Journalism, law, and freedom of the press

“As much as I loved my work as a journalist, law school was always in the back of my mind,” says Jacobs. “In all my positions, I kept encountering legal problems and questions that caught my attention and made me want to learn more from due process concerns with campus sexual misconduct cases to the implications of major breaking Supreme Court decisions to war powers’ worries about international conflicts.”
The protests surrounding the murder of George Floyd last summer inspired Jacob’s Comment in the Journal. “It became clear early on in the coverage of the George Floyd protests last summer that the press was being targeted by police. … I think there’s a really interesting phenomenon happening with what one judge has termed the “Floyd Caselaw” cases coming out of last summer’s protests where courts seem to acknowledge that law enforcement can and should be treating members of the press differently when they’re doing their job and covering protests ....

Unequal jury representation and its consequences | VOX, CEPR Policy Portal

Shamena Anwar, Patrick Bayer, Randi Hjalmarsson
There is growing concern and anecdotal and academic evidence that racial minorities in the US are overrepresented amongst criminal defendants and unequally treated throughout the criminal justice system, ranging from interactions with the police (Facchini et al. 2020) to death sentences (La Ferrara and Alesina 2011).
Moreover, this unequal representation is asymmetric, as minorities are underrepresented amongst the decision makers such as police, prosecutors, jurors, and judges. Though much of this concern is focused on race, this could be a symptom of a more general form of unequal community representation.
This begs the question: what are the consequences (and potential policy remedies) of unequal representation of neighbourhoods? This column discusses this question in the context of one agent in the justice system that is explicitly meant to be representative of the community – the jury. ....

Saving America and Election Integrity: Part 2

Saving America and Election Integrity: Part 2
This is the second essay in a five-part series. Read part 1 here.
Rep. Bennie Thompson (D-Miss.) chairs the House Homeland Security Committee. He disagreed with Senators Ted Cruz (R-Texas) and Josh Hawley (R-Mo.) when they asked for an investigation to ensure that certified slates of presidential electors were, in fact, those chosen by the people. So Thompson wants the government to punish them.
He suggests Cruz and Hawley be placed on the U.S. Department of Homeland Security’s “no fly” list. Ground them!
Thompson’s suggestion is akin to that of an intolerant bully. But it also showed that he’s ignorant of the fundamentals of his job. His remark, like many others issued by federal officials, should tell us this: Stop relying so much on the federal government and start telling state lawmakers to resume their constitutional duties. ....
