Court incinerates Trump's Affordable Clean Energy rule in pre-inaugural gift to Biden


“Because promulgation of the ACE Rule and its embedded repeal of the Clean Power Plan rested critically on a mistaken reading of the Clean Air Act, we vacate the ACE Rule and remand to the Agency,” said the 185-page decision.
EPA spokeswoman Molly Block said the agency would review the decision and “explore all available litigation options,” while New York Attorney General Letitia James applauded the ruling against the so-called dirty power rule.
“This ruling affirms what we’ve said all along the ‘Affordable Clean Energy’ rule did nothing to promote clean energy, and was not affordable for American consumers,” Ms. James said in a statement. “Instead, this ‘Dirty Power’ rule served to support dirty and expensive coal power plants, undercut clean and sustainable electricity, and left New Yorkers and all other Americans to foot the bill.” ....

WASHINGTON - The Supreme Court on Tuesday night began to clear the way for the execution of Lisa Montgomery, who is scheduled to die by lethal injection - the first woman to face the federal death penalty in nearly seven decades.
The court granted a request from the Justice Department to vacate a divided federal appeals court that would have delayed her execution until after President Donald Trump leaves office next week.
The court s three liberals - Justices Stephen Breyer, Sonia Sotomayor and Elena Kagan - dissented. ....

DC Circuit Revives Bid by Democrats to Get Trump Hotel Lease Records

WASHINGTON (CN) A federal appeals court has sided with more than a dozen members of Congress in their attempt to get their hands on details about the Trump Organization’s lease on the luxury hotel located in the capital’s historic Old Post Office building.
In an opinion released Tuesday morning, the D.C. Circuit held that the lawmakers have standing to pursue their case against the head of the General Services Administration.
In a complaint filed in Washington federal court in 2017, Democrats on the House Oversight Committee claimed President Trump has refused to divest his ownership interest in his namesake Washington hotel “even though the lease explicitly prohibits any ‘elected official of the government of the United States’ from taking or sharing in any benefit that ‘may arise’ from the lease.” ....

A divided federal appeals court has upheld the power of legislators in the House minority to demand records from the executive branch.
Acting in a dispute over records related to President Donald Trump’s luxury Trump International Hotel, the D.C. Circuit Court of Appeals ruled on Tuesday, 2-1, that lawmakers can resort to the courts to enforce an obscure statute known as the seven-member rule. ....

The Department of Justice reportedly appealed a federal judge s order that stopped the Commerce Department from imposing restrictions on Chinese social media app TikTok.
The government was filing an appeal in the U.S. Court of Appeals for the District of Columbia, according to
Reuters.
After declaring TikTok a threat to national security from the Chinese Communist Party, the Trump administration attempted to clamp down on the short video-sharing platform. TikTok was the most-downloaded app in the world in 2020 and had the second-highest consumer spending and the eighth-most active monthly users of any mobile app, according to data from App Annie. ....
