Criminal defence lawyers sound alarm over Ford government's new justice of the peace appointees

Last week, the province announced 41 new justices of the peace would be appointed to the Ontario Court of Justice, effective July 8, following changes to the Justice of the Peace Act early in the pandemic. TORONTO, April 15, 2021 (GLOBE NEWSWIRE) As MPPs vote on the third reading of Bill 254 today, the Ontario Federation of Labour and Democracy Watch are calling on Ontario Attorney General Doug Downey to release the government lawyer’s evaluation about whether the Ford government’s
Charter rights.
“Ford’s Conservative government has made numerous attempts at unconstitutional changes to Ontario’s laws that the courts have rejected,” said Patty Coates, Ontario Federation of Labour President. “The public has a right to know whether the government’s own lawyers think Bill 254 violates Charter rights.”

National | Reform but no follow-through

When the Trudeau government tabled a package of reforms designed to fight delays in the justice system in 2018, there were mixed reactions to many of the proposals. Critics, in particular, feared Ottawa was tinkering around the edges, not tackling the real causes.

But one thing that seemed to inspire support was the creation of judicial referral hearings for bail violations.

Per the government, the new measures, which came into effect in September 2019, would streamline certain administration of justice offences out of the traditional court system where no harm has been caused to victims.

These hearings would prevent re-incarceration over minor violations of release conditions, and prevent further administration of justice charges being laid, which eat up significantly more court resources. ....

New justices appointed in Thunder Bay

THUNDER BAY Two new judges have been appointed to the Ontario Court of Justice, to begin serving in Thunder Bay effective March 4.
In a news release issued Feb.19, Ontario Attorney General Doug Downey announced the appointment of Justice Claudia Cynthia Belda Perez and Justice Vince Scaramuzza.
Belda Perez was called to the bar in 2004 and soon after began working at Nishnawbe Aski Legal Service Corporation where she led the Ontario Telejustice Project, an initiative to increase access to justice in remote Nishnawbe Aski Nation communities.
She has also worked at several private practice law firms and has a decade of experience in child protection, family law, alternative dispute resolution and as duty counsel in family and criminal courts throughout northern Ontario, the release said. ....
