Supreme Court gives Guam go-ahead to sue Navy over toxic dump

A unanimous Supreme Court decision Monday allows Guam to pursue its lawsuit seeking to force the Navy to contribute toward the roughly $160 million needed to clean up the toxic Ordot Dump on the island territory.
The decision, written by Justice Clarence Thomas, overturned an appellate ruling that Guam was barred from suing because of a statutory time limit. The case goes back to a lower court where the island will continue litigating the case.
“We are thrilled with the Court’s decision in favor of Guam today, which paves the way for the United States to pay its fair share for the cleanup of the Ordot Dump,” the attorney representing Guam, Gregory Garre, said in a statement Monday to The Associated Press. ....

The Ordot dump was recognized as hazardous in the 1980s, but took decades to close. Here are some of the key events related to the dump:
-Prior to 1950: The starting date of the dumpsite is unknown, but there is evidence that the site was used by the Japanese as a disposal area during World War II. The U.S. Navy continued using the site as a dump after the liberation of Guam.
-1950: Ownership of the site is transferred to the government of Guam.
-September 1983: The Ordot dump is placed on the National Priorities List of hazardous waste sites in the United States eligible for long-term cleanup financed under the federal Superfund program. ....

The government of Guam is gathering evidence, and could track down eyewitnesses, to prove the military dumped hazardous waste in the Ordot dump, said Guam Attorney General Leevin Camacho, following the island’s victory Monday in the U.S. Supreme Court.
Justices on Monday issued an opinion, stating GovGuam can seek dump-related compensation from the Navy under the federal Superfund Act. Guam learned about the court’s opinion early Tuesday local time.
GovGuam sued the Navy in 2017, seeking fair and equitable compensation from the Navy as a “potentially responsible party” for the dump, which opened before World War II, while the island still was under a naval government. The military continued to use the dump for decades, even after it was turned over to the civilian government, the lawsuit states. ....
