WASHINGTON, April 26, 2021 /PRNewswire/ Americans for Prosperity Foundation, backed by nearly 300 groups across the political spectrum, urged the U.S. Supreme Court today to uphold people s First Amendment privacy rights. The question before the Justices in
Americans For Prosperity Foundation vs. Rodriquez is whether a state s blanket demand for a list of an organization s supporters supersedes those people s rights to freely join with each other, protect their privacy, and amplify their voices through groups that represent their beliefs.
Americans shouldn t have to choose between staying safe or speaking up, said AFPF CEO Emily Seidel. History shows us the right to maintain privacy makes it possible for people to join together on causes and in movements. That was the case for abolishing slavery, the Civil Rights movement, marriage equality, and is still the case today. Especially in a polarized climate, the work of ....

EFF to Supreme Court: States Face High Burden to Justify Forcing Groups to Turn Over Donor Names

Throughout our nation’s history most potently since the era of civil rights activism those participating in social movements challenging the status quo have enjoyed First Amendment protections to freely associate with others in advocating for causes they believe in. This right is directly tied to our ability to maintain privacy over what organizations we choose to join or support financially. Forcing organizations to hand membership or donor lists to the state threatens First Amendment activities and suppresses dissent, as those named, facing harassment or worse, have to decide between staying safe or speaking out.
In a California case over donor disclosures, we’ve urged the Supreme Court to apply this important principle to ensure that the bar for public officials seeking information about people’s political and civic activities is sufficiently high. In an amicus brief filed last week, EFF, along with four other free speech advocacy groups, asked the court to compel the ....

Chinese dissidents are urging the Supreme Court to strike down a California law aimed at cracking down on nonprofits and dark money groups, saying disclosure requirements could endanger the lives of anti-regime activists.
California law requires donors to disclose their identities to the California attorney general s office, but a wide coalition of different interest groups are arguing the requirement compromises donor anonymity that is vital to their missions. Citizen Power Initiatives for China publicly backed the suit, asking the justices in an amicus brief to protect the privacy of anonymous donors. The group, which promotes the peaceful transition to democracy in ....
