like new developments in a legal fight between texas and the justice department. the doj is now suing the state after texas governor grab that refused to remove floating barriers from the rio grande. he says that they determinants from crossing over the state but the department of justice alleges that it's violating federal law. we spoke with the property owner who's been impacted by the states efforts to ward off migrants. rosa flores has the report. >> we are at the south end of our property driving along the river >> she owns an orchard in eagle pass, texas and says her property used to be beautiful. >> my husband and i would come out fishing, in this area it's really pretty >> but she says the state of texas installed concertina wire blocking actors to own property with piles of

she needed help. law enforcement had to cut two sets of concertina wire and fencing to bring her to her property to be able to provide medical attention. take a listen. and i believe we don't have that sound, but in essence, what this property owner is saying, just imagine that you're eight months' pregnant, it is hot. it's three-digit heat. you're overheated and you're asking for help. and, rahel, law enforcement has to cut through concertina wire, several layers of it, to providprovide help. those are concerned with the u.s. doj filing that are concerns. these are migrants, men, women and children, trying to turn themselves into u.s. immigration authorities and all of these barriers just up the danger on the ground. >> abbott and the biden administration heating off.

both of public safety and humanitarian concerns. now, according to governor greg abbott, the state of texas has sovereign authority based on the constitution's of texas and the united states. now the office of the texas attorney general issuing a statement to cnn saying that they're ready to duke it out in court. they're ready to fight for texas' use of these border buoys along the rio grande. now back to the humanitarian concerns. take a look at this video. we were here yesterday when a pregnant woman from honduras was getting medical attention here on the property where we are live. the property owner actually painted a clearer picture of what was happening. she explained to us that this woman was on the river and that law enforcement had to cut the wire to render her aid. they also had to cut the fence to actually bring her on her property to render aid. now, this property owner is very

grande right now as they do maintenance or adjustment to the buoys. according to the doj's filing against the state of texas this also raises public safety and humanitarian concerns. now texas governor greg abbott digging in his heels saying that the state of texas has sovereign authority. that is gets that sovereign authority from the texas and u.s. constitutions. and the office of the texas attorney general also telling cnn that they're ready to duke it out with the u.s. doj in court, to defend the state's right to have and use these border buoys along the rio grande. now back to the humanitarian concerns. we were on this property when a pregnant woman needed help. and we have video of this. you can take a look at your screen. the property owner actually filled us in on the story. they witnessed this. she said there was a pregnant woman from honduras along the banks of the rio grande.

that migration is still happening. erica, that's one of the big points here. you see all of these different bored barriers, you see these buoys. the buoys have a beginning and end. i can see it from right here, and that's the bigger point. the buoys that are at the mid of this legal battle, showdown between the state of texas and us doj is not stopping illegal immigration. my dw migration is continue. it's the humanitarian point, is what the property owner where we are live at, that's her concern. she doesn't want more people, more migrants dying on her property because of all of these barriers. >> yeah. and important to let that sink in, too, the humanity and the people involved here. rose a, excellent reporting. thank you. so good to have you there. more than 345 million people

mexican side of the border. it is lush, green. that's the contrast that locals here in eagle pass always tell me about. they say they miss their side of the river looking like mexico where when they were able to enjoy the river. they'd come out here to fish, and instead, what they are faced with this is wire, and multiple layers of this, and look at this fence. the property owner here, and you know how texas is about small government and property rights, and this property owner does not have access to her river front property. take a look. this gate is completely barricaded by the state of texas. you can't move this thing. it is barricaded with barrels and metal stakes, and the wire. so all of the talk whether it is in washington or austin here in texas, the people who are caught in the middle are the property

stories. in the u.s. doj letter it specific alley says the u.s. government is concerned about the humanitarian risk. tell me a little more about that because you shared that people have died on your property. >> they have. they have. it is true. when the migrants reach this point now we have to look at these buoys. it is unfortunate now we will have to see -- or i'm going to have to see it because i'm out here every day, see them struggling. they may drown. then they have to get to the concertina wire. they may get cut up or caught up and then they have to come up over the fence, and these temperatures are triple digit, it is hot, and, yes, i have seen people die from heat stroke on the property. >> reporter: now, the u.s. doj is saying to the state of texas, if you don't remove these buoys we are going to take legal action. as a property owner would you take legal action against the state of texas? >> absolutely. absolutely. >> reporter: so they could remove the concertina wire? >> we want the wire off. it is a huge liability. like we've talked about it, it is horrible on the migrants coming to seek asylum.
