Overview of Recent Nationwide Permit Program Changes
On March 28, 2017, former President Donald Trump issued Executive Order 13783, “Promoting Energy Independence and Economic Growth.” The Executive Order directed the U.S. Army Corps of Engineers (“Corps”) to immediately review existing regulations that “potentially burden the development or use of domestically produced energy resources” such as Nationwide Permits (“NWP”). NWPs are general permits issued for categories of activities that have minimal individual and cumulative adverse environmental effects on the environment. The issuance and reissuance of NWPs normally occurs every five years. Most of the current NWPs are set to expire on March 18, 2022. However, in September of 2020, the Corps proposed to revise and reissue 12 NWPs, and create four new NWPs. The final rule, published on January 13, 2021, created and revised the 16 NWPs through the following actions:

Group files appeal of Devola sewer decision | News, Sports, Jobs


¯ Permit to install was granted March 10.
¯ Ruling has not been made on motion to intervene in court order.
¯ Sewer project will affect some 560 homes in Devola.

A notice of appeal was filed Wednesday with the Environmental Review Appeals Commission in answer to the permit to install granted for the Devola Sewer Project.
Greg DeGulis, attorney for the group Devola Against Sewering Homes, said it is an administrative appeal of the director’s decision to grant the permit to install the sewer in Devola.
DASH is made of opponents of the Devola Sewer Project, which will affect about 560 households using either drywell disposal systems or septic tanks for wastewater.

COLUMBUS — A political dark money group that authorities say was used as part of a $60 million bribery scheme to pass nuclear bailout legislation in Ohio pleaded guilty to a federal racketeering charge on Friday.
Generation Now Inc. also agreed in federal court in Cincinnati to forfeit $1.5 million from two bank accounts.
Jeffrey Longstreth, a co-defendant in the case who previously pleaded guilty to racketeering for his involvement in the scheme, represented Generation Now during Friday’s hearing.
U.S. District Judge Timothy Black delayed a pre-sentence investigation and sentencing until after cases for all of the defendants are resolved.

COLUMBUS, Ohio — Former state appeals court judge Dennis Deters has been appointed to a full term on the Public Utilities Commission of Ohio, fellow Republican Gov. Mike DeWine announced Friday.
Deters, who was first appointed to the PUCO by DeWine in 2019, was recommended for a full five-year term by a nominating committee last month.
A Hamilton County attorney, Deters was appointed by then-Gov. John Kasich to the state First District Court of Appeals in 2017, but he lost re-election the following year. He’s the brother of Hamilton County Prosecutor and ex-state Treasurer Joe Deters.
