getting closer to more reopenings. >>hey they can grant that's right contra costa county is inching closer to that red tier but by the states metrics at this point not there just yet, but the state has said that they will be allowing for more reopenings in 4 counties to move forward once vaccination deployment gets up a little bit in a little bit better shape as for the counties that are already in the red teal tier a number of them here in the bay area. but some contra costa county business leaders say they are feeling left 5 bay area counties are already ahead of the others when it comes to reopening santa clara, san francisco, san mateo marine and napa counties have all loosened restrictions in the red tier. >>but counties like contra costa continue to wait. it's really hard. >>hard to not be open right now like the other counties are open right now restaurants like postie know in lafayette have to continue seating their customers outside under the purple tier unlike in the red tier where diners can sit inside up to 25%. >>other indoor activities include movie theaters museums and gyms owner perry town believes the reopenings should be uniform across the bay area. i think it's fair for them to open us up now to other counties are open up. what's making our clientele just going to go to sepsis go for dinner date inside one reason contra costa county has stayed in the purple tier is because of new covid-19 cases per day per 100,000 people as of monday it sits at just over 8. the county will be able to move ahead once it dips to 7 or fewer new infections. the owner of honor and thai cuisine says they would like to reopen for indoor dining i think he's going to be they bad out if he can do in sight fall, because we are 85 to to open but she also understands it might be better to be patient is not good right we do have the high number for the covid. i think it's good that did not last to open right now. just when it first. >>well the state says that they are considering modifying the metric to 10 or fewer new covid-19 cases and that's once a vaccine deployment gets better in those hardest hit communities. and it's also important to note that most of california's 58 counties remain in the purple tier grant vicki. >>dan i know it's only a monday night over the it was really hop and a lot of the restaurants were doing a pretty brisk business out outside the weather's going to change is out with their worried about. >>that is definitely one of their post you know they were pretty happy that they've been able to keep tent area warm there. but there there have been people that have been coming out of these restaurants, especially on nights when it gets cooler like tonight or even when rain is in the forecast that they're going right to the front door and saying hey look at i'm going to sit inside is that okay and they're like sorry, we have to turn away. one business behind me here batch in brine actually said that they had visitors from humboldt county and they were hoping to be able to sit inside and unfortunately they had to turn them away as well so they're hoping very soon that they will be able to enter into the red tier plans to reopen more than 70 elementary schools. >>in the district for those pre k through second grade. the district released a timeline for students to return and officials say it's going to happen in 3 waves in many cases children will return 5 days a week with their regular teachers but in schools where there is high demand to return to in person learning there's going to be a hybrid model and students will attend in person. 2 days a week this all came after the district reached an agreement with the teachers on friday. >>we emphasize from the start that we wanted to make sure that students were able to stay with the teachers they've had all year as much as possible and we achieved that we also wanted to make sure that students whose parents choose not to send them back if they're not quite ready to send their kids back to school in person that they continue to receive quality instruction as well. also as part of the agreement students teachers will have to be tested. >>for covid-19 every 2 weeks in these big group of oakland parents is pushing for schools to reopen now. these moms and dads say their kids are suffering and need to be back in the classroom kron four's michelle kingston spoke to them and the district leaders to find out when the doors may be back open in oakland. >>the for my 11th grader who pretty close to dropping out and he says he just he can't do this anymore. >>this is not the way that is supposed to learning. >>oakland unified school district officials believe it's critical for students to be back in the classroom by mid to late march, but some parents don't think that's going to happen and say their kids are reaching their limit the district does not seem to be doing its job and putting kids first. >>rebecca bodenheimer is a part of a group of parents in oakland usd parents for transparency and safe reopening they're frustrated and want the district and the teachers association to come to an agreement didn't get students back to in person learning. >>i trust we can do we can do it safely and that we need to do it that our kids health is actually being very detrimental e affected and it's urgent that we open the schools the oakland unified school district says that for several months now the district has been working towards an opening of our campuses this spring we've taken countless steps to ensure that campuses staff and students are ready for this transition, the oakland education association says their bargaining team has been meeting 3 times a week and has been working hard we're hopeful that we will reach an agreement soon it will be able to share further details when we come to an agreement we spoke to one oakland teacher who says she will return to in person learning once it's safe. >>but she needs more information before heading back inside what's that safety plan says social distancing plan. >>it's not just like a yes or no in oakland, michelle kingston kron 4 news. the cdc released guidelines, let people know what is safe once you're fully vaccinated the agency says you you can gather with other vaccinated people that includes. >>meetings i indoors without a mask and no social distancing. they also say that vaccinated people can come together in the same way with people considered low risk for severe disease. officials say a person is considered fully vaccinated 2 weeks after receiving the last require dose of the vaccine. but even after that fully vaccinated people should still take precautions while out in public. >>because the whole name of the game here is control of the environment. any on family even though the cdcs sanction potential mixing of socks and an unvaccinated in that incident setting it's only 5 pretty soon as unvaccinated has a lower risk of getting progressing to bad covid to older people and those with but it's also different when you go out into the world because not everybody has been vaccinated yet and the more people you put together the higher the chinese statistically that somebody can covid. from each other even though they've been vaccinated off from a box and person depending on when they were vaccinated. >>the cdc says more than 9% of americans are fully vaccinated so far is about 30 million people. >>the area legislators community leaders say the state's new equity plan leaves out many of the people it is meant to help the plan to distribute covid vaccines to the state's most vulnerable neighborhoods in more than 400 zip codes. only includes 10 bay area zip codes and it leaves out some hard-hit neighborhoods like east really have to take a closer look at you're probably wondering how this happens and it has to do with the state's metric which is based off of things like household income education levels and health care. well, you know local leaders say that that does not take into affect your take in effect that there's gentrification in large disparities in these neighborhoods as well and that's why they had a call with the governor. the governor's office today and they say that that we can expect changes to this plan as soon as sometime tomorrow. >>the area lawmakers calling on the governor's office on monday to make changes to the state's new equity plan. then to distribute covid-19 vaccines to underserved communities. the plan announced last week but his oeuvre 40% of the state's vaccine supply to vulnerable residents across 446 zip codes, however, some of the hardest hit commlnities in the bay area were left out including east san jose which is a predominantly latino community. the hope is that within the next 24 hours that's the commitment that we got from the governor's office for the next 24 hours. >>they would come back with some kind of an adjustment that takes care of the areas that seem to be. missing in action right now and missing from the role of senator dave cortese who represents santa clara county. >>was shocked when he saw no zip codes from his region included on the state's list, the states metrics who many are now calling well intentioned, but flawed. >>was based on household income education and health care. >>community leaders like john de colo of the latino 6, 7, people in a one bedroom or making under $50,000 a year living next door to one person in a two-bedroom was maybe maybe a $180,000 a year. and that is actually the cross of why we've seen high rates of infection in the mission district looking at city data of covid cases broken down by neighborhood. >>it's easy to see the neighborhoods in dark green with the highest infection rates among them are the mission district bayview hunters point in portola all of which were excluded from the state's list follow the data and support where it meets all right, it's really that simple. >>only 2 zip codes in san francisco made it on to that state's list that is the tenderloin neighborhood and treasure island to again senator cortez he says that the governor's office is expected to make some changes to this plan sometime tomorrow, the next 24 hours for now live in san francisco tailored the psac ii kron 4 news. thank you taylor more than 6,000 people who went to the oakland coliseum to get a vaccine got a less than recommended those people affected visited the site last sunday and monday. first theresa she's been following this story for us and has the very latest now from oakland. >>we first told you about the situation last week and now the state telling kron 4 news that they are indeed sending out letters to nearly 6300 people and the conclusion was that because they received more than. >>0.1 5 mililiters it's is it sufficient in terms of getting an immune response. >>that from the california department of public health director about vaccines administered at the oakland coliseum mass vaccine site and letters going out to those 6300 people and issue the state informing those vaccinated on february 28 and march first that they may have received a lesser dosage than recommended. the state alerted to that lesser amount reportedly by several emt workers here at the oakland coliseum mass vaccine site once alerted state officials say that they stepped in adjusted the dosage and also called in a team to investigate. now the state says in concert with the centers for disease control prevention. a vaccine manufacturer pfizer and the california department of public health, a possible smaller dosage is quote safe and does not require the dose to be repeated should not repeat the the pfizer vaccine is a two-dose series. this would have been their first dose they need to just keep their appointment for their second dose and they're the letters weiss and out these letters. >>that's just the best practice anytime you have something that that anytime you have anything that's unusual we're receiving the medication we want to make sure that every single person knows. >>that what happened in this case, what happened is not going to require any action on their part but also everybody know that what happened happened during a period of time we caught it we changed it and the only people that need young people that really need to be aware where the persons who receives a slightly lower dose and then everybody else needs to realize is that we we fix the issue so that nobody has any unnecessary concern. >>i spoke with the san francisco man who did get a letter and had this to say about it all it's reassuring i is a good that they send out they contacted. >>people who are within that group. >>it's still i have to say it's it's a little sloppy. >>the whole experience was. the sloppiness of that was surprising. i don't want to sound too grumpy about it because was good. that they reached out to people. the letter says. the doe she got was safe and state is involved in and they said that they have not at any situation reported to them. here at the oakland mass vaccination site i'm theresa kron 4 news, a judge has accepted erica minues plea deal and he will serve the remainder. >>a 12 year sentence at home. amanda was the master tenant of the ghost ship warehouse where 36 people attending an illegal music event died in a massive fire. the judge accepted the plea deal earlier this evening after an emotional day in court. our first maureen kelly has the latest now from oakland. derick almena who has been under house arrest walked into the oakland courthouse with his mask under his chair devin not answering reporter questions. >>in court. he faced a barrage of many victim impact statements from the loved ones of the 36 people who died in that inferno. at the ghost ship warehouse during an illegal music event back in 2016. the family members themselves appeared in court remotely some of them broke down during their heartbreaking and sometimes angry words, colleen dolan whose daughter was killed in the fire cursed el mina to suffer as the victims did saying quote i curse you with the pain in your bones and muscles that comes from clinching in fear as you face the fury of a firestorm coming to consume you, derek, i do not need to see you spent 39 years in prison writing and drawing in quiet retreat, but i do call on judge thompson to reject this inadequate sentence and recommend a return to plea negotiations. i mean it was the master tenant of the go ship artist collective which was described by prosecutors as an illegally converted to story deathtrap mina pleaded guilty to 36 counts of involuntary manslaughter in exchange for a 12 year sentence. but he will not go to prison. he'll continue offer elementary school families the option to return their students to a 5 day schedule of on campus learning berkeley elementary school campuses set to reopen march 29th 4 tk transitional kindergarten through second grade and then campuses would open on april 12th for grades, 3 through 5 this is just breaking as we learn more we'll post the info on kron 4 dot com. meanwhile, the movement to recall governor, newsome has now 9 days left to send in signatures for verification. organizers say they've collected nearly 2 million signatures. only 1.5 million must be verified to qualify for a special election. so far about 700,000 signatures have been verified. march 17th is the deadline to get them verified counties have until april 29th to certify them if successful a special election would likely happen towards the end of the year. >>have now come forward to accuse new york governor andrew cuomo of harassment as the calls for him to resign are growing louder the murder of a police officer charge against walker in may. but they left open the opportunity to revisit the charge against him if new evidence surfaced. the judge today ordered that they dismissed the
