Ex-employees seek CYFD contract investigation

The state Attorney General’s Office, the state auditor and the New Mexico State Ethics Commission are being asked to investigate allegations that two top officials at the state Children, Youth and Families Department improperly steered a multimillion dollar information systems contract to a California firm without going to competitive bid.
In a complaint filed last week, two former CYFD employees contend an investigation is needed into whether state and federal laws were broken in the agency’s hiring of Binti Inc., which is headquartered in Oakland, California.
The 11-page complaint was signed by Cliff Gilmore, who served as CYFD’s public information officer, and his wife, Debra Gilmore, who had headed CYFD’s Office of Children’s Rights. Both were fired May 6 after less than a year on the job. They previously filed a whistleblower lawsuit in state District Court in Santa Fe alleging they were terminated for raising questions about the hiring of Binti, among other issues.

A special congressional election is checking the political pulse of politics across the Albuquerque metro area and a few outlying rural communities in one of the few House campaigns since President Joe Biden took office.
Four names are on the ballot in Tuesday's election to succeed Deb Haaland in Congress after her confirmation as secretary of the U.S. Interior Department. After weeks of early voting, polling locations are closed on Sunday and Monday before reopening on Election Day with allowances for same-day registration.
New Mexico's 1st Congressional District has heavily favored Democratic candidates in recent years, shunning President Donald Trump with a gap of 23 percentage points in 2020 and reelecting Haaland with a margin of 16 percentage points as voter participation reached an all-time high.

  Commentary: Thanks to solid investigative reporting by Searchlight New Mexico, the state Children Youth and Families Department is no longer using a secure messaging system designed to circumvent open records laws by automatically deleting records before a request can be made.
The system allowed CYFD officials to automatically delete their text messages. According to former CYFD Chief Public Information Officer Cliff Gilmore, Department Secretary Brian Blaylock told top staff members that they should set their messages to automatically delete after 24 hours, specifically to avoid the Open Records Law. He noted that once a request is made, records must be preserved. So, the best solution is to get rid of them before a request can be made.

LAS VEGAS – The trial of former Las Vegas mayor Tonita Gurule-Giron got underway Tuesday, despite a bumpy start with some last-minute jury issues.
Gurule-Giron, 63, is accused of using her position as mayor to give her then-boyfriend’s construction company, Gemini Construction, city contracts in exchange for kickbacks. Fourth Judicial District Judge Abigail Aragon is presiding over the trial, which is expected to last until Friday.

Gurule-Giron is charged with engaging in an official act for personal financial gain, violation of ethical principles of public service, soliciting or receiving an illegal kickback, conspiracy to commit making or permitting a false public voucher, unlawful interest in a public contract – each fourth-degree felonies – and demanding or receiving a bribe by a public officer or employee, a third-degree felony.
