we ve got a very, very busy day. it s just like monday all over again because of the weather. thanks for being with us this morning. an extreme weather alert. a second wave of killer storms taking aim in the south. we ve got to get out! let s go! at least 11 deaths reported across !51ñ mississippi, tennessee this morning. homes ripped to shreds leaving countless people homeless. the account of the devastation is staggering. maria molina is live on the ground in tupelo, mississippi. maria, tell us what you see there. reporter: good to hear from you. 11 people were killed overnight in alabama, tennessee and mississippi. that brings the total from the past two days of this multiday severe weather outbreak to 28. 28 people killed by these killer storms. here in tupelo, the damage is extensive.
as you can see behind me, what used to be a gas station almost unrecognizable. just a pile of rubble and twisted metal. across tupelo we ve seen car windows smashed, a lot of power lines down. we ve also seen roofs torn off buildings. when weç arrived last night at about 11 p.m. we could smell the strong smell of a gas leak. we spoke to the mayor about that. take a listen. the gas lines are the major concern of the storm damage that has released natural gas lines through the neighborhood. crews have been working nonstop all night long. they have made progress. i don t know that they re 100% completed but they re making progress. the governor of mississippi, phil bryant, arrives at 9 a plt to survey the damage. otherç areas hit hard across mississippi is louisville,
mississippi. look at the incredible video storm chasers captured of that tornado. a big tornado! right there. there it is! athens, alabama, roofs torn off buildings there. today the storm system continues to move eastward and we have a risk for severe weather stretching across parts of the southeast up into the midwest. this is a very widespread area and the national weather service issuing a moderate risk again today. we could see more tornadoes that stay on the ground for a longer paoefrd period of time.ç violent storms right here in mississippi and alabama for the second day in a row here. this is the third day of our multiday severe weather outbreak. please stay safe out there. let s head over to you in new york. maria molina live in tupelo, mississippi, where
she reported 11 killed overnight in twisters. we continue to focus on what s happening with the weather, and that s the continuing story. we re going to have a next chapter in the saga revolving around the los angeles clippers and their owner and the 81-year-old s controversial comments that leads one to believe that he has a problem with theç african-american race. we also know as we mentioned yesterday, not only is there this one-hour tape out there, there could be a hundred separate tapes of donald sterling, the owner of the clippers, talk nag way which will make him look according to reports even worse than the tapes released already by tmz sports. today at 2:00 eastern time it will be announced. what shall happen to the owner of the clippers after those remarks. people all across the country are waiting. and afterwards they ll take action, whether it s the players deciding not to play or sponsors deciding not to take part.

let us know what you think about that. is it a slippery slope or a path to more acceptance? speaking of a slippery slope our secretary of disaster i mean secretary of state, john kerry, really angered a lot of people when he said behind closed doors to a room fullç of influential world leaders, he said israel is at risk of becoming an apartheid state. we ve got a little clip of it. it s kind of hard to hear but that s what he said. listen. i heard [inaudible] apartheid states [inaudible] a state that destroys he said those remarks and it began to resonate written by the press in israel. now the word has gotten out. you ll hear his reaction. when there was backlash he
pointed to the partisan reaction to his comments. how do you explain this tweet from barbara boxer, who is a democrat? israel is the only democracy in the middle east and anyç linkage between israel and apartheid is nonsensical and ridiculous. this backlash is bipartisan. aligning with the time when they spent the weekend and a day remembering the holocaust, it seemed to jab a knife into the heart of those in israel. this is rush limbaugh. who again are the anti seplites? not these guys. these are the tolerant oées, the democrats, john kerry, the leftists. a dangerously absurd thing to be saying. the people that think something like that is

despite its long history of supporting unions, media matters, that liberal activist group that declared war on fox news, doesn t want their own employees to unionize. this is aç petition they the seiu sent to media matters. it is reported now that the watchdog group is hiring big powerful attorneys. joining us to weigh in is the professor of international politics and american government at the citadel, also a fox news contributor, mallory factor. good morning to you. i don t get it. you look at their website, they re so prounion. yet you say now that the people of media matters who work there, the worker bees, they want to unionize, media matters says we can t do that. media matters, when it comes to their own employees they want to reward their best employees
and deal directly with their employees. they know if they have a union in between their employers will lack freedom and they re no( going to be able to reward employees who are doing well. let s put hypocrisy aside. we should congratulate them for the first time doing the right thing. media matters? media matters. they re standing up for workers rights. i don t know if they re going to do that in the future but now they are. they are standing up for workers rights by saying we don t want to unionize this place. when you look at media matters, considering all the money they have gotten, for instance from seiu, in 2012 they took $100,000 from them.ç in 2009 they took $50,000 for a total of $150,000 we know of. they re such big supporters of them. look at other unions that have sent money media matters way, $140,000 from that big union, then $35,000 and $400,000 from
the teachers union, the n.e.a. on paper they look very pro-union. yet, their chance to unionize, no. they have been sticking up for the unions. they have been attacking fox news and any other outlet they consider conservative. they have been going after anybody fighting for workers rights. whenever we do a segment here on fox news that they have a problem with, they oftentimes distort things and take sound bites out of context. that s just how they operate. you know, curiously, they haven t done anythingç about how sharyl atkisson, how she claims media matters helped her produce stories for cbs. yet, they are a partisan attack dog. they are did he definitely a- they are definitely a partisan attack dog except

student body perceived this as what? what is the general feeling on campus? theç general sense from my standpoint was one of outrage. people were horrified that the reactions from the administration was such that the sensitivity of one group was able to outweigh what was a charitable event put on by the vast majority of the student body. most people on the campus, as far as i can tell, are very much in agreement with the opinions we express in the paper. the student who put forward the complaint said this was for business. you say it was for charity? it most certainly was. this is the third year in a row that the fraternity and sore sorryty put this on together. this is a charitable opportunity which has gone awry. what is your fear with this move? our concern is that the

unfortunately another extreme weather alert for you. deadly tornadoes slamming across the south, and this storm chaser had a very close call with one of them. take a look at this. oh god! please make it pass! please make it pass! wow. amazing. he did make it out okay, but the storm system went on to kill 11 people in alabama, mississippi and tennessee. maria molina is live on the ground in tupelo, mississippi. maria, what are you seeing there? we re seeing such heartbreak and devastation. reporter:ç absolutely,
heartbreak and devastation and now the death toll rising to a total of 28 people killed by a multiday severe weather outbreak. when we arrived here in tupelo, mississippi, last night we could smell the strong smell of a gas leak as well. we spoke to the mayor about 30 minutes ago about that. he said crews have been working all night and making progress on repairing those lines. they have a very difficult task ahead of them due to how extensive the damage is here. behind me you can see what used to be a gas station reduced to a pile of twisted metal and rubble. across the city of tupelo we ve also seen carç windows shattered, cars tossed, roofs blown off buildings and power lines down. one survivor in tupelo who was driving to work when the tornado hit described how powerful the wind was. take a listen. everything was flying. the roofs, metal, woods,
everything was like wide. reporter: people are starting to dig through the rubble in tupelo that was once their home. in pearl, mississippi, another hard-hit area by these storms, mobile homes were tossed and destroyed. in kimberly, alabama, a firehouse was blown apart by strong winds. the storm system is a very slow mover. we expect more strong storms today stretching from parts of mississippi includingç right here in tupelo, mississippi, and that stretches farther north into the midwest. the storm prediction center issued a moderate risk. this is an issue for the third day in a row from the storm system that includes parts of mississippi and alabama. those are areas that could see some of those long track tornadoes, meaning tornadoes that stay on the ground for a long period of time. we have all the conditions ripe for severe weather. very humid air mass here. we have very warm temperatures ahead of the storm and a lot of wind sheer. that means these
thunderstorms that fire up later this afternoon into this evening could start to rotate and unfortunately produce mosu tornadoes. again, anywhere from parts of the southeast up into the midwest. please when the warnings get issued, seek shelter. do that fast. maria molina live in tupelo, mississippi. they have had days advance notice. keep in mind, they knew this was going to be moving through that area last night and yet 11 people were in the wrong place unfortunately when the tornadoes came through their areas last night. it looks like it could be another rough one today. like maria says, keep an eye on your phone because you can get emergency alerts on your phone. or stay near your television. heather nauert is standing right by the couch with other news. the feds are starting to look for new contractors to run obamacare s website. could a small business run healthcare.gov better than a big government contractor? the administration begins aç

and how did it happen, if so? former pennsylvania senator and former presidential candidate rick santorum said yes. he wrote a book called blue collar conservatives, recommitting to an america that works. he gave the g.o.p. a wakeup calling urging the party to reconnect with middle-class america. joining us now is senator rick santorum. why is this the right message for you now? if you look at what would happen in the last few elections, we are losing elections because middle-income americans feel like republicans don t care about them. so they re not turning out to vote. an estimated six million folks who were going to vote for obama, squarely in the middle of america income wise stayed home instead of voting for republicans because we re talking about tax cuts for high income individuals, balancing the budget and cutting government programs, all of which are things that i support. but what if you re in middle income america? where are you talking about me? no one is talking about the
70% of america that don t graduate from college, folks looking for jobs. we need to have an agenda for them. this book lays out an agenda, policies of how we can make lives for average americans better. how much is the perception we give people that decide not to go to college or not to finish college and go learn a skill or trade a bad feeling in our society? that s the otherç thing. we should celebrate all work. the obama administration through obamacare and a bunch of other welfare programs subsidizes people for not working or discouraging people in obamacare s case from working. we need to say work is a positive thing no matter what work you do. the earned income credit is one thing i talk about in the book but there are lots of suggestions of policies that can move us in the right direction of rewarding work, encouraging people no matter what the work is, that it is a positive thing for them. republicans who end up being labeled as a party of white rich guys will not be successful and it is not accurate? i
the last convention. i spoke on tuesday night and they had placards saying we built that. one after another remember when obama said you didn t build that? we had one after another come out, small business person saying i built this. but we didn t have workers come out and say i m here because this person standing next to me did build a great job, great employment place for me to work and employer put their arm around the person and say we re a great team. or i worked 9 to 5 for you who put up the capital. we need to be unified. the other side, they re going to divide all the time. we need to unify. senator, you had almost no momentum going in your pickup truck, traveling around. no one took you serious. then you came up on the scene, you almost took the nomination. you have the foundation to run for president again. you re aheadç of where you were four years ago. what are the chances of you getting back in this this? we have patriot voices,

but i guess the concern as a mom, i want to let my kid go anywhere anymore, it s not that world. why wouldn t i check in and monitor their freedom? i don t see it as though i m infringing on their personal space. i need to know they re safe. parts of it is you want to help your child transition to adulthood and that can be rocky. so what that process looks like is to slowly give them freedom and back off when they vital new some particular wait a minute way. it s a process. with colleges, jobs, people are look at their behavior on-line. what do you say? that s true. part of it is helping your child think creditly about what they re going to encounters. in the work force, at college, et cetera. but let them be making the decisions. that s part of it. they need to learn to make decision because whether they re out of your household, they don t have you to turn to. so don t punish them or critique them, understand what s going on? it s a process.

if you re just wake up, we ve got another extreme weather alert. as the sun comes up across the southeast, we re seeing all devastation left behind last night by dozens of tornadoes across our south land. that s right. at least 11 people dead in three states. alabama, mississippi, and tennessee. maria molina knows that very well. she s on the ground in tupelo, mississippi. i see you moved your location slightly. what are you seeing? the damage here is so extensive, very severe. behind me we have what appears to have been a strip mall. the roof has been blown off. is there is a lot of debris inside what s left of that structure. we ve also seen piece of furniture. there is a couch that s just outs in the parking lot. there is pieces of debris that s let serring the roadways and also the parking lot. power lines, some of them are down and the ones not here in
the area that we re standing in are just dangling. we ve also seen car windshields that have been shattered and also basically just a lot of damage out here. some buildings are unrecognizable. they re just a pile debris. they have allowed traffic to allow people to get to where they need to go. something lard to convey through video or images is the smell of gas over the past 30 minutes, it has increased in intensity here in tupelo, mississippi. we did smell it last night when we arrived and did speak to the mayor about that. take a listen. the gas lines are the major concern of the storm damage. atmos energy through some of the neighborhoods, those crews have been working nonstop all night long. they ve made progress. i don t know that they re 100% completed. but they re making progress.
and tupelo, mississippi is just one area hit hard by the severe weather yesterday and in the overnight hours. in pearl, mississippi, we ve also seen video of mobile homes that were destroyed and severely damaged out there. we have reports as well of severe damage in parts of tennessee and also across alabama. the storm system continues on the move and the storm proceed diction center has issued a moderate risk yet. we ve had that already for three days in a row, including parts of mississippi, kellogg right here if including here in tupelo and parts of alabama. preparing into the midwest. this has been a rotten week weather wise. peculiar i can t, thank you very much. let s talk business now and let s talk interstate business. score another one for governor perry. no kidding. he s been on this program. he was with us about a year ago talking about how he s encouraging businesses to head down to texas. texas is open for business.

coming out of georgia this morning. as workers were showing up at what appears to have been a fed-ex ground facility in georgia, there are reports of a shooting in this area in kennesaw, georgia. we re hearing at least six people have been hurt. officials are saying that the injuries so far range from minor to serious and that shooter, as we understand, is still on the loose. dozens of cops and emergency workers are on the scene right now. fed-ex just releasing this statement saying, quote, fed-ex is aware of the situation. our primary concern is the safety and walt our team members, first responders and others affected. we will keep you updated on there story as it develops throughout the morning coming out of georgia a short while ago. in north texas the woman known as mama damato has been laid to rest. the mother of form new york senator and fox news contributor

facilities in kennesaw, georgia. we understand that the shooter is still on the loose. this happened around 5:45 a.m. eastern time near cobb county airports, just northwest of atlanta. officials say the injuries as of now range from serious to minor. right now we understand that there are dozens of police on the scene and they are hunting for an active shooter right now. fed-ex, a short while ago issues released this statement, saying issues quote, fed-ex is aware of the situation. our primary concern is the safety and well-being of our team members. first responders and others affected. we ll keep you updated on there story as it develops. as of now, six people have been shot so far and someone is still on the loose, a shooter on the loose. another fox news alert. a second wave of killer storms taking aim at the south.
let s go! look at that. the death toll after two days of tornadoes, rising to at least 28 people. you can see the homes ripped to shreds, leaving countless people homeless today. the extent of the devastation is staggering. the family from arkansas hit by a twister for the second time in three years. the family is okay, but their home completely destroyed. the roof is gone, the windows are blown out. the only thing that wasn t touched we hear this time and time again was the cross on the fronts door of their home. we know god was with us. god was taking care of us and he s still with us. indeed. more tornadoes and severe storms are expected through the south again today. we ll keep you posted on that. also new overnight, could you imagine look out your airplane window and seeing a fire spewing from the engine? look at this.

think of john kerry, the disaster that is right now. we heard warning that israel could be apartheid state if they don t enter peace talks. should he resign? he s kind of apologized. he s done the walk back. as soon as it came out of my mouth, i regretted make the comments. we have to remember this comments doesn t exist in a vacuum. especially at the beginning of the administration. there was a loft concern from jewish americans and awful us to support israel that the president really wasn t as i think continuing the relationship with israel as it had been continued and conducted for years. so there was a loft concern, a lot of push back on the settlements, et cetera. so there was a lot of concern early on. so this kind of confirms what a lot of us believe about the president s approach to israel and the middle east peace. it s always israel s fault.
and to say that apartheid he said he misspoke. i don t want to make too much of it. but the word is very charged. like the word holocaust. apartheid means economic and social and political disenfranchisement and discrimination institutionalized discrimination. this is our only ally that s a real democracy in the middle east. he knows that. he s going to have to do is he going to resign. he s not going to resign, i don t believe, over one comment. i think the policies are the real problem. and i don t think to brand israel an apartheid state has been very helpful, but he s going to be cleaning this up for some time. i think you re right, because people in his own party are steamed. boxer. yes. senator barbara boxer was on the twitter machine. she says israel is the only democracy in the middle east and any linkage between israel and apartheid is nonsensical and ridiculous. bad politics. yeah. plus, jewish leaders are fuming.
yeah. again. the left rushes to demonize people who are either republican or conservatives who misspeak. i don t want to do what they do. i m more concerned about the fact that we have a foreign policy that is essentially nonexistents today. we ve accomplished nothing really in terms of foreign policy. america is weaker. everybody knows it. china is only the move. russia is on the move. and the middle east, all these dreams that we had of an arab spring turned out to crush religious minorities, crush christians, still have the textbooks in muslim countries that say jews are pigs and are defiling the world. so that s all continuing under the obama administration. so we re weaker and that s my real concern. one comment, it s a stupid and horrible comment, but the policies are the problem.
i think it s so true because you can t debate a policy if there is no one to debate. we ve taken our hands off the wheel. what do you think, mom? right. that goes right to hillary, too. let s talk about domestic politics and a woman that a lot of people are saying is a liberal s liberal. the senator out of massachusetts, senator elizabeth warren. her book has become a best seller because she s taken on the rich, on the capitalism. she says it s rigged. she says it and said it also on the daley show. that s what s fundamentally changed. it s tough out there. it really is a rigged game and it s set up now over and over. it s probably always been. well, snot not like this. it s set up over and over that the rich get richer and the powerful get more powerful. they ve got all the advantages of concentrated money and concentrated power. wait a minute. she lives in a mansion. she was paid $350,000 to teach one class at harvard. and i believe she s worth north
of $10 million. she s a 1%er. yeah. nothing is ever rigged at harvard, right? nothing rigged. it s so easy for a conservative professor to make their way at harvard or conservative students for that matter. they re never discriminated you know something? warren is for the whole equal pay mess. women, equal pay, 70 cents per dollar. she s all for policies attend up hurting the middle class. she s against the keystone pipeline. she believes that the minimum wage should be $22. that s what she said would be equitable. that would be fair in the currents market. so she talks good game and i think a lot of people do believe that money is concentrated in fewer hands today. that s true. fewer banks as well. no doubt about that. there is a populist pitch to be made, but her ideas actually run counter to helping the middle class. she s also for immigration
amnesty, which i think, you know my position on this, it will hurt the middle class, hurt black american, hurt single mothers because it will depress wages in the united states to legalize millions upon millions of people who are already here. so i understand the moral case for that. i get it. but it s not going to help the middle class. that s farce. so she s got to change her policies to have any credibility on boo hoa the middle class. speak of stupid. we re going to move the party over to dartmouth college. you know it well. they can t use the word fiesta because it s racist. one of the students filed a complaints there. the editor of the dartmouth review was here with us and this is what he had to say. people were horrified that the reaction from the administration was such that the sensitivity of one group outweighed what was a charitable
events put o on by the students body. our concern that the rule of law on dartmouth campus seems to be eroding slowly. the group with the ripest self-esteem gets a pass on these issues. there is no sense of bringing people to the table. it s always if you re offended, the most sensitive, you prevail. you say? i was editor of the dartmouth review a while ago. i was the first woman of the editor review. look, now one person, one young woman said she was offended by the word fiesta and the fact that they served, i don t know, mexican-themed food, that was so offensive to her that she i guess she wrote a letter, made her views known and the fraternity president and the sorority president, oh, of course we re going to cancel. so there is a couple of things going on here. one person can be offended and

the afternoon hours yesterday. we know that tornadoes touched down in places like mississippi, alabama, and also across the state of tennessee. here the damage is extensive. behind me we have what used to be a strip mall with the roof blown offment there is debris inside of it. we ve seen furniture outside of park lots, metsal scrappings on park lots as well, thrown around. and cars tossed and flipped and windows shattered as well. and also car wind shields shattered. we did speak to someone who survived a tornado. he was in his car when the tornado hit and that car was pushed to the side. his wife and children were at the restaurant and they had to hide and ride out the tornado inside in the cooler. he survived and they are all fine. but their business severely damaged. other survivors who rode out the storm when the tornado hit here in tupelo, take a look.
ripped the roof off the building over there. we all jumped in the pit. glass flying all around down in the pit. to see trees twisted and snapped like what they are now it s nothing i ve ever seen in my life and nothing i want to see again. we ve also seen images of trucks and cars overturned and just again, the debris extensive out here. something that s hard to convey over video or images is the smell of gas. that s also been a big concern here in this city and we spoke to the mayor about that who said that crews have been working long hours overnight and have been make progress on that. other areas that were impacted hard by tornadoes, louisville, mississippi. that county, three people were killed, extensive damage there as well. the threat for more severe weather extending from parts of the southeast up into parts of the midwest. there is a moderate risk issued by the storm prediction center, including parts of eastern

baby monitors are supposed to give parents an extra layer of security. but one ohio couple recently made a horrifying discovery when they found out a hark using the monitor s camera to watch their baby inside that baby s own room. sharing their shock story is heather, along with her sweet baby, emma. good morning. emma, you are so cute! let me tell you, you hear this
story. it sounds horrific. can you describe to us what happened? you hear this man s voice coming from emma s room. what happens then? it was terrifying. i immediately woke up and i looked at the monitor, which is on my cell phone. i looked down and i saw the camera panning around her room. so realized that someone was controlling the camera and look in her room. i woke my husband up and he ran in there immediately and when he walked in, the camera panned up and looked straight at him and start screaming expletives at him and it was terrifying. he unplugged it from the wall at that point to disconnect the camera and then we just had to console emma, who was terrified. it s just so fightsenning to think some creep can have access to your little girl. the irony is that you have this to protect her. she s so sweet, you want to do
that. did you know it it had happened before? that would be my worry that, this wasn t the first time. i don t know. and if this man hadn t spoke and yelled at my daughter action i would not have known that he was even watching. so we don t know if it happened before. that mix me crazy to think that someone could have watched me in her room for several months before. and i no way of knowing. such a violation. have you used the monitor since then? yeah. we disconnected it for a few weeks and did some research on it. we have since rehooked it up and we ve added some security to it. so it should be safe now and secure. we do still use it. i think it s good tool. but just wants to make sure everyone knows to make sure it s locked down. it s so creepy to think this happened of the such a violation. emma is so sweet. what can parents do?

not to come out of the earth. it is too cold. joining us is anna kooiman for elisabeth who has taken the day off. that s allowed. we have a live camera with elisabeth. we ll be dipping into her life throughout the day. let s talk about benghazi. judicial watches put in a freedom of information request to find out about memos and e-mails transferred during the time of the benghazi attacks a couple of years ago. it turns out if you ask the right way, if you try hard enough, you eídç up getting those memos and they turn out not redacted. the key is you have to sue them. we ve done a lot of stories on benghazi but this is the one you ve really got to pay attention to. because of this. as it turns out the white house had these documents they turned over to the house oversight committee. about 100 pages? how would you know because so much stuff was blacked out they were useless. judicial watch sued them under the freedom of information act. they went to court and
wound up with these unredacted things. who told susan rice to go on the sunday talk shows and say it was a video. now we ve got these unredacted things from ben rhodes, barack obama s assistant and the deputy national security advisor, one of them entitled prep call for susan rice the day before she was on tv. it said the goal was to underscore that these protests are rooted in an internet video and not a broader failure of policy. it does not mention, according to sharyl atkissson who has written a blog, does not relate to terrorism. the national security council is basically saying the e-mail referring to protests going on around the region in cairo and benghazi, they were talking more about the flavor of theç region. that statement did not
address what fox news asked, which is where did you get this information about protesting sparked by the video, the attacks on benghazi on innocent americans, where did you get this information from? snorkelly ayotte was on with grate at that senator kelly ayotte was on with greta last night. we asked where the video reference came from. now we know it came from the white house. this is a dynamic where the president in the election was claiming he had been a good foreign policy president, had al qaeda on theç run. the other thing in this e-mail here that is very troubling is this reference to make sure you mention that al qaeda has been destroyed. then you saw ambassador rice on every single sunday show saying al qaeda has been decimated. blame it on the video, not on the president s strategies. it reads more like a p.r. strategy than it does trying to get the proper intelligence to the american people. remember it was seven weeks before the election,
and at that point the talking point for the administration was bin laden is dead and al qaeda is on the run, we ve got them on the heels. what happened there proved that wasn t true. but sharyl attkisson who worked at cbs she resigned because she couldn t do what she wanted to do, specifically benghazi. ben rhodes, the president sç assistant, his brother is president of cbs news. sharyl noted that in her blog. but jason chafits said the government tried to keep the e-mail secret because they initially had it declassified but then they classified, pwhrabgdz it out and sent blacked it out, sent it over and there was nothing there. i would say too they are

completely newç just because we have an african-american president. we did reach out to his office and haven t heard back for a comment. we ve got lots more news to tell you about. once again we turn to heather nauert. got news now to bring you at nine minutes after the hour. we break in with breaking news that came in overnight. prison officials try a new drug cocktail to kill an inmate but the execution is botched. the inmate died more than 43 minutes later of a heart attack. now all executions in the state of oklahoma are on hold. the man exploded after the first of three injections and then the execution stopped. some witnesses say the convicted murderer then tried to get up and talk. pretty gruesome description there. witnesses say he looked likeç rambo. a guy with a shotgun came in. he shot the guard in the
belly and then he went inside and started shooting. police identified the gunman pwho shot up a fedex warehouse in georgia. he is a 19-year-old, a package handler for the company. etches armed with a knife, molotov cocktails and had bullets strapped to his chest. he shot six people before he turned the gun on himself. three are in critical condition. police not releasing a motive yet. amanda knox and her roommate fought over money before knoxç allegedly n knife, her off with a according to italian court documents that were just unsealed in that case. a court informant claimed convicted knox and her former boyfriend of murdering kirchner. knox was first convicted of murder about five years ago but the verdicts were overturned on appeal in 2011. in january a federal appeals court overturned the conviction. knox now in seattle was

regulation. now a liberal blogger is attacking the move saying, quote, this represents an utterly stupid and useless case of corporate welfare. rick perry is engaged in domestic financial terrorism. is rick perry probusiness? he sure is. he s probusiness and anti-american. strong words there. but is bringing jobs to your state really financial terrorism? here to weigh in is stuart varney. good morning. are you kidding me? isç there any validity to that argument? do you think tax breaks to steal business from another state, does this hold water at all? sheer nonsense. actually it is sour grapes. toyota goes from california to texas lured by less regulation and much lower taxes. that is not financial terrorism. that is a legitimate inducement to get money and jobs out of a high-tax, high-regulation, big-union state like california and bring them to a go-ahead, low-tax, low-regulation
state like texas. it is sour grapes from the left. isn t the whole idea when you re in business like toyota is and we should point out the big three were all in california once upon a time. one of them has gone to tennessee, the other now in texas as well. when you re in business, isn t the idea to make as much money as possible? and if your federal and state bureaucracies are charging you high taxes, figure out a way to payç less. in this case it s move to texas. it s good business. toyota wanted to build a brand-new headquarters. you can t build anything in california. they regulate you to death. there s rules and regulations for everything. what do they do? they listened to governor rick perry of texas, and went to texas where they can build a whopping great big new headquarters building just like that. you know what they re doing is saving the u.s. what concerns me, even though it is allowed, maximize profit if that is your goal for shareholders and make it more desirable for consumers. bow do you think overall weç are chase but do you
think overall we are chasing money out of the country and this is a good story because it keeps money in the country? nobody is higher with taxes than abu dhabi at 55%. we re keeping $2 trillion of money outside of america. it doesn t come back here because of those high taxes. and we re chasing corporations out like pfizer. pfizer is going to be domiciled overseas because of our high taxes here. it s on the big level, a country level which is exactly the same as the state level within the united states. right. and all these energy jobs in texas as well. unemployment rate lower than a lot of others. what can other states learn from governor rick perry? low tax, low regulation pulls in the jobs, pulls in the money. high tax, big unions, you re chasing money out of your state.ç that s what you can learn. fantastic. rick perry wins. stuart varney we re going to watch your show today. yeah, i m fired up.

doing good. then what happened? we got a call from the postmaster general. will and i used to work in washington, d.c. we put on our suits, go to washington, met with the postmaster and its senior team. we go into this intimidating board room and gave a pitch. we said we re just a few guys trying to help build a great technology product that our customers love. we would love to find a way to work together. a few great linesç ensued. the chief digital innovation officer from the post office said no one is going to want it because digital is a fad. that was a doozy but the next one was better. the postmaster said those aren t our customers. he said our customers are a few hundred volume mailers and the product is junk mail on to the tables of america. they feel an allegiance to junk mailers who pay nothing to go into the
postal system. you were astounded by having said that so your goal was to win them over. as ridiculous as those wrepbts comments are, win them over. how did that go? we like to think of ourselves as occasionally persuasive peoplo but when you encounter the forces of bureaucracy, we don t think the people at the postal service are foolish. the reality is they have tons of incumbent interests like the unions and congress that make it hard for them to make good decisions about their business. we tried everything we could. we had lobbyists and attorneys and a public interest campaign. it just seemed to be walls too tall to surmount. the government has two things that startups don t have which is time and money. we operate on a fleeting time frame with very little money. and the postal service, even if we could take five years to convince them, a startup could never operate duringw; that time frame to create a successful company that consumers love. you know what i found
amazing is that the post office is on life support. even the biggest advocates of the post office knows it is borrowing loans in order to keep going, keeping people kphroeud. they should be embracing people like you with ideas like yours. that was our hope honestly. our passion and real calling is to create a great private business that creates a good or service that delights our customers. and we think when more people like us do that, us and dozens of others, that our society and country will really be on a great path. all right. we reached out to the post office, have not heard back. guys, thanks a lot. hopefully you can show stats on how well it was working and make legislators get on your[ @&c @@ side and force the post office into the 21st century. we appreciate it. thanks for having us on. the creators of outbox. straight ahead, no idea,

places have been devastated. we find her in athens, alabama tracking this wild weather. maria, good morning. good morning. you re right, we re in a different state today in a different city but the scene is the same. more widespread destruction. in this area the national weather service confirming a tornado touchdown with winds up to 140 miles per hour. that would make it anç es-3. that is here in athens, alabama, where we have widespread destruction. we have a home behind me, as you can see, the roof blown off, walls are gone. and inside of it, it s unrecognizable, just debris littered inside that home. down the road in a trailer park, a mother and her son were killed by the same storm system. making matters worse, today we have the threat for flash flooding. when we got here to athens, alabama, last night we had heavy rain and there was a warning in effect that has been lifted here but across eastern alabama, southern
alabama and up to southern new england, you have a number of flash flood watches and several advisories in effect as well. this is a very widespread storm system impacting at least 18 states with those flood advisories. across the florida panhandle in pensacola, anywhereç between 5 to 11 inches have been reported. higher amounts have been possible in localized areas across parts of the florida panhandle. cars have been submerged. we have a number of warnings in effect there as well. at least one person dead in the florida panhandle due to that flooding. all of this flooding is on top of another round yet again of tornadoes. yesterday we had eight reported tornadoes in the state of north carolina where flooding was also a big issue there. take a look at this. we had about four and a half feet of water in our driveway. it was ohe hoods of both our cars, probably a good three feet of water in
our house. it turned our freezer over, washer, dryer. 135 tornadoes have been reported in our multiday severe weather event. we do expect more severe weather possible today across the eastern third of the country. stay safe. let s head over to you in new york. maria molina, thank you very much. the key is about the flooding because down along the panhandle i was reading, some spots are going to end up with 25 inches of rain. 24 minutes before the top of the hour. there she is right over there, the retired cougar cheerleader. long ago retired. that was a lot of fun yesterday. from flooding to fishing, listen to this one especially if you like tuna. tuna fish caught off the shoreç of oregon is now known to have elevated levels of radioactive particles in it. it is believed it is from the fukashima disaster. researchers studied 26
specific albacore and found a slight increase in the levels there. they say you would have had to consume thousands of pounds of fish for it to raise any eyebrows. illegals are now eligible for in-state tuition in virginia. virginia s attorney general announcing illegal immigrants who came here as children are now eligible forç cheaper in-state tuition. the students qualify under the dream act which was created by the obama administration. in the state of wisconsin, a federal judge striking down the voter identification law. the judge ruling that the requirement that voters show a state-issued photo i.d. at the polls is an unfair burden on poor and minority voters. there are 31 other states with laws requiring voters to show i.d. at the polls. this is a fun story to tell you about in a way, i guess. twerking landing three women behind bars in the state of oregon. it all started when one went to city hall to pay a fine after she and her

there. then they called me down to the principal s office and wanted to give me suspension. okay. and then you told them that, look, i left it there by accident; right? what else? and i told them it was by accident and i told them like the story that had happened, like that i helped my boyfriend with chores on the farm and iç threw it in my purse that weekend, that last weekend. rick, you go ahead. they only thought i should get a three-day suspension because they knew i was a good kid and never got into trouble. then the school board took a look at it, rick, and decided your daughter should be kicked out of school for the rest of the year. you ve got a problem with this, don t you? i do. to take a good honor student and punish them excessively like this, it does no school for the kid, whether it is my kid or some other kid, it does no for .
it just teaches bad things. you know, the zero-tolerance policies are clearly not working and this is a clear-cut case of that. sure. from the picture we re looking at it looks like the blade might beç two, less than three inches long? right. what s interesting about this and you did talk about this, rick, because you have hired an attorney. you want your daughter to go back to school. she needs to get into a college and you don t want this as a black mark on her record. but tell us about one of the kids of one of the school board members who also took to school something classified as a weapon. there was a student that had a lighter that he actually forgot in a bag inside his locker, which is the same situation that whether his parent is a school board member or not should be no different than
whether or not he violated the school weapon policy or not. he ended up only getting a three-day suspension for that. he got three days for having what was classified as a weapon and your daughter got kicked out for the rest of the year because as it turns out the school board had a little flexibility when it came to the school board member s child. alyssa, how do you feel about going forward knowing that you made a little mistake, you owned up to it, but now they re killing you? yeah. i don t know. i think it s an excessive punishment like it s not just about me now. it s about everyone else who s gotten an excessive punishment too. i don t know, i just want to fight for everyone else too. rick, it does seem commonsense wise, she s been out of school already, said she was sorry. it was a simple mistake. where s the common sense? there clearly isn t any.

they boosted him to white house victory in 2008 and 2012. now disappointment leaves many of them disillusioned. new study shows their level of trust in president obama has slid to 32% over the last four years. that s 12% drop. only 14% of millenials trust congress and 20% trust the federal government. how does president obama and the government lose the millenial generation? let s ask three of them who all already hold public office. alex morse, the mayor of holly oak, massachusetts. and two other guests. good morning. good morning. representative garcia, we ll start with you. you say this talk of hope and change is simply empty rhetoric. why? well, as you pointsed out, trust in government elected officials dropped among my littlials and the thing is, it s one thing to distrust your elected officials, but this
generation and the recent decade, we ve seen that we have reason to expect that our elected officials, particularly our federal officials personified in the president, actively deceiving us, not just distrust. mayor, we ve got a full screen to show. in 2008, the youth vote, president obama had 66%. 2012, 60% of the youth vote. but come time now, they re having a tough time finding jobs out of school, disheartened about obamacare and having to subsidize the he saiderly. how do you think this will affect the mid terms. are they disillusioned by the democratic party? i don t think it s about a party or a person i have really think it s about a process. the same harvard study that was quoted in the national journal article showed that between the first and second term for both president bush and president obama, there were precipitous
drop in perception among millenials. i think what they re reacting to is the fact that the process is not built for progress. in fact, the gridlock is what s turning many of us off. mayor morris, let me ask you, you re an arresteddents obama supporter what about the other issue of student loans that millenials are facing? how is that going to affects midterms? i am a big obama supporter, and we re all about getting things done. i think president obama, when first elected in 2008, immediately came in to republican obstructionism in congress and so i think be it stabilizing student interest rates, that s something important to young people. young people wants to get involved not just in politics, but public service. that same article pointed out the volunteerism rate among young people. issues like health care and immigration and gun control, those things need a vote in

great to be here. we have a bombshell. we have done stories about benghazi but this is really important because despite what the white house told us over the last year or so, it looks like the white house is who misled the country on those talk points. remember siphon rice went out out susan rice said it was because of the internet video. now we know apparently there was a document from the white house, top advisor to the president who made it clear, let s not call this terrorism. let s divert people over to something else. yeah, ben rosen, assistants to the president, deputy national security advisor, he had an e-mail sent out to about a dozen people, including jay carney, but some of the president s closest confidantes, and the subject line said, 4:00 p.m., press call. here were the goals there. one was to underscore that these protests are rooted in an internet video and not a broader
failure or policy and the other one was essentially to reinforce the president and his administration s strength. so the idea was to try to make this look like it was not a failure of the president s policies, but just, of course, this video. so let me get this straight. now you have a direct link between the spinning of the message, the telling of the story and the white house. now this was done because judicial watch sued for it. originally these documents, i understand, were given up, but there were some redacted that makes no sense. but now you have everybody this was cced to. you have in the title saying prep. this is saturday night before the sunday shows. what does this mean? it means their shows are spinning in the message. the c.i.a. said we never said anything about a video. white house, according to sheryl atkissson, she said, can i just get a picture of who was doing anything during the attacks? she can not get a picture from the white house. she s just trying to get a
situation room shot like with the bin laden. out of frustration, what does it mean to the american public? charles krauthammer put it in perspective. we now have the smoking document which is the white house saying we re pushing the video because we don t want to blame it on the failure of our policies, which is what anybody who has looked at this assumed all along. before an election, obama saying al-qaeda is dead, gm is alive. he s running the foreign policy issue on which the whole campaign is based, is one that says he killed bin laden, al-qaeda is on the run. so this undermines the whole narrative, therefore, they have to invents the video. the fact that it was redacted when the documents were asked for and only revealed by a court order is telling you this is a classic cover-up of a cover-up and that is a serious offense.

secretary of state john kerry trying to back pedal after he was caught on tape saying israel risked turning into an apartheid state. the israelis are furious at that. but this isn t the first time kerry has stepped in the diplomatic mud, shall we say. should we be surprised? oklahoma senator jim inhofe is a ranking member of the senate
armed services committee and a member of the senate foreign relations committee, one of the three senators who voted against kerry s confirmation as secretary of state. good morning to you. good morning, steve. what do you think about, first of all, kerry saying this apartheid stuff? he didn t know anybody had a recorder, somebody did. now looks bad. i m not surprised. i m not surprised at all. we made some comments about his lack of, i felt, allegiance at that time to our best friend in the middle east. keep in mind that in israel, the arabs have full citizens rights. they have 10% of them of the kinneset has full rights and to associates that with apartheid is outrageous. but again, i m not surprised. surely. one of the things that was said during the confirmation hearing was that if mr. kerry was selected as secretary of state, we were going to have trouble with israel because our president and then mr. kerry as well, not israel s biggest fans.

there is nothing there. you re looking right there at a document that has been released. judicial watch had to go after it because a copy was sent to the house judiciary committee that was so redacted, so blacked out, you couldn t tell anything. now we know right there, according to those documents, that it looks like when asked who exactly told susan rice to go out on the sunday chat shows and say the benghazi was about the video, now we know after mike morell a couple months ago, who was at the c.i.a., said, we didn t give her that information. now we know the information came from the white house. keep in mind, this was seven weeks before president obama s reelection day. and they were doing everything they could to make sure that he looked like he was in control and that osama bin laden was dead and al-qaeda was on the run. that was the mim. that was the narrative they were trying to push. ben rhodes sent an e-mail to a dozen people, some of the
president s closest confidantes, jay carney was on the list, and in it, it said prep call, 4:00 p.m. for susan rice. and here is what it said. to underscore this is a goal of what the prep calls a underscore these protests are because of a video and not a broader failure or policy. it was to make it seem like it was nothing that the president was doing wrong in the region. it was all because of this internet video. right. think about it. double whammy for the president. he had a military action in libya, would thank would show chaos resulted and show terrorists are acting against and killing americans and he says al-qaeda is on the up and bin laden is done. he also said let s reinforce the president s strength on challenges. this is saturday night, everybody important in the administration is cced on this. senator kelly ayotte, who has been all over it, she said this about what this all means.
we always said r did the video reference come from? now we know it came from the white house. the president is claiming he had been a good foreign policy president, that he had al-qaeda on the run. the other thing in this set of e-mail here that s very troubling is this reference to make sure you mention that al-qaeda has been destroyed. then you saw ambassador rice on every single sunday show saying al-qaeda has been decimated. so that e-mail was from ben rhodes who was the deputy national security advisor and maybe if you re going think, if it s not the white house trying to be political, which is it clearly looks like what, could the white house have been doing? maybe they really believe that it was about the video. keep in mind, though, everybody who was talking to them, the people on the ground in libya, the c.i.a., they were all saying it s terrorism. it was an attack. what is curious, though, is

always remind me of darth vader, that noise. or a sleep apnea machine. right. thank you very much. all right. we know that one of the voter blocs that helped get president obama, the president job were the young people, millenials. harvard has a new poll out that shows that while there was a lot of hope and change back in 2008, a lot of the support that the president had has slid because they just don t like how it s all turned out. millenials who are 18 to 29, harvard did this study, so it s got to be right. so the trust factor was high at 44. now dropped to 32. also congress went from 14 to 4. the supreme court to 4. and the federal government down 2% from 20. james carvelle was on with greta last night and said this is hurting the democratic party hitting them where it hurts rather. i saw that poll, my day started out about as good as
donald sterling s. wasn t too good. that was one way to ask the question. i think asked another way and it was closer. the poll is not good. i m not one of these people that says oh, trashed the poll. the poll was not good on a variety of frontses. if i saw in an abc, washington post, generally a highly respected poll. sometimes they can be a little bit off. i m hoping this is it. i ll wait and see the next one before i get my frustrate razor out. one of the things according to this particular harvard study is the millenials say look, mr. obama promised that he was going to change things. washington is a partisan place. i m gog change all that, he said back in 2008. now fast forward to today, audients do it. and they view him as being part of the system that they promised to change. they re disappointed. it s not just the empty rhetoric. it s them graduating from college and not able to find
jobs. or the jobs they re finding, they re way overqualified for. they re upset over obamacare and subsidizing the older, unhealthy people. they re upset about students loans. it goes on and on of the and earlier in the show i talked to some millenial politicians who are already in office. take a listen. this generation and the recent decade, we ve seen that we actually have reason to expect our elected officials, particularly federal officials personified in the president actively deceiving us. i think what millenials are reacting to is the fact that the process is not built for progress. in fact, the gridlock is what s turning many of us off. we re about getting things done. i think president obama, when first elected in 2008, immediately came into republican obstructionism. okay. either that or the number sticks out is 62% say that elected officials are motivated for selfish reasons.
so a bitterness and a cynicism. plus you got to figure that the millenials, they re disappointed with how it all turned out with obama. he s not running next time. so how will it impact whoever his party s standard bearer is? stay tuned. the one bit of good news i saw in this whole thing, the number one entity that the millenials trust, the u.s. military. the u.s. military above the presidency, above the supreme court, above the federal government. that was down 7% from where it was. the surge was after 9-11. after 9-11, about 60% supported the president. 70% supported the military. and 54% supported the congress. my, how things have slid. the polling is also showing that conservative millenials are more motivated to come out to the polls in the midterm elections and word is now that democrats are concerned about losing the senate and now vetting and processing federal judges to try to leave that for

i am banning mr. sterling for life from any association with the clippers organization or the nba. as for mr. sterling s ownership interest in the
clippers, i will urge the board of governors to exercise its authority to force a sale of the team and will do everything in my power to ensure that that happens. nba commissioner adam silver sealing the fate of donald sterling for his racist remarks. but will he walk away from the clippers without a fight or give a full court press? fox news legal analyst peter johnson, jr. joins me now. good morning. i don t think the fate is sealed. i think there will be a full court press. he s fought before. given his twisted statements that we all know about around the world now, do we assume that there is any sanity or common sense, do we assume he s going to step away and say, okay. no mas. i m done. i ll walk away. that becomes the question. so there is two questions. will he fight the ban and the fine? there is something called arbitrary and capricious in the law. if he says you didn t give me
due process, he could bring a courts proceeding. then number two, if the owners vote to expel him and make him sell the team, can he fight that based on antitrust, based again, arbitrary and capricious, based on the contract with the association itself? so there is a lot of questions in spite of what the commissioner has done. peters, when he bought it back in 1981, it was for something like $12 million. there are estimates it could be $575 million for now. more! more! so is it even really an argument for him to say you re making me lose my livelihood? absolutely. you can make the legal argument and i think there is a better than 50% chance he will. i think in the end, he will profit from his own despicable conduct. he will receive a price for this team that is more than he ever imagined it would be. but will there be a fight? will there be a negotiation? will he threatsen a lawsuit
against the commissioner? will he threaten a lawsuit against the owners? will he say what you did was denude, decrease the value of this team. the real fair market value of the team. in order to do that to get a higher price going forward. lot of people want to buy this. maybe magic johnson. a lot of people across america. but given what he s done in the past, do we expect a fight? yeah, there is a pretty decents chance that we re going to see a fight on this issue. what about the small portion of the people no doubt the comments were tough listening to these tapes. horrible. but he is tried in the court of public opinion. people are saying it s a rush to judgment. what s the argument on that? in terms of statements that we know about, i can t see that there is a rush to judgment. they re despicable, odious, wrong. they re foul, unamerican. it s not what any of us stand for in this country. but at the same time in terms of the property right, that s a totally different question.

others like stuart varney says not so fast. steve? thank you. she had high hopes of motherhood as she set out to adopt a daughter from russia. but soon thereafter, our next guest discovered her daughter, julia, suffered from rad, reactive attachment disorder. it s a condition that affects thousands of orphans all across the globe due to abeen donement and neglect, among other things. that mom now sharing her story of her family and their ups and downs in the new book rescuing julia twice. tina joins us live. good morning to you. good morning. you rescued her twice. the first time was? eight months old, siberian orphanage. got her on valentine s day, middle of the winters in siberia. and she was a beautiful baby. and you rescued her the second time when you realized something is the matters with my child and i got to figure out what it is. that s right. that s right. more importantly was we rescued her from herself. we rescued her from a dark
place, a place where she was incapable of bonding and attaching and feeling the benefit of love. that s referred to as rad. it s a condition that is typically affiliated with children who have been neglected or abused at an early age. it is common among children who have started their lives in orphanages. you picked up your daughter in siberia when she was eight months old. only eight months old. i had not been schooled in this at all. i had not been prepared for this. and it was confusing because she was such a beautiful baby. she s a beautiful young girl now. however, we had been given all sorts of warnings potentially about physical problems, but physically, she thrived. she was strong. she was powerful. she was healthy. she met milestones. so there was this confusing dichotomy between the physical
vancements and what was happening for her emotionally. it was very confusing for a new mother in her 40s in the first child. i m sure you thought i m doing something wrong. that s exactly right. that s exactly the problem. and possibly most of all, why i ve written this book. i was so much in the dark. i was so filled with despair. i was so confused and so convinced that i had made haggai grantsic mistake. in particular, you were moved to right this book after you heard about a family about three, four years ago that had a child with the same problem, sent him back to russia. 2010, tory hanson, a single woman, she literally returned her 7-year-old child on a plane to moscow by himself with a note attached to his sweatshirt saying this child is psychotic and i can t parent him. and while her experience was very different than mine and while the world viewed her as a monster and she didn t make a great decision, i understood what was behind that. i understood how difficult it was to try to parents a child
who won t accept love. sure. how many times with your daughter were you to the points where, i can t take it anymore? something is the matter, either with me or her or us. it never occurred to me to return her. of course. i was deep in despire. i was scared. in those early days, those first couple of years, i would think a we were never going to be a family, that i was never going to truly be this child s mother that when she said mommy, that it would never be authentic. you know what s interesting about your story and you re very brave for telling it, is when you see on tv about these celebrities, they adopt these international children, looks so easy. everything turns out great. angelina jolie makes it look like it s an idyllic situation. you have a little troop of orphans, internationally adopted children and it all melds perfectly. that is not reality. it s great you are making people aware of rad in circumstances. the book is called rescuing

priorities. how can you seriously, with a straight face, tell the parent of a kindergartener, we have to put him in a college prep situation? that s the thing. the thing is when you read the letter that was sent around, which has been acknowledged to be silly, i think by the administration, the wording of it, if you look at some of the statements in it, like college and career ready, that s a real buzz phrase for the common core. every meeting that go to, you will hear college and career ready. harvard ready. rigor, increased rigor. so it s not just silliness, it s like a speaking point for the common core. right. and one of the quotes is it s part of the changing face of education. yes. and i m not sure that that changing face is productive if it takes away creative learning from kids that are five and six years old in kindergarten. and obviously the biggest thing can common core is they teach to the test. here is what the school says. our educators believe that the traditional kindergarten performance requires multiple
days away from classroom work for preparation and execution and together with the lost instructional time due to poor weather is not the best use of the limited time we have with our youngest learners. so too many snow days. we got to put more curriculum and less to the theser. to me, that says then you re devaluing creative forms of education and only valuing seat work as education. last year they held that play, decades and decades they ve held that play. our great educators saw central in it for decades and suddenly now that common core is in place, there is no more value in it? i sense that teachers my informal poll is teachers agree with you. they re not loving this. it s more the administrators that are administrating this. i don t know whether they re administrating it out of their minds or whether this is like a trickle down situation from albany, that we are so tied and we need the state funding so badly, are we in a situation

dan o connor and state senator troy balderson are neck in in this case neck in a district donald trump won by 11 points. a district that has been red since 1939. aside from a two-year blip in the 80s. now it is a district that could easily turn blue. not just women, i think men are as well a little confused what s going on in the republican party and everybody is kind of looking to support the best candidate rather than be more a partisan issue. do you normally vote for republicans or democrats? i tend to be a conservative testimony i wou democrat i would say. was it something about o connor. it is more about sending a message. i mean, the republicans have to wake up. if they are not going to be a

majority in the house, voters in michigan and kansas and washington state are also headed to the polls. is this a consequence of democrats have the momentum and energy? are they drawn to the party s ir resistible messaging or about the republican party, a party with a president who dominates the daily discourse and shames republican morals. a part in the tlauls of an existent shal crisis, the grand oel party or party of trump? the big question we re asking, is another gop election loss enough for the gop to change its strategy? joining me, msnbc capitol hill correspondent dare ron hak in columbus ohio and rick sherman. good to see you out of the capitol, number one. you ve been talking to folks for the past day. what sort of things have you been hearing beyond what we just played a moment ago?
changes in november. how much of this is about the democrats message or is it more about as we suggested in the lead-in the open to this show that this is about a republican party that is in the middle fl an existential crisis, except for the identity of the man in the oval office? it s not about democrats as a national party they are messaging. you see a huge difference obviously from alexandria cortez talking about abolish s i.c.e. and danny o connor, two different candidates. it s not even about the president in some ways because the president is actually above water in this district, 48% in most polls, anywhere between 48 and 51% of voters here like approve of the job the president is doing. i think this is about a massive influx of cash. republicans have spent $4 million in this district, which is an unheard of sum that congressional leadership fund
it s coming. about frank o connor. to represent the 12th congress at district. it s a big day and we worked hard to get here. reporters are we trying to get him to comment on something he said, he don t want someone from franklin county representing us. franklin county is the most populist county in the state. it s responsible for 30% of the votes that are going to get cast and by the way, it s the more democratic, more moderate columbus and it s nearest end suburb. what you saw there is balderson intentionally or not last night saying hey, i m the guy who s going to be the representative for all of the these more rural places, not necessarily the candidate of the city folk if you will. it s one of those things where you sort you said the quiet
the mini me to donald trump. and so i talked to one of consultants yesterday and said doesn t matter how much money you spend anymore. once people decide they are not going to vote because of trump, it s over. i think this very republican district, we re still still a competitive seat but o connor has proven that candidate quality matter and if you re trying to be a reapplicant of trump, you re going to put yourself in a state of vulnerability and if you re a guy like o connor or lam they have communicated in the district and haven t hustled. balderson doesn t seem like he has a lot of hustle. he seems to be dodging the press. not a happy warrior. usually the press gets your message out exactly. how it works typical. do you think if the democrats are not able to take
this seat, this is going to be something of a deflator? certainly not, the fact we re looking at the dead heat in our plus 7 district i think is making everybody on the other side incredibly nervous and empowering those on our site. if it comes anywhere near as close as polling suggests, that s definitely a loss for the gop even if we wind up for balderson. i agree with everything rick said about the particulars of the race but i do think there is something larger happening across the country in terms of progressive enthusiasm and turnout. we have seen democratic turnout rise 84% by what it was in 2014. i think what is happening, democrats realized across the country we have been falling down on voting when it wasn t a presidential the republicans have just been eating our luncheon this. we were vaguely aware of it but we weren t actually doing anything about it. once donald trump got elected and we saw how bad things could
get, i think that changed. so since his election, in every special election that we ve had in 2017 and 2018, we have seen republican performance drop and democratic performance rise as electronomically. this could be more than just a backlash to trump this year. this could be a party realizing what it needs to do to elect the people it wants to be represented by. donald trump has endorsed balderson. he s trying to get him to lift up in the race any other races that are the primaries happening today, he s endorsed people like chris kobach running in kentucky. kansas. kansas, excuse me. k state. in kansas and so far the people that he s endorsed have tended to be the more controversial choice. and endorsing somebody like chris kobach leading the charge on the voter fraud investigation when there s no real no such thing as voter fraud the way he was describing it. right. how does that help the
republican party? he wants anyone who is running to owe him. trump looks at himself as a medieval lord and these guys are his vessels, he s going to say i put you in here and selected you. you re not part of anything else. you re part of me. you know, set aside that s completely departure from our constitutional principles and history, but defined by trump at all points if kobach gets the nomination and has a rage tweet on toilet, kansas is a horrible hell hole and i hate them, chris kobach is screwed. he s not mindful of political party leader. it s all impulse and all what s there in the moment and all whatever comes out of his itchy twitter finger any given second. you wrote a book and the fate
that has befallen them, mike flynn, et cetera, et cetera, paul manafort, rick gates. this is not quite the narrative of your book. if donald trump is putting his blessing on these candidates that are not going on to win and say the republicans don t win in a special election, do you think that s going to be a turning point for the republican party to start to change their strategy? i don t think this special will change the strategy. these guys are way locked in and the ones that secretly don t love trump, they are terrified of him tweeting or getting angry at them. the ones who do love trump, they ll ride in pony until it falls over dead. if there s a significant democratic sweep in november, there will be a lot of folks who make get to an understanding that the endorsement in the primary was great and incredibly helpful and desisive but in the
general it s poison. i think we may be getting there and seeing democrats when they get activated by trump will crawl over broken glass to vote against his people. i think we re we ll see the test case tonight. it s still a very republican district though. in terms of enthusiasm, where are you looking most for democratic enthusiasm? is it women? black women specifically? i mean, honestly black women are the people we count on to pull us over the finish liner election. i have no doubt they ll turn out in massive numbers this year because they were part of the constituency that didn t need trump getting elected to get the memo they have to turn out even when the president is not on the line. i m looking at college educated white women who have been a reliable voting bloc since time in memorial and seem to be softening probably because the president is a huge mass saj in any event. they seem to be not as into that as they were when the republican vanguard was a mitt romney. i m interested to see do we start to get them? do they start to come over to
the democratic side? if that happens, then republicans and trump are really left with white men. and specific segments of white men. the base is getting smaller and smaller for them. if they lose white college educated women, it s hard to get a majority in this country anymore. i want to read one portion from rick s book, everything we never warned you, massive downstream election losses is coming and alienating african-americans and hispanics beyond redemption, check. raising young voters fleeing the gop in droves. check. juvenile complaints and ego bruises taking center stage while the world burns. check. blistering pig ignorance about the economy and world. check, shredding the last credibility is a party that cares about debt, deficits and fiscal probity.

manafort is back on the stand. rick gates continues his testimony today. asked yesterday why are nooath whether he committed any crimes with mr. manafort, gates answered yes and also admitted to embezzles hundreding of thousands from his boss carefully avoiding the flinting stares his mentor from the nearby defense table according to ken dellanian. manafort s lawyers seemed eager to get to cross-examination where they will make every effort to paint gates as a cowardly schemer lying to save his own skin. if the day goes as planned, the defense should get that chance today. joining me from outside the courthouse in alexandria, nbc news intelligence reporter kendelanian and seth waxman,
partner at did inson wright. you said it s like a soap opera in there today. walk us through what s happening. well, katy, you explained some of the drama, of course, mr. gates long time pro to jay of paul manafort walking in to testify against his mentor. manafort stare beiing bullets a. today we moved into a different mode where gates is getting into the nitty-gritty and it s been very powerful testimony from gates because it doesn t just rely on his word. the prosecution is very cleverly using documents and e-mails, often with mr. manafort s own words to show participation in this tax fraud and bank fraud. first they showed that manafort and gates together knew about foreign bank accounts that weren t reported on manafort s tax returns and concerted effort to hide income by showing it as loans and most recently i
stepped out of the courtroom where they were talking about 2016 when the business had collapsed and they had no clients and trying to lie and prop up income to get loans from a bank. gates testified that manafort directed him to essentially help fake documents. there was one case manafort wanted a pdf converted into microsoft word to change inflate his income. very powerful testimony. the defense does want to cross-examination gates and that s going to happen today but it s hard it s going to be hard to overcome these documents in black and white with paul n manafort. there was one change a document the jury was shown where manafort had shown his 2014 income tax projection. and he says, i just wtf and manafort, being blindsided like this.
this is a as ken just said, financially strapped. they talked about how the man, ukrainian president lost power, significantly decreased and difficulty paying his bills according to gates testimony. why is it so important to show that he was having problems paying his bills in this trial, seth? well, i mean, that s just another mode i think there are two big things we re hearing out of the courthouse, the one you re bringing up now. this case says prosecutors who put this on and often times say it s about greed, he wanted more and more money and that s why he didn t pay taxes. now we re hearing he was in financial zdistress this gives another mode. when jurors hear this, not only do they have the more common, the greed aspect of a case like this but now they see the unnerving need that he had and
that could be telling and very persuasive to a jury. seth, you tell me if i m skipping ahead here. could this be laying groundwork for how this ties into the russia probe and broader question of conspiracy, collusion and coordination. manafort needed money. is this mueller s trying to paint this portrait of get into the public record of manafort as a man desperate which is why it s a weird an open question and weird it s just weird that manafort went to work for donald trump under all of these financial issues and wasn t getting paid. well, i think the main purpose of this trial from the overarching mueller investigation is to get paul nan manafort to flip. this background, as a former federal prosecutor, did it for 13 years, conspiracies don t just fall out of the sky in the middle of march of 2016 or june of 2016. there s a history there are
relationships and business relationships and there are reasons why the russians felt reaching out to paul manafort and these facts, the decade or so of interactions and business transactions with russian backed yugoslavians or others, can be how the formation of a conspiracy comes together and prosecutors use that in the wider case to build the record and show jurors how this all came to be. it wasn t something that just dropped out of the sky in 2016. one other point i want to make, there seems to be some drama with judge ellis and the prosecution, at one point the judge looked at greg andress, a member of the prosecutorial team, i understand how frustrated you are and in fact there s tears in your eyes right now. and saying he wasn t crying and the judge looks back at him and says, well
we have not seen any of that behavior from judge ellis today. i wonder if it had to do with the media coverage of this tension from yesterday. up until today, there had been a lot of grumbling from people close to the prosecution that ellis wasn t being fair. he was really holding their feet to the fire trying to get them to rush through their case they felt, not letting him allow evidence. today we haven t heard a peep. i want to let you know i ve been told that the prosecution has finished their questioning of gates and cross-examination will be happening this afternoon. also, a reference to donald trump, not being mentioned at the trial. there was a note in a manafort document that talked about season tickets to the yankees and this is from 2013 and the note said going to trump next week. that wasn t mentioned and put up on the screen. we all read it. wanted to let people know that happened. no doubt judge elis will be happy that the trial is moving on that the defense will get a chance to cross-examination

this is just another d distraction when again after two years of you know, nonstop investigation, with everyone in the media, everyone in the fbi, everyone in this whoever the whole world is looking at this and yet to produce anything that even remotely resembles what they ve been talking about. and yet every other day, oh, my god, we ve got it now. nouz the we got the needle in the haystack, i ve been hearing this for two years. the president s son says all of the talk about the trump tower meeting is just a distraction. over the weekend the president publicly confirmed that the purpose of the meeting was to get information on an opponent. trump insisted though it was totally legal and done all the time in politics. but is it? a piece in the new york times explores potential legal pitfalls for don jr. joining me now, the author of that piece and new york times
washington correspondent charlie savidge, known as nbc contributor and white house reporter jonathan la mere, also an msnbc political analyst. charlie, you talk about a lot of potentialities and ways don jr. could run afoul of the law. depending on how the grand jury interprets the facts for the special count, robert s. mueller iii gathered about the two trump towers meeting it could find the foreigners elected the federal complain election act and don jr. conspired in that offense. what do you think he s most at risk for, charlie? well, there s a variety of different laws that ban foreign assistance to campaigns. not just the provision of that assistance but even promises to provide such assistance or requests to provide such assistance even if it never actually materialized. some of those laws under the federal election campaign act have never actually been used to
prosecute someone. so the one that i think is most interesting is a related one called conspiracy to defraud the united states which means to prevent the government from carrying out one of its legally assigned duties and we ve already seen this surface in the mueller investigation when special counsel mueller obtained the grand jury indictment of 12 russians and three russian organizations in february for the covert campaign to manipulate american social media, to help the trump campaign in 2016, the first charge he brought against them was conspiracy to defraud the united states specifically to prevent the federal election commission from carrying out his duty to keep americans informed about money and campaigns and who is supporting what candidates and prevent foreign assistance to domestic political campaigns. since that charge has already surfaced in this very context, i think if i were on donald trump
jr. s legal team, that s the one i would be most concerned about. as well as a related charge potentially of lying to congress when he told the senate judiciary committee last september that he was unaware of any other foreign government offering to help the trump campaign when we know he was talking to people representing saudi arabia and united arab emirates and their desires to help the trump campaign. i do also believe that conspiracy to defraud the united states was one of the superse superseding indictments for paul manafort as well. it could have come up twice. the president and don jr. have said this is all political opposition research. john, that s their defense, everybody does this. this is nothing new. also, nothing came of it. right. they are shifting the definition of what collusion is. we keep hearing president say over and over again no
collusion. that s not actually the crime. there s conspiracy and all of the others you just listed there. what we re seeing here is that a pretty concerted effort to change the talking point from the president himself to his allies and rudy giuliani, et cetera, where they are saying, look, maybe there was this meeting but nothing came of it. no information was delivered and therefore nothing was really wrong or illegal. and that of course is sort of treacherous legal ground. this is a concern for this white house and people close to the president. we have heard now for over a week that the president despite his public denial on twitter the other day is brooding over this, stewing over the possibility that his son could be in real legal jeopardy, even if he didn t know he was breaking the law, he still may have. watching manafort trial, which is like on cable all the time and it s from a visible reminder of robert mueller. even though it isn t about russia, it s connected to mueller and trump has told people around him he feels like the next person he sees go on trial might be his son.
there s great concern there and we ve seen that manifest itself in these very tweets from the president in recent days. the president will often quote people on fox to develop his own arguments and repeat what they say. andrew nepal tan no is often one of those people but just today he was not one of those who were parrotting the president s line on the trump tower meeting. listen to this. if there was an agreement to receive dirt on hillary from the russians even if the dirt never came, if those who agreed, at least one of them took some step in furtherance of the agreement, there is a potential crime for conspiracy. but it doesn t appear that the president was among them. charlie, do federal prosecutors and from your understanding of this piece you just wrote, does he have does he have a point? what andrew nepal tan no was describing was the classic crime
of conspiracy, when two or more people agree to commit some other crime and take minor step toward that, that that point they already committed the crime of conspiracy, even if they never fulfill their plan to carry out some other crime, like you and i agree to rob a bank and look at the bank to look at the security around it and never rob the bank, we ve we re already guilty of that crime of conspiracy. that s what andrew is getting at when he was saying that it doesn t matter if no information was received because the crime of conspiracy at that point would already have been completed. or if you break into the bank and there s month money there, that could be something along those lines as well. and i would point to don jr. and that e-mail exchange with rob goldstone where he says that a woman from the russian government has dirt on hillary clinton. don jr. s response in black and white in writing, was if it s what you say it is, i love it. jonathan lemir, charlie savage,

was denied that right. he thought that this would be a smooth thing. told me i thought everything in the country was fair and square, unlike where i come from in haiti. i thought since i have the green card i ve been a model citizen, naturalization would be no problem. instead he was denied that because he had entered the country with a fake passport in 1989. despite the fact that had been waived. dhs is going back and readds jut indicating some of the decisions made under prior administrations. he could also be deported and not get his citizenship status because his daughter is disabled and as we reported in this story, there is a forthcoming policy change from the white house that would label anyone, any immigrant who has been using public assistance, even those here legally like louis charlgs fr charles from getting citizenship sore advancing status in any way. they are including obamacare in that, is that questionable because is obamacare considered
public assistance? it s federally mandated that you have that insurance. it s true. this is for people who are using the health marketplace exchange. and it does seem like a stretch but this law is very broad. this is a law from the 1800s that said the united states shouldn t have to take any immigrants who are likely to become a public charge. so really they are able to redefine that in a lot of ways. previously immigrants who are on cash assistance like social security, they did have a hard time becoming citizens. so that is not changing and already been the case. now they are expanding it to a place where even people who are using the marketplace through the obamacare exchanges, that would now be looked at like a social safety net. 20 million legal immigrants at risk. that s right. great exclusive reporting. come on with any new details you get. will do. thanks, katy. president trump has been pretty consistent about his

nationalism, extremism, all of that stuff. why does it behoove a social media company or what are the pitfalls for a social media company to decide to draw the line? sure. i mean, this is clearly an issue that facebook and apple and youtube have dealt with for a long time. and, you know, eventually, once apple made its move on monday, facebook and youtube decided to follow suit. they have been previously very reluctant to take action against alex jones and info wars. on one hand, i think these platforms are very reluctant to seem like they re biased against people on the right, or conservatives, even someone like alex jones. on the other hand, you have someone who s using these platforms to promote harassment and harassment campaigns against families, as sandy hook victims, naming the wrong shooter in parkland. stuff like that. and so then, it becomes an issue for the platforms, less about politics, and about harassment, hate speech, and potentially the promotion of violence. david was arguing that what they should have done is just
not use hate speech, as a reason to ban alex jones, david french, the conservative columnist, but rather, that he was afoul of the law, more specifically. he wanted to argue he thought that they should argue that he is being charged with libel as opposed to something as wiggly as hate speech, which can be defined in all sorts of way. libel and slander are more serious, for sure. and they re more so legal definition. yeah, you can put your finger on it. there s a twitter account that i m sure that you treasure that came to prominence in the 2016 campaign called the sweet meat your of death, where the whole concept was like, you know, this election is so terrible, there will be the sweet release of the media coming down and blowing us all up. it was banned for 12 hours today, because the new twitter rules are like, i don t know, you re propagating, you know, hate speech and violence against people for the sweet meteor of death. so you know hate speech, what is it? it doesn t really have a firm legal definition. it kind of doesn t even really exist in our legal community right now.
i think what you see, and of course, all of these social media platforms have the right legal right to absolutely ban the loathsome toad that is alex jones, there s no question about that. the question for me more is, what is our culture of free speech right now? we have great constitutional protections for free speech, but if the culture for free speech is sick, which i think it is right now, i just think it is, then constitutionally, 10 years, 20 years down the road, we might be in a rough place. hold on, facebook, youtube, spoti spotify, et cetera, are not the government. they re private companies. democratic senator chris murphy tweeted as much. and don jr. took his tweet and accused him of a censorship campaign. it s really all about purging conservative media. and i want to push back on that a little bit. this idea that it s conservative media. this effort to lump alex jones in, with conservative media. alex jones is not a conservative. alex jones is a liar. alex jones is a conspiracy
spreader. he s not someone saying that i believe that the tax policy that president obama put in place wasn t a good policy. it s not somebody saying, i want smaller government. right, but when you have these platforms now going off and being hypersensitive, under political pressure, social pressure, journalistic pressure to go after the bad guys, they are going to make some mistakes. and scott horton, a good journalist and anti-war guy, he was banned for twitter from a day, i think it was, recently, as part of this kind of net. i think that s the broader point that people are making. and i think the thing that we should all think about is, are we going on twitter and spending our time trying to de-platform somebody from one of these things? trying to get them un-hired from the new york times or msnbc or anywhere else like that? that s not a healthy culture. but msnbc can fire me any day. it s a private company. they re under no obligation to keep me employed. i totally agree with that. and it s my platform, i might very well kick off alex jones. but it s the rest of us that i m kind of more worried about right now than facebook and the rest of them. are we going first to the ban
