years. still a lot of additional spending. >> reporter: but the deadline and its consequences may not be set in stone yet. already, some lawmakers are writing legislation to avoid some of the automatic cuts. and at this point, wall street didn't like what it saw out of washington. all of this uncertaintiy that had is creating. last summer, you remember, one investment house reducing the aaa bond rating following the debt ceiling crisis and there are fresh concerns that the u.s. can face additional downgrades following this failure today, shawn. >> what is next? what happens now? >> congress doesn't like to deal with deadlines and they adept at moving and we're hearing more that already, there are pieces of legislation tonight being drafted up to push off some of the defense cuts. it's going to be hard to see right now if they can't agree on this savings they locked in in august, whether or not the republicans and chems with all of the bad blood and blame will be able to come together and push some spending cuts down the road. >> thank you, tom fitzgerald. that is frustrating for all of the american people to hear. you heard tom mention that wall street did not like what happened today. you saw it on the big board today. we saw that big selloffs on wall street. the result of that failure of the congressional supercommittee to reach a deal to cut the federal deficit. the dow closed down 249 points, ending the day at 11,547. another big story, the man charged with trying to assassinate president obama is ordered held without bond. oscar ortega hernandez appeared in federal court hours ago and is accused of firing an assault rifle on the white house on the evening of november leth. one of the nine rounds fired cracked a window of the first family's living quarters. maureen umeh has the latest for us. maureen? >> reporter: the accused white house shooter was in the courthouse today. the judge ordered he undergo a psychological evaluation before the next preliminary hearing. after ramiro ortega hernandez was escorted into federal court monday handcuffs, his hair and beer were long, looking like the modern day jesus christ he claims to be. he spoke three times during the 15-minute proceedings. once when he was sworn in and then to state his full name and a third time when the judge questioned if he had enough money to hire his own attorney. he answered at the moment i do not. the 21-year-old is charred with trying to assassinate the president the night of november refth. the prosecutors say he drove by the white house and that he fired nine shots from the car. one cracked a window at the first family's living quarters. inside his car, police found a romanian semi automatic assault rifle with a large scope mounted on top and with three loaded magazines, several boxes of ammunition and nine shell casings and brass knuckles. in court, he was appointed the public defender and ordered held without bond. and at the prosecution's request, the judge ordered a psychological evaluation of about the next court hearing on monday and he is from idaho falls, idaho. there is some question about his state of mind. >> were assaulting a woman in monasses. the police arrested this man, harold rodman saying he assaulted a woman yesterday. and investigators say a victim and friend were walking in the area when a man wearing a tsa uniform approached them and showed them the badge. moments later, the victim said she was sexually assaulted. the former director of the fbi is in charge of the investigation into the penn state sex abuse scandal. >> if we find or run across any evident of criminality, we'll report that immediately. and we will can stem -- ask them for their help in the assistance. >> his investigation will be fair, comprehensive, and relatively quick. he's already brought in former fbi agents and federal prosecutors andings to look into records dating as far back as 1975. the former penn state assistant football coach jerry sandusky is accused of sexually abusing at least eight children. some of the alleged attacks took place at school facilities. two penn state staffers said they witnessed attacks >> reporter: we're talking about a multimillion deficit of 4 ms. and that is just for this year. the university had to make some tough cuts. eight of the 27 teams have been cut. and three men track teams, including the indoor, outdoor and cross country. the man's tennis, the water polo and some acrobatics and tumbling. altogether, a total of 166 athletes are affected and 12 athletic coaches and this is that reaction to the tough cuts. >> i want to make it clear that this is perhaps one of the most painful and heartwrenching decisions i have made. over the past two wes, i have met with coaches and who have -- student athletes and communicated with many, many parents and alumni. >> and this is not something we would, any of us wanted to do. >> part of the problem, the fund raising is down and the program are down and that is ona steady decline since 2006 and that is part of a problem. coming up, we'll have reaction from more students and the athletes involveed in this. >> i don't know if you know this yet, but what happens to the coaches and especially to those scholarship athletes? >> oh, my goodness. crazy. and more than a billion dollars messing from customer accounts. find out which major investment firm is under federal investigation. this building was supposed to be the new home of a non- profit that helps children. but, they're out of money. no not because of the economy. they say somebody took millions of dollars from then. en. and another staff shakeup. why d.c.'s mayor is revamping his communications team. eam. ñ >> it's called a ponezy scheme, taking someone else's money with the promise of investing it but a fraud that ends up with someone losing cash. federal investigators say it happened in the d.c. area. among the victims, several non- profits. fox 5s beth parker is here now with the story. beth? >> reporter: well, the securities and exchange commissioned there are 130 investors that lost $127 milliony that trustd this man and company with their money investing $8 million. what is left? $200. >> this is heartwringing. >> reporter: juanita price is in the business of helping children. she's the executive director of hillcrest children's center in d.c. >> many of the young people that we provide services to are foster kid children. we provide services to homeless adults homeless families. >> reporter: that job got tougher. the securities and exchange commission charged garfield m. taylor and his company gibraltar asset management with running a ponezy school. >> we came -- ponezy scheme. >> he came across as someone who was very professional, astute and competent. caring, presenting that he had a mission to help charities, a mission to help children and families. >> reporter: the board took a lot of precautions before hiring taylor and associates to manage the money. after a trial period, they handed over $8 million, half of the hillcrest endowment. according to the sec, it was not the conservative investment strategy that taylor promised. >> he would tell people that there their principle wouldn't be touched and promised them 20% on their money. >> reporter: instead, hillcrest lost nearly $8 million. we knocked on the door of the million-dollar home in mont groomery county, no word for him. hillcrest would love to hear from him. their plans to renovate a new facility are on hole. they're still providing some support to low-income families. >> all of the plans and hopes and things we wanted to do to hundred dollars our children we're not able to do. >> reporter: they learn something lesson the hard way now, who you are begins with what you do. >> reporter: there are two different court cases, hillcrest filed suit against garfield and his colleagues and the securities and exchange commission filed a separate complaint that is in federal court in washington, d.c., civil cases and not federal. >> thank you. and another member pleaded guilty to fraud. he admits he falsified business records to produce fake trades dating back to the early '70s and that convinced investors the trades happened. he will also admit to bank fraud so they can buy multimillion homes. the failed investment brokerage mf global is in the hot seat, missing as much as $1.2 billion from customer accounts, twice the amount that the company reported to regulators. the feds are trying to figure out if mf global took money from the client's accounts as their own finances went south, which is illegal. and the investment group that wants to buy a troubled online poker operation has a plan to get money back to gamblers whose assets were frozen. the justice department is investigating full-tilt poker for the suspectd ponzi scheme. the group reached an agreement with prosecutors to broker the sale and free up the assets of those gambling. we're waiting for the money. in an effort to get the message out to the public, mayor gray announced a new communications director and chief of staff both joining the city after leaving their jobs on capitol hill. matt ackland has more. >> reporter: the mayor believes his office can do a better job of getting information out to the public, especially the good news he would like the district residents to know about. the mayor announced that his head of communications, linda wharton boyd, will transfer to the health department and two fresh faces would join his administration. sheila has been hired as the deputy chief of staff and will focus on community engagement. she has worked for congresswoman eleanor holmes norton for many years and served as the chief of staff. and also pedro rivero, serving as deputy chief of staff and communications director for congresswoman zoe lofgren of california. >> i believe some of the things we have condition have -- done have not gotten out there as quickly. >> people are asking me and not because i asked him. >> when it comes to hiring in d.c., salaries have been an issue recently. the mayor said that sheila bun will be paid $150,000 a year and ribera, $120,000 a year. by the way, laura, both are district residents. >> good to know. thank you. >> uh-huh. it could go a long way toward easing the traffic congestion in our area. the second leg of the icc is going to open up to commuters. respect his face. we'll tell but a newical pain to keep undeserving drivers -- new campaign to keep undeserving drivers out of handicap parking spaces. ces. ? reaction coming up. >> it's an overused phrase. there is a fine line between winning any losing. yesterday, this was the -- that was the case for the redskins who came up short to the cowboys in overtime. dave feldman has more on the players reaction. feldy? >> reporter: you know, dan snider's done a lot of whacky things since buying this in 1999. he never lost six straight games until now. the same goes for mike shanahan. in his 18 years as a head coach. up chartered waters for the two most powerful men running the powerful washington redskins. we have breaking news first, laura. let's go back to you. >> we're going to go to the white house to listen to presume a. thanks, feldy -- presume a thanks, filly, as he reacts to the failure of the supercommittee and light listen to what the president has to same. >> by cutting spending, the growth of medicare error error and medicaid and asking the wealthiest americans to pay their fair share. in addition to my plan, there were a number of other bipartisan plans for them to consider from both democrats and republicans, all of which promoted a balanced approach. this kind of balanced approach to reducing or deficit and where everyone gets a little bit and everyone does their fair share is supported by an overwhelming majority of americans. democrats, independents, and republicans. supported by experts and economists from all across the political spectrum and to their credit, many democrats in congress were willing to put politics aside and commit to reasonable adjustments that have would reduced the cost of medicare error error as long as they were part of a balanced approach. despite the broad agreement that exists for such an approach, there is still too manyies in congress who have refused to listen to the voices of reason and compromise coming from outside of washington. they continued to insist on protecting the $100 billion worth of tax cuts to the wealthiest 2% of the americans at any cost, even if it means reducing the deficit to things like education and medical research. even if it means deep cuts in medicare. so at this point, at least, they simply won't bum from that negotiating position. and so far that refusal continues to be the main summit block preventing congress from reaching an agreement to further reducer deficit. now, we are not in the same situation we were in in august. there is no imminent threat to us defaulting on the debt that we owe and there is 1 trillion worth of spending cuts locked in and part of the law stated that if congress could not reach an agreement on the deficit, there would be another wo$.2 trillion of automatic cuts in 2013. the budget -- divided equally between domestic spending and defense spinning. one way or another, we will be trimming the deficit by $2.2 trillion the next 10 years and that is going to happen, one way or another. we have $1 trillion locked in and either congress comes up with $1.2 trillion, which they have failed to do or the sequester kicks in and the automating spending cuts will occur that will bring in the wo$.2 trillion in deficit. the -- $1.2 trillion deficit. the question is if we can reduce the deficit to help the economy grow, operates with a scalpel and not a hatchet, and if not, whether congress is willing to stick it to the painful deal that we made in august for the automatic cuts. some in congress are trying to undo the automatic spending cuts. my message to them is simple: no. i will veto any effort to get rid of those automatic spending cuts domestic and defense spending. there will be no easy offramps on this one. we need to keep the pressure up to compromise. not turn off the pressure. the only way the spends cuts will not take place is if congress gets back to work and agrees on a balanced plan to reduce the deficit by $1.2 trillion. that is what they need to do and that is the job they promised to do. they still have a year to figure it out although congress hasn't come to an agreement yet, nothing prevents them from coming up with an agreement in the days ahead. they can still come together and around a balanced plan. i believe democrats are going to do so. there will be some republicans interested in preventing the automatic cuts from taking place and, as i have from the beginning, i stand ready and willing to work with anybody that is ready to engage in that effort to create a balanced plan for deficit reduction. and in the meantime, we have a lot of work left. we have to work to cut taxes for workers and small business owners across america before congress goes on break. if we don't act, taxes will go up for every american starting next year and i am not about to let that happen. the middle-class americans can't afford to lose $1,000 next year because congress won't act. i can only hope that members of congress who have been fighting hard to protect tax breaks for the wealthy will fight as hard to protect tax breaks for small business owners and middle class families. we need to put construction workers back on the job rebuilding our roads and our bridges. we still need to put our teachers back in the classroom educating our kids. when everyone is back from thanksgiving, it's time to get work done for the american people and all around the country, americans are working hard to live within their mens and meet their responsibles, and i know they expect washington to do the same. thanks.
