DALLAS, TX – The U.S. Department of Labor’s Wage and Hour Division (WHD) has launched an outreach and enforcement initiative to improve compliance with the Fair Labor Standards Act (FLSA) and the Family and Medical Leave Act (FMLA) among businesses in the child care industry in its Southwest region.
WHD will conduct compliance assistance seminars and will increase close communication and coordination with child care industry stakeholders. Outreach will be coupled with strategic and data-driven enforcement efforts to test industry compliance and identify and address trends in violations. ....

The United States Department of Labor (DOL) wrapped up 2020 by issuing COVID-related guidance under both the Family and Medical Leave Act (FMLA) and the Families First Coronavirus Response Act (FFCRA).
FMLA Guidance
The DOL issued new FMLA guidance in the form of two “Field Assistance Bulletins” (FAB)
[1], noting in a press release that the guidance is part of the DOL’s “ongoing efforts to support the American workforce through the pandemic recovery.”
In FAB 2020-7, the DOL addressed the employer notice provisions of various federal labor laws.
[2]  With respect to the required posting of the general FMLA notice, the DOL explained that it will consider electronic posting by employers to satisfy the posting requirement when: (a) all hiring and work is done remotely; and (b) the employer posts the FMLA notice on an internal or external website that is accessible to all employees and app ....

Recognizing that remote work is here to stay for many employers, the U.S. Department of Labor (DOL) recently issued guidance on how employers can use virtual means to distribute and maintain the various posters required by federal employment laws.
Background
Several federal laws, including the Fair Labor Standards Act (FLSA), Family and Medical Leave Act (FMLA), and the Employee Polygraph Protection Act (EPPA) require employers to post a notice of rights in a conspicuous location. The FLSA, for example, requires employers to post a DOL-issued notice “in every establishment where such employees are employed so as to permit them to observe readily a copy.” The FMLA goes even further, requiring the notice to be “posted prominently where it can be readily seen by employees ....

U.S. Department of Labor Issues Final Rule to Amend Tipped Employee Regulations

December 28, 2020 - WASHINGTON, DC – The U.S. Department of Labor last week announced a final rule protecting the tips of employees. This rule addresses amendments made to Section 3(m) of
the Fair Labor Standards Act (FLSA) by the Consolidated Appropriations Act (CAA) of 2018. The CAA prohibits employers from keeping tips received by their employees, regardless of whether the employer takes a credit for tips earned by workers toward its minimum wage obligation to those employees under the FLSA (a “tip credit”). The rule also prohibits employers from allowing managers or supervisors to keep any portion of employees’ tips. ....

Indiana Restaurant Operator To Pay $317,108 In Back Wages To 21 Employees Following U.S. Department Of Labor Investigation – WBIW

(EVANSVILLE) – After an investigation by the U.S. Department of Labor’s Wage and Hour Division (WHD), Los Tequila Inc. – operator of Los Tres Caminos restaurant in Evansville, Indiana – will pay $317,108 in minimum wage and overtime back wages to 21 employees for violations of the Fair Labor Standards Act (FLSA).
WHD investigators found that Los Tequila Inc. violated the FLSA’s minimum wage and overtime requirements by paying servers for only up to 40 hours per week, failing to pay them any wages at all for any hours they worked beyond that point. Servers typically worked more than 40 hours per week every workweek. ....
