here's brian now with the news edge at 11:00. right off the top tonight, an arrest in a murder mystery on a quiet maryland street. the father found dead in the middle of that wheaton street. police have a lot of questions about what happened. they say the victim was not a threat to anyone. so, why did someone kill him? fox 5's wisdom martin is following the investigation. wisdom? >> reporter: brian, investigators and family members are still looking for answers tonight. they want to know why this father of two young girls walked out of his house last night and ended up dead. >> it just happened, you know, this morning and which i'm still don't know exactly what happened. >> reporter: jose says his 34- year-old brother, samuel, was a good father and hard worker. he did construction and drove a dump truck. he called samuel a jack of all trades. >> he's a mechanic, too. he do everything. >> reporter: jose says samuel was at home with his family last night when he got a phone call. >> he was here in the house and around 10:00, my mom said somebody calling and he answered the phone. so he said i'm going to go out for a little while. >> reporter: they say he got in his car and drove away. then investigators say just after midnight, motorist saw a body laying in the road on newton street in wheaton. police identified samuel chacon as the victim who was transported to the hospital and later pronounced dead. then today investigators arrested 19-year-old moises rodriguez of wheaton charging him with murder. an autopsy revealed chacon died from multiple stab wounds. police say the suspect and victim did know each other but the motive for this crime is still unknown. >> we never heard nothing about somebody want to hurt him. >> reporter: rodriguez is currently being held without bond at the montgomery county police detention center. the news edge on a police involved shooting in fairfax county. police say the man they shot and killed was unarmed. it happened friday on route 1 in alexandria. they were trying to pull over david masters who they believe had just stolen from a business. one of the officers who was involved is on administrative leave while the investigation continues. the other two officers involved have returned to their normal duties. a case of mistaken identity turned deadly on a hunting trip. a virginia man accidentally shot at a group of ollege students thinking they were deer. it happened yesterday afternoon just a mile off the ferrum college campus in the virginia wilderness. roz plater live in the newsroom with more. >> reporter: it all went down about 4:00 in the afternoon on a clear, sunny day. so tonight the families are asking how could this happen. and how could one bullet cause so much damage. now, this happened tuesday afternoon aut a mile from the ferrum college campus in a wooded area. several students were working on a biology project collecting frogs. investigators say a hunter claims he thought the students were deer and opened fire. one round hit 23-year-old jessica goode in the chest killing her. it appeared her body. then struck her classmatin the hand. the 20-year-old is a biology student from mcle. his mother says he's already had surgery and likely faces months of therapy. >> what really strikes me is how is it possible that one tuny bullet can do this kind of damage. what kind of person would use this. was it appropriate? >> reporter: police av arrested a 31-year-old. he is charged with manslaughter, reckless handling of a gun and trespassing to hunt. his bond is set at $20,000 and he's set to be arraigned on december 2. meanwhile we're told funeral services for jessica goode are set for saturday in winchester. lawmakers on capitol hill discuss the 9/11 terror trials. attorney general eric holder faced tough questions over his decision to try 9/11 mastermind khalid sheik mohammad in new york city. >> mr. attorney general, you've based this on where you think you're more likely to get a conviction. you talked about the best chance to prosecute, the chances of success are enhanced and so on. one of the factors has to be the fact that he has at least at some time asked to plead guilty. you had to have taken that into account. >> that was then. i don't know what khalid sheik mohammad wants to do now and i'm not going to base a determination on where the cases should be brought on what a terrorist wants to do. he will not select the prosecution venue. i will select it and i have. >> during his testimony, the attorney general also said it is unlily that guantanamo bay prison would be closed by the january deadline previously set by the president. former d.c. police chief charles ramsey is taking heat tonight over mass arrests during the world bank protest back in 2002. laura evans tonight everywhere at 11:00. >> reporter: a lawsuit filed today over those arrests. a d.c. police detective claims he heard ramsey order the arrests of hundreds of demonstrators. ramsey's sworn twice he did not do that. the lawsuit seeks $500,000 from the city in punitive penalties plus attorneys fees and other costs. ramsey is now commissioner of the philly police. fallout tonight following a govnment task force recommendation on mammograms starting at age 50. kathleen sebelius says women should continue screening starting at age 40. she issued that statement today to clear up any confusion. south carolina governor mark sanford could face ethics findings. the state ethics commission says he violated state laws when it came to his use of state private and commercial planes. no specifics, though, on the charges he would face. prince george's county police are calling a merchant who shot and killed a gunman in his store a hero. two masked gunmen stormed the food zone convenience store in washington. tried to rob it but the store owner said think again. jon jiang grabbed one of the men's guns and opened fire. today customers congratulated him for his actions. >> it's sad that somebody had to die but i'm glad that he was able to protect himself because he might have been the one to die. >> i congratulate the brother for taking a gun away and just letting justice prevail for himself. >> police say it is unlikely any charges will be filed. as for jiang, he doesn't think he's a hero. in fact, he regrets what happened. he says he was just defending himself. will your kid have to get off the bus and walk to school? one local county has put that hot button issue on the able. who would walk and who would ride? we'll jessica mckay and other members of the fairfax county board of supervisors are worried. even though they cut police and fire and libraries and public transportation funding this year, fairfax county revenues are still declining and more cuts are likely next year. mckay is looking hard at the cost of school busing. >> the most telling statistic is that it costs us as much money to operate a school bus every year as it does to put a teacher in the classroom. >> reporter: he also points out even with clean diesel fuel, school buses still pollute. he subjects that school officials -- subjects school official -- suggests school officials expand the groundries as to who gets bus service. >> if it means trails and connecting students to schools, that's a better use of our county resources than running school buses. >> reporter: it draws a maybe from some county residents. >> there are some areas in my community, rose hill, it will work pretty well. i can think maybe out in clifton or the western part of the county, it won't work so well. >> reporter: we also met parents of current bus students who don't want their children to become long distance walkers. >> i don't want mine having to walk anywhere, especially this time and age, no way. i want him on a bus. >> kidnapped, being beaup by other kids, i just think that that's a wrong call on fairfax county. i think they should be looking and thinking about the children. >> reporter: supervisor mckay has gotten some grief for floating this trial balloon. he says he's not married to the idea of trimming school bus service but the supervisor points out the projected budget hole for next year is $500 million, and he believes something has to be cut. in fairfax county, john henrehan, fox 5 news. >> the board of you can see some of the showers that are sneaking their way toward the metro area. these will be around for the morning rush hour. they will likely be fairly light to start the day, but continue throughout most of the i think even 10:00, 11:00 tomorrow night we'll still be tracking these pushing ahead of a frontal system. best part of all, it's not going to be cold. this time of year we watch all of the storms. no cold air to be found. we are going to keep this going thursday, friday, saturday and sunday. teeratures a little bit above normal each day. average is 57 degrees. tomorrow will be 60. friday looks like a real nice day, 62. i think saturday looks great as well. and sunday not bad at all. all of those days above average. good time to get all your running around done. let's talk a little bit more about the weekend. on saturday there may be a few clouds around but the above temperatures should make it nice. we're holding any showers off on sunday till very late at night. but i have to tell you that if anything does change with the forecast for the weekend, it will be the timing of showers that may approach the area sunday night associated with a coastal low pressure system that will be developing off the carolinas. good news tonight with the clouds and the showers starting to move in. we will stay on the mild side. 51 for washington. 46 for germantown. 46 for front royal and 51 degrees for fredericksburg. tomorrow, though, the showers around but warm showers, so warm and slightly unstable out to our west that there could even be a rumble of thunder during the day. but that rain will be off and on throughout the entire day. max hd future cast we'll pause this around 1:00 or so you can see for the first half of the day, most of the showers stay west of the metro area. that's not to say you won't get a few here and there but 11:00 tomorrow night now we see them lining up nicely with our frontal system. that's going to keep swinging on through. friday nice and bright. by 1:00 or 10 we -- or so we should be seeing lots of sunshine. and going on into the weekend, we are in fine shape. we'll keep an eye on the coastal. that's about the only ripple in the forecast that we still have to get ironed out. the late shower is what that represents on sunday. monday i think we'll still have some showers going, 56 degrees. good news, most people don't start their travel plans we hope till tuesday or wednesday. getting on the road then will main to be seen as we iron out those details later in the week. speaking of ironing out the details, feldy has lots
