Im not sure that it is the dissents right to say that the court had to strain to create ambiguity here anymore than it does in a range of cases that get far less attention. Is it more of a strain to find ambiguity than it did in yates . That im skeptical. Other than the intensity of the spotlight im not sure the court had to work harder to find ambiguity than in any number of cases where it resolves hard questions. I think it is fair to say that whether or not the chief justice or Justice Kennedy thought this was ambiguous, they thought it was a drafting error. Its fair to say in other contexts the court has been less hospitable to that. Im not worried about how we come out because maybe it is mistake and congress can fix it. That argument has a lot more sway in other contexts than it had here because in most contexts its a useful and benign fiction. ....

Marissa mayer is she was hired to be a coder at google. She was hired to be someone who literally makes the programs. Her first big project was supposed to be like googles first ad delivery system, you know . Google makes billions and billions of dollars off of ads, and she was going to make the first one. And it was taking her months and monthses and months to do. Google went out and hired someone named jeff dean and this sort of shocked the industry because jeff dean is a superstar. Hes really known for being one of the best coders on the planet. And he did the project that meyer had been work on in a matter of weeks. And mayer, you know, to her credit sort of looked at this and said is, you know, she loved working at google and she said im not going to make my mark at this company by being a coder. Lets get down to business and tell you whats going on this morning. U. S. Equity futures right now. Youre looking at a morning with red arrows. Dow jones would have opened about 46 points down. Nasdaq off 49 points off and s p 500 off about 6 points. But as you would say joe so goes apple so goes the dow. And the nasdaq which has been doing better recently and then yesterday anyone cares to be watching says the dow is getting crushed down 200. If you added it up it was like 140 at one point during the day. The vast majority of the decline. Right. Which made me think that maybe the dow wasnt doing so badly, the other 29 stocks. But then after the bell i dont know how microsoft will be received but apple has a long list i have written down every Single Person that told me that i never will have ever anything to worry about. That 49 billion in revenue is the birth right of apple. You know what they say about history, it doesnt repeat ....
