Challenge to Berkeley gas regulation dismissed, a win for cities in carbon emissions fight

A District Court judge dismissed a lawsuit last week challenging the city of Berkeley, California s 2019 ban on natural gas infrastructure in new low-rise residential buildings, a decision that some observers say could inspire more cities to follow with their own restrictions.
In a lawsuit brought by the California Restaurant Association (CRA), U.S. District Court Judge Yvonne Gonzalez Rogers for the Northern District of California stated that the local regulation is not preempted by the federal U.S. Energy Policy & Conservation Act (EPCA). The judge did not rule on whether it is preempted by the California Building Standards Code or the California Energy Code, and said that must be taken up in state court. ....

Carbon dioxide gets the fame and attention, out of the greenhouse gases. But there are others that are even more effective at trapping heat; they just exist in much smaller concentrations, so they don’t usually face the same level of scrutiny or regulation.
The United States is finally taking aim at an important type of these lesser-known superpollutants: hydrofluorocarbons, or HFCs, which are used in air conditioners and refrigerators. The Environmental Protection Agency announced a rule on Monday, first reported by the New York Times’s Lisa Friedman, that it will phase out the coolant’s use by 85 percent over the next 15 years. The EPA estimates the rule would cut down on the equivalent of 4.7 billion metric tons of carbon dioxide from 2022 to 2050 about equal to three years of US power sector pollution. ....

U.S. President-elect Joe Biden is expected to move quickly to execute his energy and climate change agenda during his first 100 days in office, both through executive action and the launch or rollback of agency rulemakings.
The incoming president will also work closely with the Democrat-controlled U.S. Congress on climate policy as lawmakers draft further legislation to respond to the coronavirus pandemic.
