>> yeah, that's right. so nbc was first to report that there was a memo going out that would release migrants without court dates or the ability to track them. they'd have 60 days to report to an ice office to get their court date, and a judge actually ruled that they couldn't go forward with that policy, and as a result, we found out that they stopped the policy, but they couldn't turn the spigot off quite in time. they've processed over 6,400 migrants that way, 2,500 of those after the temporary restraining order, but the judge ruled last night that he understood that those people had to be released because they've been processed before the temporary restraining order came in play. all that to say, yes, there were 6,400 migrants released without court dates or without the ability to track them. now, that could get some on the right very upset, but it's also important to remember that when a migrant is released without a court date, a lot of immigration advocates say that does a huge disservice to migrants because in the rush to release they might not understand they only have a one-year window to apply

certain migrants into the u.s. with no way to track them. how has that impacted processing and what are you hearing now from dhs? >> yeah, that's right. i mean, they say they will comply, but we understand they're keeping all their legal options open. this is a florida judge who said they cannot go forward with a plan to release migrants without court dates or without the ability to track them. that was under a plan to send migrants to an i.c.e. office to get their court date there within 60 days of their release. it was a process they had in place when they got to those points of over capacity that i talked about. but secretary of homeland security alejandro mayorkas was just speaking to savannah guthrie on the "today" show when she asked him if the border was secure. here's what he had to say. >> you say the border is not open, but there is a subset of people who are being released into this country with no court date and no way to track them. that sounds like the border is open for some. >> savannah, the vast majority

and it will take longer so they think that over crowding could happen more rapidly as more people come and it takes them longer to process. what this would do is anyone who's already been vetted, deemed not a security risk, could be released into the united states with a notice to report to an i.c.e. office rather than a court date, and they could potentially be going without any way to track them. previously they've had to call in. they've had to check in on an app. they've had to wear a geo locater or ankle monitor. that in some cases will now be gone, and this effort to clear as many people out of border patrol processing facilities as quickly as possible. at the same time, the biden administration is doing more to try to crack down on the number people who will be eligible to come into the country and claim asylum. those who don't meet those criteria could be deported more quickly. really it's a matter of seeing what's going to happen here and how the next 24 or 48 hours play out along the boarder and see if the measures the biden administration has put in place to both deter asylum seekers and to try to move people out

and if you give the impression that the border is open, it doesn't matter if you have all of the technology or all the border patrol agents because all they're going to do is catch them when they come in, process them in some sort of way, put them to either report to an i.c.e. office later or to the immigration courts, and right now the immigration courts are overwhelmed. i've added literally hundreds of new judges over the years, and look what's happened. right now we have the highest number of backlog cases for the immigration courts. so i would say the equipment, the technology, the personnel at the border, the funding part, work with the other countries so we don't play defense on the 1 yard line but on their 20 yard line, and have compassionate, dignified policies but strict policies that follow the law so we don't give impression that the border is open. as long as the border -- they have the impression is border is open, they're going to keep
