing is integrating pride more into their every day. taking a 365 day approach versus putting all of their eggs in one basket. i am seeing an increase in commitment. i will tell you why that is. 30% of the next generation are lgbtq. 80% of the next generation identify as allies to the community. if you are a consumer business in america, you need to step up your ally ship. they realize that what they are trying to do is do it in really thoughtful ways. how much does misinformation fuel all of this? that is tonight s last ward, the 11th hour starts now. tonight, hunter biden is guilty in the federal gun case. what is next for the president s son as he awaits sentencing? my exclusive interview with trump s former national security advisor. why he thinks we are not taking the former presidents threats seriously enough. why congress is being lost. the 11th hour gets underway on this tuesday night. good evening once again, we are now 147 days away from the election. today the president s son hunter was convicted on all counts in the federal gun trial. the jury deliberated for three hours. biden excepts the outcome of the case and will always be there for his son. reporter: tonight, president biden arriving in delaware, hugging his son on the tarmac after hunter biden became the first child of a sitting resident found guilty in a criminal trial. it took three hours of deliberations for 12 jurors to determine that hunter biden was guilty of three felony counts, from lying about his drug use in order to purchase a gun. the prosecution saying this was not a case about his struggles with crack but his decisions to break the law. his the choice to lie and purchase a gun. it was these choices that made his conduct dangerous. reporter: inside the courtroom the president s son did not react, he left holding the hand of the first lady later releasing a statement saying i am more grateful today for the love and support i experienced today then i am disappointed by the outcome. it comes after four days of damning testimony. many testifying about his drug use around the time he filled out the background check saying he was not a drug user. his ex-girlfriend testifying he witnessed him smoking crack every 20 minutes or so. the defense argued that hunter biden did not knowingly lie on the farm. tonight we spoke with juror number 10. you felt that you and the jurors separating politics from the case was not difficult. correct. for us it is not politically motivated. politics did not play into anything we said in the jury room. president biden said we are not pardoning our son. he said joe and i will always be there for hunter and the rest of our family with love and support. nothing will change that. with that let s get smarter with the help of the leadoff panel this evening. mike is here, he has covered biden and the family for more than a decade. susan a staff writer for the new yorker. mike, you know i am going to you first. you know this president and his family better than any other reporter out there. how are they reacting to this? biden has a lot of family expressions and one of them i hear the most often is family is everything. the beginning, the middle and the end. i have seen them come together to celebrate the biggest triumphs, the election and the inauguration, but i have also seen them come together to endorse some of the most tragic moments as a family. this is one that yet again brought the family together to take stock of a difficult moment. the past week and a half has been difficult, reliving through the trial, the most difficult moments of their family, starting with the death of bo and what it did to hunter leading to the addiction. as i talk with people close to the family, i have been struck by a tone of defiance and a resoluteness about what comes next. there has been concerned about what it means politically but also personally for biden. he is 21 weeks away from his last election, 16 days away from a consequential debate against trump. the tone i am hearing from people close to the president is that they are proud as the public service as a family and nothing will stop them from achieving the goal they set out in front of them. the politics, the legal situation does not get easier from here but they are determined to face it together as a family. you wrote in the la times that the juries decision was right but the prosecutions was wrong. what does that mean? the doj guidelines have ways of handling cases and cases like this in which somebody lies on a farm but does not do any other crime with the gun or is not part of a gang are universally dismissed were treated with the severity that david treated this one and that is how david first proposed to treat this a year ago when the gun charges were going to be the subject of a divergent agreement, if hunter kept clean for two years it would go away. the screening question, not the jury verdict but the decision to charge presents, is what happened since then to change his view of what was the proper punishment and treatment of hunter to take it outside how doj practice would normally treat it and because he was a special counsel, nobody in the supervisory structure which would normally say we do not do that, nobody was there to say that and i think it is certain for whatever reason that hunter was treated more severely than any other defendant with the same facts. susan, you have written you don t think a game changer can change voters minds about this election, i am assuming you do not think this verdict will have much of a impact. we are getting to the point where you are anticipating me well. if trumps conviction and becoming the first convicted felon in american history who is a former president, if that was not a radical change, i do not see the conviction of a private citizen, even one that is the sign of the current president to be a game changer in this race. it is that close. a minor shift at best toward biden. it is not clear how this conviction of his son will play politically. certainly republicans were immediately questioning this, saying this is a distraction, there were all sorts of conspiracy areas, default setting from some of trumps public supporters and defenders. hunter is not running for president and that is the bottom line. there is no evidence that years of investigations of him, dragging his name around, has affected biden s political standing and i do not anticipate this would either. hunter is not running for president, he has no role in the government, past, present or future. what could he look at as far as a sentence goes? the standard guidelines would dictate a sentence between 15-21 months based on the conduct and lack of criminal history. those are just recommendations. my best guess, consistent with others, is that he will receive less than that from the judge. remember there is still the tax charges he has to face and david made it clear today that the investigation is ongoing and he may be targeting some of hunter s conduct in 2014 in china in business dealings but for this charge itself i expect him to get a sentence that is a matter of months, not 15-21 that the guidelines would otherwise dictate. even if it is just a few months, hunter biden has secret service protection, how does that work? your guests is as good as mine. we know the secret service prepared a plan when it came up with trump, trump would have his own wing and people would be there. there would have to be a lot of cooperation with authorities. here it is easier because it is federal authorities. still that will be worked out one way or another. that is the least of the practical issues this conviction poses today. you just laid it out for us how close the biden family is and how defiant the president is when it comes to protecting his family. at this time last year i interviewed the president, much to his teams anger and fury, i asked about hunter and he clearly said my son is innocent and good. the president is heading deeper into this campaign, how will he handle the questions he is asked, the narrative around hunter now that we have a guilty verdict and a president that does respect the rule of law and decisions made by a jury? ink about the gauntlet ahead, 16 days from now is the first debate. tomorrow the president is leaving for a important foreign trip, he will be at the g7 summit meeting with other key leaders as well as pope francis. you know how close this president is with that pope. then he comes back and has a little over a week to prepare for that debate. we have never seen a rematch between combatants like trump and biden and we know the strategy on the part of the former president is to likely try to get under biden s skin and use this against him. the biden team looks back at 2020 when hunter was a frequent political cudgel that tried to be used against him. they say it did not work then and it backfired on trump so they are presenting this as a do this at your own peril to trump but i do think that is a concern for people close to biden, as important as preparation is, will he be able to focus on the task at hand, the answer from those i spoke to earlier today is that will not be a issue. former president trump and his friends at fox news said it over and over, where is hunter. it seemed like years. after today s verdict, the trump campaign was basically silent. saying it is just a distraction. what is going on susan? first of all, i guess now that trump wears the label of convicted felon and been the spearhead of the most concerted assault we have ever seen by one political party in this country against the very legitimacy of the legal system, it is not a comparison that is a favorable one. where you have democrats from the president down today that we respect the rule of law and biden will not issue a pardon for his son. as painful as it is, we think the jury system works. so the contrast with trump is obviously one that is unfavorable. i am struck by how quickly trumps allies immediately reverted to conspiracy theories and make-believe. i cannot stress that enough. they are still in burnet down mode. when it comes to the legal system. that includes trying to imply that this case is a distraction from the real secret being covered up, the real case that should be brought against hunter. whatever the conspiracy theory is, it is part of a purposeful and political plan to rip down the authority and legitimacy of the legal system because of donald trump. republicans like to say the current resident weapon ices the justice department but i want to hear what democrat jim mcgovern said about that very thing. when a republican is convicted it is weaponization but when a democrat is convicted, the presidents son no less, that is justice? give me a break. hunter was found guilty by a jury of his peers just like trump come up this is the justice system at work. it is a great reminder that one political party remains committed to the rule of law and the other does not. jim mcgovern ringing irrational thought to a political party. crazy to do these days. there is a lot of apolitical people out there. it seems like what he just laid out would be a contrast for voters, is it? i do not think enough people are. when you hear trump saying things like retribution can be justified, what he means is i am saying retribution can be justified and i think he has a list of adversaries he wants to go after and i think the justice department under his administration will be under chaos as he tells his appointees to go after people whether they have grounds to do it or not. those lawyers will tell you about their legal integrity but it will put the judiciary under a lot of pressure. you may be on that list, are you concerned for your own safety? i am concerned about a lot of people he made it clear he wants to go after. he tried to suppress my book and he tried to get a criminal investigation started and they were both settled because they were without merit. i do not think those technicalities stand in his way. for example he said he wants to prosecute the former chairman of the joint chiefs of staff for daring to have a conversation with his chinese counterpart to ensure the chinese state do not need to worry and trump said that is treason and reminded people that death penalty used to apply. i think he is serious. this will be a retribution presidency and the justice department will be where the rubber meets the road. you called the new york verdict the fire bell in the night and you urged your party to nominate somebody else at the convention. do you think that is something that could realistically happen? is there a group working on this? i do not think it is realistic but i do think people should have a gut check one more time at least. for most americans, voting for a convicted felon will be a obstacle. you can say all you want this was a result of political discrimination against trump. he will be able to raise selective prosecution argument on appeal. new yorkers found him guilty because the facts the prosecution presented were clear. that is a problem the party will have an could affect senate candidates and house candidates. i think if he is elected, electing the first convicted felon as president will cause real damage to the u.s. and how we are perceived abroad. given the guilty verdict today for hunter biden, what do you say to those republicans that claimed that biden has weaponized the doj and made hit his political tool? and basically shot his son in the process. it is a conspiracy theory. you could not do in that department what trump supporters say has been done and not have it leaked to every major media outlet in the country. it is possible to be the victim of selective prosecution and also be guilty. i think certainly that is probably true in trump s case and in hunter s case they are not done with him. there will be a income tax case and a special counsel s investigation into hunter. so i would like to see what the impact of this case is on the election. even though it is not joe biden and see what people think when he says for trump, the entire world is against him, apparently against hunter as well. do you think trump is a threat to democracy? i want to know if you believe it and if so, what would it look like? i do not think he is a threat to democracy or our system. i think he will cause enormous damage in a second term and it will be a term of confusion and turmoil but the idea that trump will overthrow the united states constitution or the republic or that he is a threat to democracy gives him too much credit. it is important to state the threat accurately, not overstated or understated. to understand the nature of the threat so people that oppose it can combat it effectively. overdoing it gives trump a break and that is a mistake. you have said trump does not have the brains for dictatorship even though he would say that he would be a dictator on day one. does that make him less dangerous if he is not that smart but still wants to be a dictator? it goes to the point while trump has a infinite span of attention when it comes to the greater glory of trump, his attention span on most other issues are equal to a fruit flies. so his opponents and even some of his supporters that try to move him away from the most dangerous things he does will have plenty of room to try to step in. i am not trying to minimize what i see trump doing. what he was doing at the end of his first term is where it will pick up the day he is inaugurated and it is serious but when you say the republic is self will fall like the roman republic fell, really? people think trump is equal to julius caesar? give me a break. he may not be but this time around he will not have the safety guards of you or mcmaster and the list goes on. are you concerned about the people in his current orbit and what they are capable of doing? yes i think any administration in a second term does not attract the quality of people it does in the first. the runway in the second term is shorter, he will be a lame duck the minute he is sworn in and he has a lot of people around him, the people that stayed in the government after january 6 who are second and third graders at best. trump will assist in staffing a second term on personal loyalty to him above all. he is coming up on his decision for his vp nominee and the two questions on the interview form are do you think the 2020 election was stolen and if i told you in a similar situation to do what i told mike pence to do, would you do it? unless the answers to both questions are yes that person will not be considered. you will see something similar in virtually all key positions. that is a dangerous circumstance. to the extent the republicans in the senate take the process seriously, if they see people were loyal to trump than the constitution, that alone is grounds to vote against them. is there a specific person close to him now that you are worried about? i would not want to give any of them academy awards. i think there are bright people that have joined this cult of personality. the smarter they are, the more dangerous they are. you are giving us serious warnings, something i am going to say is not that serious is a right in vote. this election will be biden or trump, in 2020 you wrote in cheney, you said you would do it again. are you giving a clear and honest warning if you are willing to do another right in that will not help anything? i bought that argument in 2016 when hillary ran against trump and i voted for trump in 2016. hillary and bill were a year ahead of me in law school and i would like to say i have been burdened with them longer than the rest of the country but after working for trump i could not good for him but i did not vote for biden in 2020 and will not this year because i do not think he is fit to be president for different reasons. when you have two people that do not cross the bar of acceptability, i think is legitimate to cast a protest vote. a year ago i heard a lot of republicans say they will not vote for trump but they look at biden and they decide to vote for the lesser of two evils. it is a unhappy time for america when these are the two people we nominated and it will be a bad four years for america no matter who wins. then are these concerns really serious? they cannot and we are already seeing previews on how they will make that reach, no, this one verdict is just unique. it is completely different from what is happening to trump and that is not the reality. republicans will still try to say that even though it has been demonstrated they have nothing to gain. they tried to use hunter as a political football and their responses show they understand there is nothing for them to gain here. it was described as a distraction. i do not expect them to stop though. they will keep with the trump lies but when we look at this broadly we have to keep in mind it will not have a impact on the election. we heard it repeated throughout the afternoon that hunter is not running for election. we also heard the contrast and reaction to the case where biden says he accepts the jury decision and respects the justice system. that is something that will capture voters attentions. hunter is a one-up, legal bills would disagree. now that biden s son is in that camp doesn t make it harder for him to call trump a convicted felon over and over? no, he is not talking about his son, he is talking about the guy running against him for the presidency. hunter is taking care of his business and he has another case he has to deal with just as trump is taking care of his business and has 3-4 other cases to deal with. it is smart politics to call the thing what it is. obviously she is a convicted felon. our friends on this network counted each count, 1-34. for the biden team is a opportunity for them to lean into the politics. this is a political campaign. what candidate in the world would not use this kind of weakness that is self-imposed by his opponent? remember this is because of what trump did. biden was not in that hotel room with stormy daniels. trump was. the reality is, that is the truth and those are the facts. why not talk about it when the moment presents itself? my response is, to each his own but at a certain point it has to become about the country. going back to your discussion with bolton, the reality is, this is a big deal. you have a individual that is running for president who says he wants to be a dictator. in the annals of our country that is not what we do or have done. we may have had some folks who danced with this idea back in the 30s and in the 50s but leaders in this country and ultimately the american people said to with that. that is not who we are. i am not forsaking the future of my kids and grandkids to a fool who wants to be a dictator because i know what history has taught me about dictatorships. so at a certain point the paul ryan s and john bolton s may sit there and go i cannot do that but what i am asking my fellow republicans to do is think about the country for once. think about the bigger issue, the future of your kids and the importance of this. there are a lot of things about biden s policies i can disagree with all day long but they are not a threat to my freedom, my family or my future. i can get up and have that fight with the administration, i cannot have that fight with doug s knocking on my door sent by a dictator. there are important points to be made about the selection, i think that is one of them. i hope paul ryan and others will come around. at the end of the day, what they do in the privacy of the voting booth is their business despite what they say publicly. i am guessing right now mitch mcconnell is tucked in his bed nodding and agreeing with everything michael is saying but in public he will be welcoming trump later this week along with fellow senate republicans. how would this go? i am not seeing that as much, i am seeing the headline but i am not hearing that when i talk to ceos. i work with over 300 fortune 500 companies and they are not pulling back. as a result over last year s pride and the situation over bud light they are integrating pride into the every day, versus pleading all of their eggs into one basket in june. so i am seeing a increase in commitment. i will tell you why that is. they understand the next generation is lgbtq, 30%. 80% of the next generation identify as allies to the community. so if you are a consumer business in america you need to step up your support to the community and they realize that. what they are trying to do is do it in thoughtful ways. thoughtful is the key word here, how much does misinformation fuel all of this? i have seen people say why on earth does pride get a whole month? we have months the support african americans, women s, disability rights, where does the misinformation come from that makes lgbtq a target of things that are not based in truth? moment, of course, creates the split-screen of conservatives who just 12 days ago were slamming the rule of law, slamming the judge, the jury, and the verdict in donald trump s manhattan trial some even claimed the conviction was the end of the republicans. we know it but tonight, they seem to be singing from a completely different tune this is a new error in america, and i think it goes against the elc of who we are as americans and our faith in the criminal justice system in the end, this juror, jury of ordinary people from delaware, we re not intimidated and by that family and they recognize that this was a clear cut case and that clearly no one is above the law. this is a very political exercise. and you have to say that it accomplish what it set out to accomplish. but i would say this abet judge noreika, i think she ran a very fair courtroom. she ran a very fair brian, i guess we all need to shop at banana republic from now on because that s what it feels like. yeah, a banana republic for years, the bikes have been able to escape any legal accountability for their sleazy corrupt conduct but today they re luck ran out, at least hunters did. power is all they love. before this verdict, i should say, with hunter biden how was he when you last spoke with him? he was upbeat. he was positive and but he understood the gravity of the situation and the nature of the trial. so he is well aware of what the possibilities where uncertainty disappointed in the verdict. however, things did not go on his favor does not mean that the favor of god is not a ban him. we believe that his faith is strong course is family is strong and width him. and i encouraged him to look to the heel from what s come at this help? all of his help coming from the lord. but he s focused and we know that things are going to work out in the end a hunter biden has talked about his addiction. he s talked about what that has been like for his life, but i wonder on this particular issue or the set of issues that he was charged, it has now been convicted of has he ever expressed remorse for what led to all of this? i believe that he s aware of every step of his journey and remorse is a part of the process therefore, he is prepared to move forward knowing that god is a forgiving god he has said in his own words that he has hurt people along the wake but we know that the power of prayer, the power family, the power of faith can change him and any situation listen, abbe this addiction issue is a disease this impacted millions of americans regardless of race, creed, or put naomi on trial on witness i i think that was probably a strategy that should not have been done no. no daughter should ever have to testify or again, sir, dad you know, this family wow. was it a mistake for the defense to put a hunters own daughter through that i think they had to make some critical decisions. they had a particular strategy and they were going for what would work for them, what would give them favor in the face of the jury at all? the judge at all who are concerned. it was painful. but we understand that the fence had a strategy. they believe it would work. and we know that this family, again it has gone through was going through a lot and at the end of the day, it s all about what s in the best interests of hunter and the biden family we saw those emotional images of president biden hugging his only surviving son can you tell us what this has been like for him going through this trial? a different kind of trial compared to some of the other trials that he s gone through in his life with the loss of his late wife and several of his other children president, my friend and brother is a man of resilience. a man of deep faith a, man who understands the hand of god when god s hand moves in, his life. and he said that, let justice play out and whatever the decision was of the jewelry, he would respect and accept the decision. but when i saw him come home case and the trump trials and all the of charges that have been brought against could have been obviously brought for political purposes. a hunter biden as a separate instance that s a separate instance, but the other thing about the hunter biden is that this is not the only hunter biden trial. we ll see. there will be another one. it come this fall. so are we going to go through the motions see because according to the polls, i ve seen, the public actually, they do feel that their personal economic situation is better. i just talking two according according to the polls, this is they don t feel like that the country has as a whole other, everyone else is doing as well, but they individually feel better about the, about their economic situation according to the polls, i say maybe i m incorrect, but that s what i ve seen. i think and i think trump voter one of the major reasons is they feel like this economy is terrible and inflation has been bad for them personally. well, i think the reality is that because people s wages have increased faster than actual inflation has increased, people have a stronger economic position and they would be otherwise we also know that more people have jobs 15.6 million people have jobs now for the african american community, we ve had the lowest black unemployment rate in history. we also complaining about that. no you re not playing. i know i know. but i think also i don t want to be the person to make this argument, but i m going to make it anyway. the media, we have a responsibility for his for doing this too. we can we continue to say this is reporting the facts. the economy is doing well or crime is going down. we say the economy is going well and the crime is going down. but this isn t really playing for the american people. why is it playing for the american people? because we keep asking this question the way that makes it a question instead of a fat, it is that the current that crime is going down. we re talking to the fact the kind of thing, but that s a direction as opposed to like an overall real-world thing. we had an incredible insane spike in the year 2020 in everything 2020, we lost our marbles and yes, endorsed into their the congressional sayyed of the group and notorious but one other interesting house race that i m going to take you to. we re going to go away from the south and we re gonna go to the north. we re gonna go to ohio and we re gonna go to the youngstown area. and what do we see here? this is a very interesting race, right? we see the republican. he has won their 55% to about 45% for the democratic candidate. but what s the key thing that s going on? yeah, this is a very republican district. trump won this district by 28 points. and of course this margin right here is a little poor in this country. and he s co-authored a new book called white poverty, how exposing myths about race and class can reconstruct american democracy reverend william barber is a professor and founding director of the center for public theology and public policy at the yale divinity school. he is also a spokesperson for the poor people s campaign. reverend barber, thank you for joining us tonight. thank you so much for having me in this book. you focus on the depiction of poverty in this country. how we talk about poverty, how we show poverty, and you say that black people on the edge of poverty, they re called pour, while white people in the same low-income situation are called working class and getting rid of those stereotypes you argue would help people of all colors, all colors, and races. how would you say that? that would actually happen well, first of all, what we hope to do in this book, and i hope to do is to take to america. the way we measure poverty in government official power measurement is, is a lie, it s distortion, it does not count all of the poor. i want to see america deal with all of her pool. we re talking about 135 million people were talking about 41% of adults and over 50% of our children and the fact that the matter is they re 26 million for low wage black people 60 some of black population. but there s 30% of white poor people. and that s over 66 million when you, when you, when you frame it as being poor people or black, other-focused but working what you re doing is dismissing millions of poor and low weight white people. and it has been down through history, a form of mythology designed to keep black and white people from working together who really are allies and unified when it comes to the experience of poverty in this country. reverend barber, i want to ask you about something that i m sure you ve seen. this is representative byron donalds. he s been making some pretty stunning claims about black people during the time of jim crow and even just today, he doubled down on it when it comes to the social welfare programs and he says are hurting black people in particular they don t want to acknowledge that jim crow was, was, was an era ushered in by democrat politicians and a south who still wanted to segregate and subjugate black people in this country. and they also don t want to acknowledge that is lyndon johnson s great society also heavy democrat policy? that actually lead to fathers not being at home i wonder what your responses to that well, he s doubling down on ignorance. first of all, democrats of that day were not the democrats are today have today, and republicans of that de, well-linked republics, they re not, we re not kind of trump and other republicans today. so let s give it back, but more so what he s dismissing its the same mythology to suggest that the war on poverty was just about black people went. in fact, the war on poverty cut poverty in a major way. and most of the measures in terms of raw numbers help white people, particularly white people in the south the king said in 1965 to the greatest feat of racist oligarch or the puppets like this young man is the fear of a mass number of four and poor white folk coming together, reframing the voting electric in order to change the economic architecture of the country right now in this country, 295,000 poor low-wage people that every year, 800 a day that we cannot dismiss, that, we cannot say that is all right. the fact that we can have presidential election after presidential election debate, after debate, and not even talk about 135 million poor low-wage people who by the way, makeup 30% of the electorate and non battleground states and over 40% in so-called battleground state. poverty is an american crisis. i m arguing in this book, let s talk about all the poor, how it is contrary to our fundamentals about democracy, like establishing justice and promoting the general welfare. let s talk about the 55 million people who make less than a living wage in this country. and let s start fixing policy. to abolish that is unnecessary scourge of poverty low way that does not have to exist in the wealthiest country in the world. yeah, you know, the idea of building a coalition based on class as opposed to race, has been around for a long time. i mean, going back to reverend jackson s rainbow coalition famously tried to do that, but one of the interesting things about this era is that you see this unique dynamic happening in the election where the white christian right has really we attach itself to donald trump, and that has been the frame by which they look at american politics. i want you to listen to what congresswoman marjorie taylor greene said just a couple of days ago in las vegas the democrats in the fake news media want to constantly talk about, oh, president trump as a convicted felon. what you want to know, something the man that i worship is also a convicted felon as a as a pastor, as someone who is a student of history, what do you make of this worship of the former president among the evangelical christian right? most mostly hey, the white christian right. well, first of all, i don t call it christian is religious nationalism. that s the first day because you wouldn t be applying white is the operative word. secondly, you can t talk about christianity and not be concerned about the poor. the first sermon that jesus preached, he said, you must preach good news to the poor and, jesus was crucified for standing with the pool. he was crucified for lifting those who are on the margin. that is not in any way comparison to what trump is doing, but more importantly the most of those folks that she s talking about are not the poor, are poor, and low wasteful. this is a moment in history that we say, we can no longer allow an american crisis to be marginalized or treated like an anomaly and that s what this book is about. it s about the stories of pot from appalachia and folks from the east kentucky that cannot be denied or dismiss. yeah, that often don t get told. that s fascinating what you re saying there again, the book is seemed to be pulling more votes away from biden or trump based on who you spoke to anderson kennedy s coalition of voters, they ve really span the political spectrum polling data does indicate the largest contingent could actually be those who didn t support either candidate i didn t 2020 a lot of his support comes from these so-called double-haters. those holding unfavorable views of both biden and trump, anderson even can thank so much. the news continues, the sorts we count. collins starts now, i ll see you tomorrow. straight on the source tonight. the president and the probation officers were brand new details from inside donald trump s pre-sentencing interview that could have huge impact on his punishment, including whether judge, were shawn since him to prison, were to giuliani s latest mug shot this time in arizona as the ones it s powerful mayor drowns in debt and scandal he says he has no regrets. we ve got the tape of him today a new images of those extraordinary moments that hostages are found alive during that, during rescue mission in gaza in broad daylight, a top israeli official will join me here live. i m kaitlin collins this is the source let this sink in and for just a moment, the presumptive republican nominee and the former president of the united states, just met with probation officers ahead of his sentencing which happens to be one month from tomorrow here in new york. now these pre-sentencing interviews are routine procedures for convicted felons, but it s safe to say there is nothing ordinary about this interview or this convicted felon. here s what we do know as of 9:00 p.m. here tonight, it was around 330 this afternoon that donald trump donald trump met virtually from his mar-a-lago club down in south florida with officials here in new york or sources say that he answered all the questions that were asked of him. cnn s john miller was told that trump was polite, respectful, and accommodating to the probation officers who conducted this interview. and the whole thing was over and just under half an hour it is quite the call, but adding to the unusual nature of this whole thing, we re told that the commissioner of new york s probation department was present for it, along with the general counsel and the officer who s assigned to the case and trump, as we know, with the permission of the judge here, one more sean was joined by his lead attorney, todd blanche, who are you d this case. now, typically, a convicted defendant would meet with their probation officer without their attorney. there. but this was different here. like many of the dynamics here. and ultimately it is the probation department that will submit a report based in part on today s interview to the judge here, who of course, will then ultimately decide but trump s punishment will be, i m joined tonight by trump biographer, cnn political analyst, and you times senior political correspondent maggie haberman. maggie, i mean it s a required step before sentencing, but just the aspect that he is undergoing. this is just remarkable in and of itself, everything about this is remarkable. and i do think that we lose sight of it that especially those of us who were in that courtroom, as you and i were, this is a former president who was trying to understand that his supporters think that this was not a case that should have been brought. they say that all the time. i think his lawyers feel this way too but nonetheless, he was convicted and it took less than two days and now we are hurdling toward a republican national convention, where he is going to be he nominated for a third time as the party s nominee, and he will have just been sentenced a few days earlier on july 11. and so i don t think we can overstate how remarkable this is. i think where it stops feeling remarkable is that voters don t same, particularly interested in it. and so this is history. this is something we have never experienced before. everything you just described is not the usual procedure in this kind of a sentencing report interview. but this is not typical, as you said? yeah, for all the talk of how trump has treat, i mean does get special treatment in some of these circumstances and you talked about the hell the sentencing is on. it s on a thursday. the convention starts that monday based on what you ve heard, has it set in for donald trump himself though, that this is happening, that he is having to answer these kinds of questions to probation officers. it has not actually don t think that the the conviction has left his mind much even though he s i think the best compartmentalize are many of us have ever seen on the political stage. i think he is well aware of what he is carrying over the next four weeks this situation where most of them would try to get a lesser sentence in these kind of interviews or when they go before the judge, trump will have an opportunity to speak to offer to be contrite but it doesn t seem like he s going he has been making that argument based on what he s been saying on truth, social, or rallies, or in interviews about this case and we do know he s also planning on appealing it right after that sentencing happens. so how does he balance the two of those so my assumption and we don t know specifically what he said in this interview. it was pretty short today. i don t know what the average length of those are, but 30 minutes is not a long time on its own my assumption is that he was actually not contrite, but certainly more subdued in that interview. than what we have seen on truth, social, what we saw outside of the courtroom and the hallways at the courthouse, what we have seen him du rallies, what we ve seen him doing, interviews it will be very hard for him to then suddenly argue that that s all just politics. or he didn t mean it, or what have you remember? he s going to be sentenced by a judge who cited him for violating a gag order several several times. and at one point said to him, the last thing i want to have to do is put you in jail, but made clear that that was on the table. if he kept doing it i don t know what this ends up looking like it i don t see a world where trump stands up and says, i m really sorry because trump s still denies anything happened, especially to this judge of all people are rapidly rails against repeatedly, which is you make a really good point there that how he acts inside the courtroom or based on what john miller heard about how he was in this interview? it is quite different than how he talks about it at rallies on tv in front of the mics. as you and i know well, from covering him for a long time, he can be very different depending on what crowd he is playing, two and when he knows that he is playing to the probation commissioner and his probation officer or the person assigned to the case. i am expecting that he was slightly more subdued now, do i think that that means that he said you re right. i feel terrible about all of this. no, i find that very unlikely, but i doubt that it was spoken version of the all caps truth, truthsocial posts and part of this process is family members, friends can submit letters to the court on the defendants. the felons behalf do you think that ll happen in this situation? actually do think that there are a lot of people who are potentially going to write testimonials. we ll see if that happens, but we certainly saw that he and his aides were getting people to attend the trial. normally, when people do that, it s so that the jurors can see sympathetic people around the person is in trump s case, it was so trump could roll heavy with elected officials for the most part. but i could see efforts by his family members, by friends. he went to court a couple of times with steve witkoff, one of his oldest friends whose real estate investor from new york, i could see people like that sending in notes to the judge. yeah. it s interesting. i also wonder the vp contenders who also started showing up, the doug burgum is the jd vance s making very clear. it s also a question whether they would say something on his bath or there s doing it on on television and interviews. my assumption is that they are much likely are to do it to the cameras than they are to the judge because they re playing to a different audience than the judge. their plan to trump seated senior legal analyst elie honig is also your elie you when we look at this, how much impact does what happened today in this whole pre-sentencing report that s gonna go to the judge how much impact does that have on the actual sentence itself? these reports matter. they re not binding on the judge, but they absolutely matter because this is the first time you hear from some sort of neutral third party trusted by the courts, probation department, and i promise you, whichever side likes the recommendation will say, look, the probation department is with us. there on our site and just to give you a sense of how closely he held this information is when we would get these pre-sentence report sent to us as prosecutors, it would come in to emails first and encrypted email that you couldn t open unless you had the code and then a second email giving us the password to open it. so that s how confidential this information is kept. it seen as is proprietary, it s private information, it s personal information, so it s very closely guarded by the courts. does it ever make a difference to the prosecution of what they re going to ask the judge for in terms of sentencing, when they look it over port like this for sure. because let s put ourselves in alvin bragg s position here for a second. this is going to be really close call at sentencing. what does alvin bragg? i think he s likely to ask for some term of imprisonment. i think it s hard for him to bring a case like this. just to get 34434 convictions and then say, we re fine with probation. and if probation, the probation department itself has come in first and said, we recommend prison. it s much easier as the da to say we agree with them. yes. do that there s a lot of information in this pre-sentencing report that it actually could pertain to his other legal issues that he s dealing with from the civil ones here in new york, but also the other criminal cases. could that complicate anything? i mean, is that why todd blanche attended this today? would normally an attorney would not be present for it, happy if i had a client who had three other pending indictments and several civil verdicts in the process of appeal, i would absolutely insist on being there because what he says can be used against him in certain circumstances. another thing to keep your eye on here is now the trump s been convicted once he sentenced in new york that could actually bump up his punishment if he s convicted in the other cases because those cases, what you do is you calculate a person s criminal history. now, he has a criminal history. you re agreeing maggie? impact. do you think it could have i think it could have all of the impacts that le just described. i also think that it could end up being i m not sure that this will happen, but because it hasn t happened yet, but it could end up being a factor in whether prosecutors, any of the other cases and led correct me if i m wrong? on daylight, we typically this kind of stuff seems to happen at night. it was interesting that it did happen and daylight when i was in combat truthfully, kaitlan, we did normal conventional operations in the daytime and nighttime was left mostly for the special operators to do these kind of hits within our area of operation. so to do this in daylight, is just phenomenal to me that takes even more training. but they had to get in there, they had to see the ground and they had to see the train that they were operating on. and what does that tell you about the hostages? notice they re being held and buildings and apartments we know some of them were told are being held in tunnels, but clearly some of them are being moved around and being held held in buildings, but held in palestinian homes where palestinians were aware that they were there this is the coercion that hamas has on the local residents of gaza. and it s right smack in the middle of a neighborhood. and in fact, a un relief agency building was nearby. we have seen this throughout the campaign that these kind of operations by the israeli defense forces are taking place in neighborhoods with mosque, with hospitals, with schools. all of it within the environment of the palestinian people. it s remarkable, general mark hertling great to have you here tonight. also, your tonight, israel s ambassador to the united nations go out or dawn great to have you back. i do know how the hostages are doing. what would ve israeli officials heard about them they said that they re doing well, obviously they need psychological treatment and other kinds of treatment to recover from what they ve endured. but thank god, there they re at home and they are with their families. and that s the most important thing this were four people who were rescued. this puts the total that israel has rescued of hostages since october 7. its seven people. and obviously, it s undeniable that this is a success for the families and that they are happy to see this but also the question is do you, are you worried that it jeopardizes a potential bigger hostage agreement with hamas to release them on the contrary, i don t think he jeopardizes the bigger hostage deal since we had the first deal, hamas refused every for was put on the table. there were own ready. today we re where we had the fourth security council resolution that passed, but we had three previous ones that were rejected by hamas calling for the release of the hostages so it s the only thing that can work is this combination of diplomacy applying international pressure on hamas that started only today with the resolution that passed in the security council. and using our military might. but you can t what israel has not been able to do is rescue all of them through these special ops operations that are happening. we just talked about the difficulty of it. you can see they is so i do think that s a real question tonight of what it means for for a hostage deal, for getting the rest of the hostages home i don t think we forget them. i mean, we we are willing to sacrifice. you saw we are losing when we paying the ultimate price are best soldiers or lose all right sacrificing their life to save the hostages. hamas does the opposite, but what other choice do we have as long as hamas refuses to every hostage deal, i mean, president biden said ambassador linda thomas-greenfield said, the resolution said that we accepted the new hostage deal we are accepting the outline that appeared in the resolution today. i want to ask you about what happened at the united nations today. but on this, israel s facing a lot of backlash internationally because of how many palestinians were killed as a result of this rate, how does israel justify how many fatalities? we have? any country would do the same in order to release and rescue their hostages. and still, we don t know the real numbers of un-involved civilians. there were so many civilians. there that we re cooperating with hamas to keep, to keep the, you know, to keep the host the jezzine in apartments to report to hamas when our forces are getting closer and many times, we know that hamas is using civilians that are not affiliated with any terrorist organization, but still they are terrorists. so we cannot still use the terrorist numbers, as you said these are hamas numbers, figures 200 276, and we regret the loss of life. we always, when there s an opportunity and there s an option, we want this civilian population, we hope that they re not going to stay in harm s way, but you re not denying obviously innocent lives were also lost as a result are you soon i assume, yes. and i regret it and i it s a tragedy, but we cannot i mean, if we don t put the blame on hamas, we are helping and advancing their strategy because otherwise, other terrorists, we are going to use the same strategy in many other countries. if you can abduct innocent civilians and then hold them in civilians apartment and think that you have immunity. it s not going to work. we will never defeat terrorism. let s talk about what happened at the united nations today because you just mentioned in that security council the resolution that passed, it is the first time we ve seen something like this passed since october 7 happened in the eight months since the war happened, you are present for the vote today, but you didn t address the security council. why not? well, i thought that we don t want now to emphasize any differences. i know when sometimes when i speak, people are listening to me and they re listening to what they want to listen to so we preferred to lower the tone today as i said, we accept president biden s first of all, we respect him and we are grateful to all of his efforts and his administration efforts. we accept and we accepted the outline of the deal, but i have to admit we had our concerns about the way it will be interpreted by hamas. that s why we held an intimate dialogue with our american counterparts once our security concerns were addressed so we accepted the deal. you said you had concerns. this is a resolution calling for an immediate it s fire, ultimately a permanent one, and the release of all hostages. can you say tonight that israel unequivocally backs this resolution again, it depends on the interpretation because there s phase one, phase two, phase three, moving from phase one that caused, now for the release of the world on the than the women and the elderly that should be done by hamas. and then moving to phase two, that, then you get to the permanent end of hostilities, ceasefire. it needs to be it depends on upon an agreement that should must be achieved between the parties. one of our conditions this is not only the release of the hostages is also the future of gaza, and we cannot agree to hamas continuing to be the rulers of gaza because then gaza will continue to pose a threat against israel. but this still is israel s proposal. why can t netanyahu say right? yeah. that s a good point. i mean, what do you make of that question? have you ever lied, you know, kind of what this process is looking like for these potential confounders look, i go back to the voters. i think that voters actually care if there s this kind of history. and i think the criminal conviction that trump has had is going to matter. dad. i know there s some polling suggests otherwise right now, but i think it s going to matter in the end. so this actually is important because if, for example the process that they have says it doesn t matter if you ve lived are commit the crime. that s going to come back to hurt them if they say, oh, no, no, we must have a vice president who s never, ever committed a crime it kinda advertise is the problem with the top of the ticket. and i think one thing we can say for sure, top of the ticket dominates here in a way we ve rarely seen, vp is going to be so much marginalized compared to past races but this question kind of speaks volumes well and the question is also, does it affect the margins because that is going to be incredibly important in this election. and so when you, what i ve been talking to people and tell me what you ve heard as well. is that it seems like it s jd vance, doug burgum, and marco rubio who ve risen to the top of who s under consideration electorally speaking, who do you think would be the most beneficial to donald trump s ticket i haven t publicly stated any favorite. they come a strengths and weaknesses. i m sure if you come up with a list of seven or eight names they all bring their own positive electoral history and they have their positions on issues that might have more symmetry with a, an electorate. but that s ultimately up to the present to choose who he wants to be his running a bunch of races. you just read one here in new york. i mean, that is something that people take consideration. one for me, i think in 20241 of the best skills is going to be the ability to get into cities, to go talk to longtime democratic voters about issues that they care about. their are disenfranchised voters out there who aren t going to just come around and vote for your ticket? i ll be this saturday in detroit. i ll be speaking a few hours ahead of president trump. we saw president trump go into the south bronx. i found during my race for governor, as i was talking to asian voters and black motors and hispanic voters when you show up and you don t pander, you show up and actually talk to him about the quality of education in schools or crime, or mental health challenges, or homelessness and more on the issues there are these issues that transcend blind partisan loyalty. so ultimately if you haven t asked me what traits as far as getting out in campaigning and making a difference, i would say it s the interest, the willingness, the ability to get out, not just talk to republicans who may be already with you, but being able to win over the support of democrats, saying that you should be under consideration. you re going to say all right now i will nominate julie sure. that ll help my thoughts. the first to speak up for it has somewhat like good stuff in the cup the vp doesn t necessarily matter beyond what can you add that the top of the ticket doesn t donald trump need somebody who can be a monster fundraiser? he s lag joe biden. this cycle. he needs someone who can go and campaign independent of him. he is going to be tied up in courtrooms. he s gonna be busy who can go out turnout crowds, and reach voters who we maybe hasn t been able to. and then he wants most fiercely loyal to him. and this is the key thing. and you were somebody so you know this i know personally it s somebody who would not do what mike pence did on january 6. that s been a bit of aliveness test and some of these discussions, i think rubio and bergen make a lot but of sense i am kind of stunned though, that there s only really one woman and consideration and she s kinda considered the second tier considering that abortion is one of the top issues this cycle, trump s consistently been bleeding support with suburban women. and i think having a woman in contention would be a huge boom. i hear you, but i have to say, i think it s past that point for them yeah the first time in american history that a right has been taken away. the right to choice has been taken away by the supreme court. those people named by donald trump, having a woman as vp is not going to erase that. there s no way you can make that up. and i think the challenge here is none of these figures that are being talked about for vp are big enough. to really have an effect on the election. they re not going to win the swing voters over. i think this is a key thing. you just said, right? suburban women are going to determine this election right now, that s something that s gonna help joe biden in my opinion, and those swing states, who of these folks that donald trump is looking at for vp are possibly going to help to change that balance. i don t see any of them as decisive. trump has just two dominant and he has crossed the rubicon on issues related to women in such a profound way, vp is not going to say, do you believe any of those three names that could help with that? i mean, a marco rubio or any of those names that could potentially help with some of those voters are two seats. i think first the foremost, the most important trait we re talking about one quality a few minutes ago about winning an election november the most important trait is somebody who can fill the position of being president of united states and that really should be like the top three priorities of picking them. and there are talented people here. i mean, you mentioned doug burgum is a governor of a state and he was a wealthy the businessman and marco rubio is he s a good messenger and he speaks spanish and he can get out and communicate with a larger demographic. but if you go down the list, you jd jd vance, cia, he come comes on your show and you might ask him tough questions and he s ready for, and he ll give you tough answers and you re ready to go back to them and i think the audience likes to watch the back-and-forth there. there are talents by don t think anyone really is going to change the election as a vp of them are particularly presidential in my opinion, respectfully, and i can say democrats and republicans, i can say different or the same analysis for people in both parties these particular folks don t strike me as the person who s going to step in if they were ever called one dynamic though that i think i just want to finish. i just don t think it would be very interesting and valid. trump said, i m going to go for a really well-known, highly respected kind of crossover american figure, someone that people could see as their president. i don t think the people we re talking about here meet that standard. i just think that when you get to a vp debate and you get one shot right? there might be as few as one debates. one debate. and vice president kamala harris is onstage with that candidate, and you re talking about these issues related to the border or the economy, foreign policy and energy. and you re flushing qing out, not just your own positions as a candidate, but really the positions of your ticket and your party in a moment, there s someone there when mike pence arguably beat vice president commonly harrison. a debate in the next day, donald trump s stepped on the entire message at the end of the day donald trump s fatal flaw since he wanted 2016 is not being able to pivot to a general election. he s out there this week and talking about wind turbines and sharks and boats and sinking, not talking about issues voters, qarrah, always talking about rage and retribution. so you can have the best messenger out there. i think mike pence was arguably the best person he could have chosen navigated the trump dynamics in a way that wasn t better could i think i don t know that anyone s going to be able to bring him back to these independencies right? i think we are going to get a verdict tomorrow. i mean, it s not a complicated case. we only had four days worth of evidence. the jury certain lee knows what the issues are i don t think they have to spend more than tomorrow on this, but i think if they don t get a verdict tomorrow, you could be looking at a hung jury here because, like i said, the facts are not that complicated and the legal issues really aren t that complicated. and as we know, if it s a hung jury, they ll try to send them back in, like what we were speculating with the trump case as well. yeah. they would get an allen charge, which is a charge to tell them to continue to deliberate, but they ll also be cautioned not to give up their firmly held beliefs. so it s time for the sake of coming to a close. jurors light want to reach verdicts. they know they re supposed to reach a verdict, but sometimes they can and sometimes allen charge is working, sometimes they don t. i wonder what you thought because you re always we re always trying to get the minds of the jury. we don t know what they re actually thinking, but what do you think they took the prosecution s closing argument today not to pay attention to who is in the room. i mean, it was a pretty clear comment directed at the first lady jill. i mean to refer to people in the gallery are not evidence. i think that was the direct quote to refer to the first lady as people in the gallery. i think it could have been very off putting. you have to assume that the biden family and forget about what you think of joe biden, forget about what you think of hunter biden. i m sure jill biden enjoys a good reputation in the state of delaware. the rest of the biden family, it seemed like a little bit of a cheap shot. i think the prosecutors felt like they had to acknowledge what they perceived as the elephant in the room that you have the biden family there, but it wasn t inappropriate. they were all close family members, right? it s not like, you brought in political allies or people that you wouldn t normally expect, people you wouldn t have thanksgiving with? yeah. if you were the attorney representing hunter biden here, would you have sent the family million? oh, absolutely. i would have had the family that interestingly, i think i would have considered bringing the president there just for the summations now, you can t bring the president there for the whole trial because people say, well, doesn t he have better things to do than sit here for a week, but for summations for a few hours, it would not have been inappropriate to do that s interesting. so you think a president biden being in there would have been helpful? i m sure that discussion was had between the biden family and abbe lowell and they decided against it. and i can understand there are reasons to decide against it, but if you do bring the president there, it does show respect for the system that he s there sitting as a father interested in the fate of his son, but he s not there. and you would have to acknowledge it. he s not there as the president of the united states he s there as the father of hunter biden? that is tonight s the last word. the 11th hour with stephanie ruhle starts now. tonight, donald trump met his probation officer. we will look at a key step as sentencing approaches. the fate of hunter biden is in the hands of a delaware jury. nba legend steve kerr is here and why he speaking out about the stakes in the election as the 11th hour gets underway. good evening once again. we are 148 days away from election. today, one of the leading candidates for president met with his probation officer. donald trump brush off his guilty verdict set for a standard presentencing interview this afternoon, there was nothing standard about how this interview was held. trump got special permission to attend virtually from florida and to have his attorney todd blanche present. he s been complaining for months about it two tiered system of justice and he is right. is new public defenders pointed out today, most people do not get to login remotely from a resort in florida to talk to their probation officers. as for is what happens in these interviews, probation officers generally ask about financial resources, mental health, and any links to other convicted criminals. they also have to ask if you feel remorse for the crime you were convicted of. meanwhile, in delaware, the hunter biden firearms case went to the jury after both sides made closing arguments. hunter biden chose not to take the stand. here is ryan nobles with more. reporter: tonight, it s in the hands of the jury. six men and six women deliberating the fate of hunter biden, the first child of a sitting american president to be charged with a crime. many members of the first family in the courtroom throughout the trial. all of this is not evidence. gesturing around the courtroom and in the direction of first lady jill biden in the first row. people sitting in the gallery are not evidence he said adding no one is above the law. the special counsel s office use the president s son of lying on a federal back on check by checking the box claiming he was not an active drug user to purchase a gun. prosecutors used evidence from his laptop and called 10 witnesses, many describing hunter biden s frequent drug use including around the time he filled out the background check in october 2018. hunter biden s ex-wife testified she found drug paraphernalia inside his car in october 2018. his ex-girlfriend who was dating him at the same time singing hunter was smoking crack every 20 minutes or so. the evidence was personal. it was ugly. it was overwhelming he told the jury today. it was also absolutely necessary. defense attorney abbe lowell argued they focus too much on his drug abuse over a four year period and saying no one witnessed actual drug use during the window of time he purchased the gun. with that, let s do smarter with the help of our leadoff panel. pulitzer prize for investigative reporter with the washington post sam stein acerra veteran federal journalist and white house editor for political and a neighbor of carol. former new york prosecutor and civil rights attorney charles coleman jr. is here. you know it s a big night so you get first crack. donald trump met with his probation officer. help us understand the purpose of these interviews and how do they go and what do we know about what was asked in this one? when your probation officer will ask you questions, what they re trying to understand is what your setup is around your life. how do you live. what your financial resources are and what would be the impact of a particular sentence of a judge decides to send you to jail. are there people who depend on you? are you associating with other criminals which we know in the case of donald trump, he is. we could go down the long list. steve bannon, roger stone, michael flynn, the list goes on and on. one of the things a probation officer is looking to ascertain, and you talked about this, is whether you have any understanding and/or appreciation for the crime you re actually committed up. i think donald trump has a difficult tightrope when it comes to everything he said in the public around this persecution rather than what he knows is actually in the prosecution by the das office, and that will be something that will be hard to get around. the probation report is going to be something the judge takes into account when they make their decision around what sentence they ultimate ultimately oppose. they will make the recommendation and trump s attorneys will argue for as lenient of a sentence as possible. sam, donald trump has been arguing for months and months that there s a two cheered data tiered justice system and its benefiting him. he got to meet virtually with his probation officer. his lawyer was there and when he speaks at his rallies he s always saying i am doing this for you. i am standing here for you. but any trump supporters were in his position, they would not get the special privileges. why do they keep buying this? you are right. when you think back to the gag order that was imposed on trump at various points in the criminal case, that was almost done with reluctance compared to what it would ve been for any other person in the justice system. obviously, donald trump is a unique person in the justice system that he s running for president currently. it makes sense that some leeway is given to him. the justice system works in his favor and i would argue the second story, hunter biden s story, it is not a justice system. the presidents own department of justice is bringing a case against his son. if there was a thumb on the scale of the justice system on the part of president biden, one thing he would do it to alleviate the burdens on his son and maybe let it go away and the president sat back and watched this progress to the point where we will probably get a verdict in the next day or so. carol, get it s been a crazy last eight years and people have become desensitized. it is not even remotely normal for the presumptive gop nominee to be meeting with his probation officer. what is your reaction to this extraordinary moment in american history? i ve thought a lot about that and how numb the country has become to everything that we have watched in the last eight years. nobody can forget and yet we almost act like it was no big deal when then republican nominee for president, donald trump, was caught on live tape talking about grabbing women in the using a course word and saying he could get away with it because he was a celebrity. starting then and continuing on, it was like a starting gun of every other week, every other two weeks, revelations about donald trump as candidate and as president that made us all gasp and wonder, can he survive this? donald trump is the republican nominee for president again. he is the front runner in this race by many polls, and he is a felon who has been convicted of 34 counts of crimes in the state of new york. the city and the town, where he once ruled. all of us are like, oh, yeah, that s how it is. that s sort of the standard now for the last eight years. it s important for us all to step back and remember that no president and no former president has ever been charged with a crime and now we have one who has been convicted and is seeking to return to the white house. charles, an appellate lawyer wrote that donald trump s chances of winning an appeal are pretty slim. what do you think? i think so. when you talk about what it is to appeal a jury verdict, the first thing people need to understand its an rare occurrence that the system will look at the decision that is made by our constitution where you get a chance to have your case heard in front of a jury of your peers, which donald trump did, and override that decision absent some extreme miscalculation by the judge or extreme actions by one of the attorneys. judge merchan does not get enough credit for the way he ran this trial. i think he was aware that all eyes needed to be dotted and all his teas needed to be crossed and that s why he did on such a run such a tight ship to make sure there were as few issues for appeal as possible. that doesn t mean donald trump s attorneys won t seek to find an issue but the likelihood of being successful is slim to none. sam, dal bragg says he will testify before the house about the trump case but most likely not until after donald trump gets sentenced. he knows what he is going to face with house republicans. how do you think he will handle this? i mean, we knew the house republicans were going to do this. they signaled they want to protect donald trump and want to go after the prosecution. there has been overtures they want to defund jack smith for instance. bringing alvin bragg to the hill is something we should ve expected a long time ago. i m surprised they didn t push harder prior to this. i would point to the fact that a jury trumps peers made the determination he was guilty of 34 counts. that s the aspect of the american justice system that trump was right to defense and he was given defense. there will be questions about, who was on his team and funding them? what it comes down to is this is how the american justice system is designed to work. trump at his day in court and had his defense. that is that. the decision was made by a jury of 12 and you have to live with it that s what we do. charles, let s shift to what sam was talking about. the hunter biden case. what did you make of both sides, closing arguments, and hunter not taking the stand? it didn t surprise me that hunter biden did not take the stand for a number of reasons. number 1 comments difficult for hunter biden to give testimony in any way that will try to exonerate him or at least defend against those charges without either incriminating him or at least admitting publicly about his substance abuse. i think that is something he wanted to avoid. i think his team wanted to avoid that and if you are looking at this, it s something that would not of been well for the biden administration to have in the headlines. not that that has an impact on hunter s actual case or charges per se, but i think it was part of the calculus here. with respect to what you heard from the prosecution, this was straightforward. many legal experts myself included understand that when the special prosecutor on the case that joe biden allowed to stay on the case brought the charges, that is, if anything that we ve seen recently is a mass political prosecution we have seen. i say that because for these federal charges to be brought, you typically don t see that absent some additional violent events involving the actual handgun or the weapon that is in question. that s not the case here. hunter biden is not charged with that because we don t have those facts. robert hur decided to bring the charges against hunter biden and the case for the prosecution is relatively straightforward. none of this surprises me. what the defense did a closing argument is you work with the facts you have. they don t have gray facts so they have to call into question the time line. i don t know if that will be enough for a jury to either acquit him or result in a mistrial. sam, the president has already said he will not pardon his son. if he is found guilty, he could be taken into custody . how is the administration, campaign, going to react to this? they have been hands-off about a. they are not hiding the fact this is taking an emotional cole, mental pool, on the president. he is a there. when you ask about present enough, they are hands off. there s discomfort in the white house to even talk about the issue with the president himself. he does not want to discuss it. it s not that he doesn t think it s a political fallout but it s too raw for him. the question, will republicans tried to capitalize on a guilty verdict, and if so, what manifestation? we have a debate coming up. it s not beyond the realm that donald trump will not try to use something during the debate and what we ve been surprised to see is how little republicans are talking about the hunter biden trial including trump himself. it doesn t come up that much. it used to be a topic of discussion but not recently. you wonder if that s because they don t want to draw attention to trump s own legal mishaps or tested it out and realize there might be boomerang effect where people are sympathetic or empathetic to joe biden if you go after his son, part of what the issue is, issue of addiction. carol, no topic. your paper, the washington post , has this story out over the weekend about the trump ally with a quote post constitutional vision for a second term. the man s name is russell, what can you tell us about this? beth reinhard on our national investigative team for this great reporting that presages the future and right donald trump presidency. the kinds of people he is entrusting to make the plans for his new administration. he was a deputy omb director and had been in congress as a staffer for a long time and other federal agencies. he knows his way around the legislative and the executive parts of our government. he is using that knowledge to broadly expand the powers of the executive, if trump takes office. to the point of saying he will find a way for the justice department to prosecute and imprison those who he feels is wrongly gone after the president in the past including journalists. that includes political figures think the biden family members. he has said rather he is said to confidantes that he would work very hard to loosen the military s ability to take action at the president s command to stop protests that are against the president. to interfere perhaps in elections. the military would be an entity the president could send it to domestic situations and something we have avoided ever since the horrors of kent state for example. it s a person who believes in the unitarian executive theory but is proposing things behind closed doors. he may end up being the chief of staff for the president. he is proposing things that send a chill up the spine of those who really study democracy and its norms. here s my head scratcher. there s a lot of conservatives who say they do not like trump what they like his policies. these are the same people who are all about small government with limited power. this, this man and this plan. isn t that the complete opposite of small government, limited power? this is big government with ultimate power. well, i think one thing you have highlighted on your program consistently, if i can give you a hat tip, is the idea of the hypocrisy. the republican party for as long as i have been a reporter which i m embarrassed to tell you how long it has been, has always been about criminal justice and serious tough law enforcement. it s been the party of being concerned about foreign adversaries, rough it russia chief among them but that s all out the window now with trump as president. putin is a great guy and the new republican party. he is a fan of donald trump therefore he is awesome. getting tough on criminals? i think it is smart. reach people where they are. people are getting their news from less traditional outlets and people are watching the news less frequently anyway and people are checking out. it s smart to reach these people where they are and find them where they are not paying attention to the more traditional issues. the biden campaign recognizes whatever it has to do as we head toward crunch time. this is not just about his base. it s nikki haley voters, independence, and never trumper s. the people who could make or break the election which is currently by a lot of polls in a dead heat while press former president trump is not looking beyond his base. will this work for biden? well, yeah, he has to look beyond the base. that s where the election will be decided. i remember when the bush campaign was in trouble in 2000. we had to do a reset and we got pushed into it. we didn t want to do it and ultimately we decided we needed to because we had to. part of it was making changes but a big part is doing a reset for the press and the larger public to say, we heard the message. we are doing things differently. it makes sense practically speaking and make sense of the speaking that you are sending a message that you heard the message and we are doing things differently. in this campaign, it s so razor thin that biden has to do everything right and this is one of them. this is good. one of the things he needs to do is turn up the volume on the things donald trump is saying. they are seizing on some of the comments that trump made it his nevada rally this weekend. i will share a bit. you feel that? i don t want anybody going we need every vote. i just want your vote. i don t care about you. what i just heard him say, i don t care about you. i just want your vote. did the rally attendees here this? what? did they hear that? they have selective hearing. donald trump can say anything on god s green earth and they will cheer on cue. it s important that americans more broadly here it because that s him giving the game away. he doesn t care about anybody. trump s only goal is to keep himself out of prison. to make prosecutions against them go away. he has brought forward no plans to lower costs. nothing to lower health care costs. nothing to increase the amount of jobs. he has no plans for housing or inflation. his campaign is predicated on keeping himself out of prison, out of the courtrooms, and making the cases go away. and a revenge tour against the people who deign to hold him accountable for his crimes. it s a rare instance, less rare these days because he has a proclivity to see the quiet part out loud. he is saying it. if you want an example of someone who treats supporters with nothing but contempt, it someone like donald trump standing there on that stage and basically telling them what he thinks about them. what i like to hear about is the truth mark and billions of dollars in infrastructure funding has made its way across the country thanks to president biden s massive infrastructure bill now law. suddenly, we are seeing some house republicans taking credit for these jobs that were created but for facts say, the same republicans voted against the bill. to their constituents who might not pay attention to traditional politics or watch the news, do they know the new truth? these guys are taking credit for things they voted against. they are not going to hear the truth. let me make another point on the las vegas speech and the ad. there is another ad i think the biden campaign which is the best of the campaign which is donald trump in his voice talking about veterans. i think they should leave that up through election day. it s spectacularly good and impactful. trump has been complaining about it and we call that as hit dogs barking. you know he s feeling the pain so it is working. as a former ad guy, the most effective thing you can do is not say what you think the person said but let them say what they said themselves. it is great. brian, i want to go back to the infrastructure point. if you the biden campaign are running and local elections, what do you do about the fact that you have some house republicans patting themselves on the back, taking credit for passing things they voted against? i think they done an effective job at exposing these people. biden said it out loud when he was in lauren boebert s district that she tried to take credit for the infrastructure plan. it s getting into these districts and doing the side-by- side. the media has been great about showing side by sides where it s donald trump railing against toilets not flushing and trying to keep himself out of prison and biden talking about $35 inhalers. $35 insulin and $2000 a month health care plans and things that will impact regular people. they been good about that side- by-side but it s getting out there and hammering the message over and over and over again. they often say what is the one thing that a politician did to change your life or help you in some way? it s clear that president biden is interested in implementing gun safety measures. common sense gun violence prevention measures. i have been doing a lot of work the last 10 years with a lot of different gun safety prevention people like brady, giffords, sandy hook promise, march for our lives. i have learned so much and i know we can prevent lives. president biden is adamant that he is going to push for commonsense laws that can do that. i know trump will not do that, and so it s a simple choice for me. are you voting for joe biden against donald trump? i am voting for joe biden. i think the biggest thing for me, everybody needs to vote their conscience. i am voting on a few issues, but this is the main one. i lost my father to gun violence when i was 18 years old so i know how much pain people go through every single day in this country. i know gun violence is the number 1 killer of children in america. i know there is so much we can do about this. i think most people out there agree with me whether you are republican or democrat. 80% of people in this country want universal background checks , doesn t matter your political affiliation. we can do this but we have to steer the cruise ship. it will take time. we need to implement laws that the vast majority of our country want and president biden is willing to do the work to try to get those changes. you have said in the past that before you lost your father, as you said when you were only 18, you felt her life was impenetrable. nothing could get you down and bad things did not happen to you. what do you say to the folks out there who thinks gun violence is a problem but it will not affect their life so they don t make it a voting priority. you just don t know. it s such a common occurrence. the chances are likely that you will not be impacted, but there s a good chance that you will also. that is a scary thought. i have a granddaughter who is 18 months old. i am thinking about when she goes to kindergarten and she will have to go through mass shooting drills, and the trauma the kids all across america go through just from those drills and the possibility of facing that kind of situation. it is so traumatizing, and it s a terrible thought that all our children are feeling this way. again, we know that comm laws save lies. they absolutely do. there s so much we can do and it s my civic project that i like to work on is trying to help get, as i said, the ship moving. it will take a lot of work. it s up to us as private citizens to insist the government take the necessary moves to make that happen. there s a lot of public figures who share your views. many did endorse president biden in 2020, but many are staying quiet now. expressing public views right now is getting more and more difficult. the backlash is real. this is not going to be easy for you and you will get heat by all sorts of people. why did you decide to speak out? it s too important to save lives and it s important to do something that s important for our country. not that i can do anything by myself, but i do have a platform. if i can get the message out there, it is so important for families to talk about this issue. neighbors, friends, this is not an attack on the second amendment. this is about implementing things that can save lives. again, it could be your own child. your own mother or father, could be you. we have to understand the gravity of gun violence in our country and not just pass it off as this is the price of freedom. that s what a lot of people say. we have to have the freedom that the second amendment provides us, but it should be kids able to go to school and not being afraid. there are ways to do this. we can protect the second amendment and protects citizens with simple laws. we just have to get everybody on board. it is such a political hot button but it s not a common thought in our country that this is a controversial issue. it is not. 80% of people want universal background checks. we should have that, and that alone would save hundreds if not thousands of lives every year in america. you said it right there. it s a political hot button but not when you go in people s homes and use it other tables and talk about what matters to them. i do want to talk about something else that matters to you that you know a lot about and that s obviously basketball. you played with michael jordan. you know how this superstar was treated early, and the attention he got. given your first-hand knowledge, what do you think of caitlin clark s treatment so far in the wnba? i think it is a rite of passage for young players whether the wnba or nba. other players will test you. she reminds me a lot of steph curry. a lot of people may not remember this but in his first couple of years he was not a superstar. he is not who he is now. he had to get stronger and had to understand people were coming after him. that is what is happening with caitlin right now . it s all in the name of competition. she is handling herself beautifully. she is an amazing player but like every college player who comes in, it takes time and they ve got to get stronger and more used to the contact, physicality and athleticism. she will be fine and everything she s going through now is part of being a pro. what do you think of the fact she won t be at the olympics?
