On March 20, 2020, the U.S. Department of Homeland Security (DHS) and U.S. Immigration and Customs Enforcement (ICE) announced their intent to relax the requirements for performing in-person verification of documents presented for Form I-9, Employment Eligibility Verification, given the challenges employers faced during the COVID-19 pandemic. Since then, ICE has extended this policy multiple times, with the current end date set for March 31, 2021. While the federal agency may extend the policy beyond March 31, 2021, employers may want to check whether the flexible rules continue to apply to their worksites and to implement compliance steps when in-person onboarding and verification resumes. In addition, certain temporary ICE accommodations for I-9 compliance have expired. Throughout the pandemic, DHS has announced extensions of the modified I-9 verification policy just a few days prior to the then-current policy’s expiration date.

: The Office of Information and Regulatory Affairs within the Office of Management and Budget announced that the long-pending rule to rescind work authorization for certain H-4 holders has been withdrawn. The withdrawal means that H-4 holders whose spouses have reached certain steps within the employment-based green card process can continue to file for Employment Authorization Documents (EADs).
After a multiple-year undertaking to rescind work authorization for certain H-4 spouses, the United States Citizenship & Immigration Services (USCIS) confirmed on January 25, 2021 that it has officially withdrawn the proposed rule that sought to rescind this class of work authorization. The regulation promulgated in 2015 allows an H-4 holder to file for a work permit (EAD) if the H-1B spouse is the beneficiary of an approved I-140 petition and cannot adjust status due to per-country limitations or if the H-1B spouse has been granted a post-sixth year H-1B extension of status under sections 106(a) and (b) of the American Competitiveness in the 21st Century Act of 2000.

A Texas judge may strike down President Barack Obama’s 2012 DACA amnesty for roughly 700,000 illegal migrants — and undermine other giveaway programs that allow U.S. employers to keep foreign workers in jobs needed by Americans.
In a December 22 hearing, the pro-migration supporters of Obama’s Deferred Action for Childhood Arrivals (DACA) amnesty asked District Judge Andrew Hanen to preserve the award of work permits, regardless of the economic impact on non-college Americans.
Hanen called the hearing after Texas, and other states filed a lawsuit to have the DACA amnesty declared illegal.
