mr. lauro essentially revealed the defense motions that they are going to start filing very shortly. first of all, they are going to claim that donald trump was immune to these charges because the indictment covers a period when he was actually president of the united states. also, he is going to claim selective prosecution because the charges brought by the special counsel were who was appointed during the biden administration is retaliation for the investigation of hunter biden. he is also going to challenge apparently all three of the conspiracy counts, plotting to defraud the united states. disruptions of the certification of the election, and depriving people the right to have their vote counted. so, that's essentially donald trump tipping his hand what the defense is going to be in d.c. >> ainsley: yeah. and this trial date that we are learning this morning is only one out of the four that we're expecting. jack smith, he wanted it originally, and can you see like the bottom, look, trump's d.c. trial to start a day before super tuesday. that's what the judge decided. the judge is saying tough,

we're going to push it to march 4th. i don't know, what's march 5th? super tuesday. the president is used to barn storming around march 5th -- 4th. instead, got to be in court. and then you see how the rest of this plays out. the rest, we know for sure, the rnc on july 15th, everything should be wrapped up by then. and then you got election day. can you imagine if the president is convicted along the way or can you imagine if he is exonerated if he is the nominee. put jet fuel into his campaign but other people say joe biden does not have to campaign if donald trump is in court. joe biden will just say hey, i got my job to do. i got to be president of the united states. plus, my opponent, if it is -- does get the nomination, is he in court anyway. it will be the closest thing to a pandemic rematch. >> steve: mr. lauro yesterday in front of a judge in d.c. look let's kick the big trial into 2026 and ultimately she said we are going to start on march 4th.

mr. eastman? >> no. not at all. in fact, council for mr. trump, not anyone that represents him in georgia, but i'm referring to mr. lauro, has made comments to that effect in media appearances, that it is their position that donald trump did exactly what we would expect him to do. he had a serious constitutional question to confront around the certification of the election. what does he do? he hires a constitutional law professor to advise him and follows that advice. we have no problem if that's a part of the defense that former president trump decides to mount in georgia. that's fine with us. >> reporter: he would have been following that advice against the advice of top officials who worked for him. the attorney general, top election officials, top attorneys in the white house. when your client left the jail here, he said he believes that the election was stolen, which

how long are these lawyers and this particular group of lawyers has a track record, a positive track record, how long will they be willing to, again, deal with a client who is refusing to play by the rules? lauro, during the preliminary hearing, assured the judge that trump would abide by every single term of the bond agreement. as he said that, one of the lead prosecutors, tom wind -- wyndham kind of chuckled. it's particularly interesting right now. >> so this idea that history disappears blows me over. that's exactly what it feels like, to keep trying to put the history of the trumpism, on the air every day for two hours. i want to proceeds this with

the tape, to, believe that they were in several kinds of irregularities in the election. votes were stolen, whatever it is they believed or set on the tape. and they therefore, all we need to come up with are the difference of this amount of votes, even though we, on that tape, the folks on the tape, believes that there were many more votes that were stolen or lost or improperly cast, or whatever the theory is. so i think if you play the rest of the case and highlight those areas to put this in that context of your theory of defense. >> you know, i wonder. there are a number of lawyers that are mentioned in this indictment. rudy giuliani, sydney powell, jenna ellis, just to name a few. and there has been the perception, and there has been the thought that donald trump's legal counsel in the previous case, i believe mr. lauro talking about the advice of counsel. obviously an umbrella term to suggest that he was just following the advice of counsel here and that cannot be wrong, it can't be all that bad.

i think judge chutkan is going to grant it. because why would trump want this information but to intimidate witnesses, to try this case in the court of public opinion. trump's legal team tipped their hand already because his lawyer, lauro, went on all the sunday shows. it's called the full ginzburg. he did that because they warrant their supporters to be riled up. they want to taint the jury pool. i think the judge is going to send a message back. >> every time this legal team puts forward an argument, all of the attorneys at our table, that is not a thing, that is not a legal argument. once they are actually in the courtroom, right, and they are defending their client, what do you expect the argument to be that they make? >> they don't really have many arguments except for the first amendment argument and the advice of council argument that i just did what john eastman told me. both of those arguments require donald trump to testify. and his lawyers do not want him to take the stand. it's a perjury trap. at the very least he could be eviscerated by the
