TALLAHASSEE — Civil rights groups are seeking to invalidate a freshly signed Florida law that takes aim at demonstrations that turn violent, arguing in a federal lawsuit filed on May 11 that the new law was racially motivated.
They also said the law has already silenced activists wanting to speak out against police misconduct and other concerns facing their communities.

TALLAHASSEE — Civil rights groups are seeking to invalidate a freshly signed Florida law that takes aim at demonstrations that turn violent, arguing in a federal lawsuit filed Tuesday that the new law was racially motivated.
They also said the law has already silenced activists wanting to speak out against police misconduct and other concerns facing their communities.
The suit filed in federal district in Tallahassee on behalf of the groups asserts that residents, particularly Black-led groups, “who organize and conduct racial justice protests are fearful that their members risk criminal liability merely for speaking out and advocating for change.”
Gov. Ron DeSantis signed the so-called “anti-riot” bill into law last month. He had urged lawmakers to send him legislation that would enhance penalties against violent protesters after last year’s tumultuous demonstrations over the treatment of Black people by police.

The nonprofit group Legacy Entertainment & Arts Foundation filed the lawsuit Wednesday in Orlando federal court, according to court records. It argues the new law violates First Amendment protections for free speech, Eighth Amendment protections against cruel and unusual punishment and 14th Amendment protections of due process.
“The breathtaking scope of the Bill includes granting civil immunity to people who drive into peaceful demonstrators if such demonstration blocks a road, prevents people accused of ‘rioting’ from bailing out of jail until after their first court appearance, increases penalties for assaulting law enforcement officers while engaging in a ‘riot,’ penalizing local governments that interfere with efforts to stop a 'riot,' and allows law enforcement agencies that face funding reductions to file objections,” the complaint stated.
