엘지 그룹. 자료 사진 150억원대 양도소득세를 탈루한 혐의로 재판에 넘겨진 구본능 희성그룹 회장 등 엘지(LG) 총수 일가와 임원들이 모두 무죄를 확정받았다. 대법원 2부(주심 조재연 대법관)는 조세범 처벌법 위반 혐의로 기소된 구 회장 등 엘지 총수 일가 14명에게 무죄를 선고한 원심을 확정했다고 13일 밝혔다. 주식거래를 담당했던 전·현직 임원들도 무죄가 확정됐다. 고 구본무 엘지 그룹 회장의 동생인 구본능 회장과 그 일가는 계열사 주식을 넘기는 과정에서 150억원대의 양도소득세를 내지 않은 혐의로 재판에 넘겨졌다. 국세청은 2018년 4월 엘지 총수 일가가 보유하고 있던 계열사 주식을 100여차례 매매하는 과정에서 양도소득세를 탈루한 사실을 확인했다며 이들을 검찰에 고발했다. 검찰은 국세청 고발을 토대로 같은 해 9월 총수 일가에게 탈세 혐의가 있다고 판단해 이들을 약식기소했다. 하지만 법원은 별도의 법리적 판단이 필요하다고 판단해 이들을 직권으로 정식재판에 회부했다. 하지만 1심은 “주가가 고가와 저가 사이에 형성됐으므로 주식 거래로 가격이 왜곡되지 않았고 제3자 개입을 막을 수도 없었던 것으로 보인다”며 “공정한 거래가 침해됐다고 보기 어렵고 범죄의 증명이 없다”고 판단해 무죄를 선고했다. 2심도 “모든 점을 고려해도 사기 등 기타 부정행위 등을 입증할 증거가 부족하고, 조세포탈의 범의가 있다고 보기 부족하다”며 1심을 유지했다. 대법원도 이날 원심 판단이 옳다고 보고 이를 확정했다.
