Affected by the second wave of Covid-19 and fall in demand for air travel, a section Indian airline companies have demanded financial assistance from the Ministry of Civil Aviation. According to sources, the representatives of the airlines met the Aviation Secretary, and also requested that a a tab be kept on predatory pricing of airfares among other things.

In a release, Komisi Pengawas Persaingan Usaha (KPPU) – the Indonesian Competition Authority, published its first Article 20 (Predatory Pricing) decision. The KPPU Decision No. 03/KPPU-L/2020 was issued on a virtual hearing on 15 January 2021, whereby KPPU found that PT Conch South Kalimantan Cement (CSKC), subsidiary of Anhui Conch Cement Co. Ltd., to have violated Article 20 of the Law No. 5 of 1999 on the prohibition of monopolistic and unfair business practices (the Indonesian Competition Law). Rights holders have traditionally turned to court litigation to protect IP rights such as patents, copyrights, trademarks and trade secrets – or to enforce IP licensing agreements. This brings certain challenges, such as a public forum, unfamiliar laws and procedures, judges with varying IP law expertise, concern for national interests, and the risk that a judgment cannot be enforced in other jurisdictions. Arbitration offers an alternative mechanism and has a number of advantages, including confidentiality, a neutral forum or a single forum, the ability to select arbitrators with technical expertise, symmetrical risk for licensors, and cross-border enforceability of arbitral awards. This chapter considers the viability and desirability of arbitration as a means of resolving cross-border IP and IP-related disputes with a focus on Asia.
