raided the new age healing collective in san jose. all the arrests are happening as voters prepare to decide whether to legalize recreational pot use in california. >> i definitely think that they are trying to influence voter opinions on that. >> i think they are unfounded. it's a little disturbing what's going on. >> reporter: dave hodges started the san jose cannabis buyers collective a year ago, one of the city's first dispensaries. since then, nearly 80 others have sprouted in the city. san jose doesn't have a moratorium on cannabis clubs. hodges also believes the latest crackdowns are politically motivated. >> i think this is an attempt at scare tactics to try to say that everything is illegal and all these places are run by criminals. and that's not the case. >> reporter: the bureau of narcotics enforcement did not return our phone calls today. hodges acknowledges there probably are some cannabis clubs engaging nil legal activities but says -- in illegal activities but says his place isn't one of them. >> we follow all the laws. we are definitely a legitimate bills. i do everything above board and it's about helping patients. >> reporter: the 22 marijuana delivery operators who were arrested in that sting i mentioned are now calling themselves the compassionate 22. they are scheduled to be arraigned on october 14. what their supporters are telling me is that they are planning to stage a rally that day demanding that the charges be dropped. >> all right. thuy vu, thank you. in the meantime, oakland pot clubs could face higher taxes soon. in november, voters will decide whether to nearly triple the supplemental sales tax rate for medicinal cannabis businesses. measure 5 would require the clubs to pay $50 for every 1,000 in gross receipts. it's estimated it would generate more than a million dollars for the city. parents and police are on alert tonight in pinole. that's where two little girls say a man tried to kidnap them. investigators say the man tried to grab a 5-year-old girl as she and her sister were walking near sunny view drive and nob hill avenue. linda yee on the disturbing coincidences to another case. reporter: the little girls were walking in this pinole neighborhood when the suspect control up and police say ordered them into his car threatening to shoot their family if they did not. investigators released this sketch of the man describing him as a white male with a gray goatee and missing tooth. this frightened kids in the neighborhood. >> i was thinking it could have been my little sister or something like that. she was outside at the time. >> reporter: police say the suspect grabbed the girl by her shirt but her 10-year-old sister pulled her away. the suspect drove off. an alert has gone out to nearby schools. >> we're always vigilant as far as looking out for strangers coming on campus. we confront them and make an announcement again to the kids and just reiterating to them as far as who to talk to, who not to talk to. >> reporter: police say the suspect was driving an older model green four-door jeep cherokee with tinted windows and possible left headlight damage. the description of the suspect and his car is eerily similar to another attempted abduction last month outside pleasant hill middle school. >> there were a couple of students waiting for their dad to pick them up after school. a car approached them, said do you need a ride, they said no. the folks in the card say are you sure, the kids say we don't need a ride and the car drove off. >> reporter: in this case four white suspects with beards were in the old green jeep cherokee. police aren't saying if the cases may be related but the disturbing coincidences scare 15-year-old mario castenada who say he could have been targeted in the last attempt on friday. >> yeah, i actually worry about that because he could have gone a gun or something like that and demanded it and they couldn't have done nothing about it. >> pretty shocking. i mean it's a quiet community. born and raised here, but it has been getting busier with a lot more crime going on these days so, i'm married now with two more kids and have to really watch those guys, too. >> reporter: i spoke to pinole police this afternoon telling them about the similarities. they say they were unaware of the similarities until we brought it to their attention. but it's not something they are easily saying that is connected at this time. julie? >> linda yee, thank you. well, police are looking for a gunman who opened fire during a birthday party at a san leandro golf club over the weekend. two young men were shot and killed saturday night on the dance floor of the wedges grill at the monarch bay golf course. it's still not clear who rented the facility. police say the contact information provided turned out to be phony. police are asking for witnesses to come forward in another shooting. this one is in a san francisco nightclub. a gunman opened fire inside the cafe kokomo club. a man is expected to survive. a warning to high school athletes and coaches, concussions can be deadly. a new awareness campaign kicked offer today in the east bay. ann notarangelo is in pinole where at least one player spoke from experience. ann. >> reporter: yeah, dana. wait until you hear his story. the pinole valley spartans run defeated. they just wrapped up their practice and now they are heading into the locker room. when they go in there they are going to see this poster. it talks about concussion and tells what you the symptoms are and it tells you how serious it is. there are people who want this poster to be up in every boy and girl's high school locker room across the country. >> i didn't remember the hit. all i remember is i ran and everything else blacked out after that. >> reporter: linebacker travis feeney is only 17. and he has already had one concussion playing for the pinole spartans. he was off the field for three games. >> my head was aching and i had -- i couldn't yell or nothing. i count talk loud. i couldn't study or focus. >> reporter: during congressional hearings they discovered as many as 400,000 high school athletes suffered concussions in the 2008-2009 school year. today the nfl and the cdc launched a campaign targeting 14 sports, including football, baseball and soccer, saying when in doubt, sit it out. they are offering this poster to high schools across the country. it tells athletes why concussions are so serious and their symptoms. >> part of this campaign is to take the pressure off the coach. the coach is certainly in small towns and small communities are under great pressure to play injured players. what the nfl is saying in the big leagues they are off the field and don't return. >> reporter: it may seem like a no-brainer but this is a cultural shift. just ask former oakland raider morris bradshaw. >> i was part of the generation where you were told, you know, suck it up and get back in there. and we did. >> reporter: congressman george mim brother posed legislation asking school districts to implement concussion safety and management plans and require them to post information about concussions on school grounds and websites. football coach steve alameda says he thinks this hasn't been done sooner because of lack of education. many athletes don't understand how serious a bruise to the brain can be and have too much faith in their equipment, like helmets. >> you have to do what's right. winning is again not that important. we don't get paid for wins and losses here. a child's health has to be the most important thing. >> reporter: travis took his concussion seriously and it's paid off. he is healthy and will be university of arizona next year. he fully supports this campaign. >> i think it's great. should have had it earlier but i'm glad it's happening now. everybody needs to know that concussions are no joke. >> reporter: and some of the stories they heard at the congressional hearing are tragic. one softball player now fully disabled after a concussion during a game. and dana, another athlete committed suicide after multiple brain injuries. >> very sensitive personally about this issue me. daughter had to take off her junior year from basketball. so even though the nfl is behind this and bless them for being out in front of it, every sport has this potential for kids. basketball for girls like my daughter, soccer, girls and boys. >> absolutely. >> reporter: that's why they're targeting a wide array of sports. it is though with the nfl that dade county the lead in producing these posters but you're absolutely right, dana. and they did have the girls soccer team out here proving that point. >> thank you, ann notarangelo. >> you bet. hot windy weather may have been a factor in several grassfires near vacaville. one fire broke out in the hills north of vacaville morning to. it burned about 10 acres before firefighters got it under control. two other small fires broke out but were quickly controlled. a red flag warning has been issued due to high winds and low humidity. roberta gonzales is in the weather center with will gust tonight up to 40 miles an hour. when that happens it dries out the atmosphere and the relative humidity today dropped down to 6 in the driest locations. we do have the red flag warning in effect and this is also because of the heat. five records today santa rosa shattered a record setback in 1991. napa tied a record at 89 degrees. otherwise it was unseasonably warm to hot moffett field and sfo. we have a heat watch in effect for the entire bay area tomorrow through wednesday evening. we'll pinpoint the exact locations and dana and julie, that's still coming up later on in this in the bay area. and we're it's been two years since pg&e first started installing the smartmeters here in the bay area. and we're still hearing complaints about some big overcharges. but this one is unusual. jerry watson reports. >> reporter: he couldn't believe his eyes when he saw this. >> i got a large bill in august with was over $1,500. >> reporter: five months into having the new smartmeters, kaufman and his wife sarah's pg&e bill suddenly skyrocketed. >> pg&e did correct the billing. >> reporter: pg&e admits there was an error. but it had nothing to do with the accuracy of the meter and everything to do with how it was read. >> those have been manually read. >> reporter: that's right. pg&e continues to take smartmeter readings off the meter itself even though it's designed to be read remotely and not just here in santa rosa but everywhere. >> between the time that a smartmeter is installed and we transition customers to remote reads for billing purposes, we ensure that we continue to build out the network of smartmeters. >> it's my understanding that the purpose of the smartmeters so they can read it remotely. >> reporter: that is the purpose eventually. now pg&e says in the first 60 to 90 days after meters are installed they are read manually. in the case of the kaufmans, it's been five months. >> when you put in smartmetering they are supposed to work immediately. >> reporter: its critics who say the fact pg&e still takes manual readings points to an ongoing problem with the smartmeter reading system. >> pg&e is so out of compliance with industry standards that you have to build a communications system first. >> reporter: because of that, tony says pg&e continues to lose the pr battle with customers. >> it simply causes -- it adds to customer confusion and resistance to the smartmeters in the first place. >> reporter: pg&e says it monitors meters remotely while reading them manually. and it's part of the process of providing accurate information for their customers. >> we do monitor to ensure we are getting not only very good reasons but complete reads. >> reporter: the kaufmans are going along with pg&e's flow. >> they were very apologetic about it. and hopefully, we don't have any repeated mistakes again. we shall see. >> reporter: when pg&e finally does start reading their remotely. in santa rosa, jerry watson, noticed that something was wrong and they followed it and watched as it managed to dodge power lines and buildings. it struck a fence in rohnert park. the pilot and two others inside were shaken up but okay. police cleared a group of activists from a vacant residential hotel in the tenderloin. protestors were trying to draw attention to the plight of the homeless, they say. today officers went room to room but they say the squatters escaped through a roof. a few were cited and then released. and hayward is considering a ban on restaurants using styrofoam. the law would force any retailer that sells prepared foods to use either recyclable or biodegradable bowls, plates and boxes. the city report estimates that the law could cost some smaller restaurants about $250 more a month and record heat right here in the bay area. let's kick-start with a live cbs 5 weather camera as the sun begins to descend on a day in which it does go down in the record books. we had 97 degrees for a high today in santa rosa. and 88 degrees in mountain view. how about another sneak peek? this time let's transition to the coast where the coast is clear. we have an offshore flow and the winds are now blowing out of the northeast up to a good 15 to 18 miles per hour right here in ocean beach where today's high temperature was in the low 70s. let's go ahead and share with you some of the things you need to know about this impending heat wave. we have a red flag warning in effect for the north and east bay hills. let's look at some of the conditions that warrant this. right now the relative humidity is in the teens. it dropped down to 7% in the santa rosa area earlier this afternoon. but now 14% in the north bay. still 90 in napa with a record high there today, as well. if you are out and about this evening, obviously we still have some balmy temperatures as the sun officially sets at 6:37. with this heat we have a watch, a heat watch, that's in effect for tuesday through wednesday evening as temperatures are unseasonably warm by a good 20 degrees. bottom line, hydrate all day. coast is clear. we do have an area of low pressure. it's to the north of us, going to stay there. tonight, temperatures in the 60s for the most part. a few upper 50s. otherwise, tomorrow's day haim highs, 80s at the beaches, 90 in san jose and los gatos. east bay numbersle from 8 in oakland to 97 in brentwood and there is a peek at the north bay numbers from 69 in stinson beach to 93 in sonoma. we'll talk about the extended forecast, dana and julie, and how long this heat is going to last still coming up. >> all righty then. thank you. well, from kindergarten on we all learn that it's nice to share. but when it comes to the raiders and the 49ers, sharing a football stadium could be a pretty dicey proposition. mike sugerman has been pondering this idea. hey, mike. >> reporter: dana, you know, oakland and san francisco are actually closer than russia and alaska are and you can see oakland from san francisco's front door. and vice versa. the football 9ers from san francisco don't like playing here. they want to go to santa clara and they have already started trying to build a stadium down there. and the raiders aren't crazy about the coliseum, either. they are not getting a lot of people there. so the main man in football says, you know, you ought to build a stadium together. really?? reporter: this is candlestick park where the 49ers play. they hate it. they think it's the pits. it's located in the southern tip of san francisco. this is the oakland coliseum. it's where the raiders play. they don't mind it as much but when they play there is sometimes for empty seats. it's out in the bay in the middle of alameda county next to the oakland airport. this is nfl commissioner roger goodell at the raiders game sunday he suggested the teams share a new stadium. e teams >> i would encourage them to evaluate it because it has worked in new york and as you know, getting a stadium built is a challenging process particularly in this environment. and i encourage them to take a look at that and evaluate it. >> reporter: where would you put this new stadium? between san francisco, oakland and santa clara? well, the middle is obviously right in the middle of the bay. that's not going to work. but stadiums cost like, i don't know, half a billion dollars. and teams only play 10 times a year. ladies and gentlemen, quick question. i went to pete's tavern in the city. one of my favorite sports bars to ask the question. should the raiders and 9ers share a stadium, thumbs up, thumbs down? >> thumbs up. >> reporter: why? >> i think the economics make sense. you have two professional teams, the amount of time that they are using the stadium is limited. >> just the loyalties of where the giants -- you know, excuse me, the miners and the raiders are the fans are not interminglings. >> reporter: it would be like mixing white wine with jell-o. and next week, the two teams play each other. what would the field like, half raider half 9er gold 9er at the midfield? but as goodell says they did it in new york. if we can't get along together like new yorkers, that would really be something. >> all right. white wine and jell-o shot reference, maybe that's a cheese shot. but the fans are very different and that culture of the ownership, al davis and the yorks? it would be very interesting to see these families get together. but the economics do work. and at least the public discussion has started. >> yeah, but, okay, so let's say they do this and little east bay city of san ramon paying its city manager herb moniz $344,000 a year. but the real target of buchanan's shot isn't moniz. it's republican mayor abram wilson, who is one. officials who approved the city manager's salary and who is now her opponent in the november election. and this week, buchanan started running a radio ad hitting him for it. >> wilson is paying the highest salary in the state. higher than cities 8 to 10 times the size and he thinks that's fine? >> reporter: so now her opponent mayor wilson has to defend the pay. >> san ramon is one of the best run cities in the united states. we have 100% of our pension obligations are paid. we have a reserve. we have quality of life here. >> reporter: the 15th assembly district isn't the only race where we're seeing tactics like this. in alameda, a developer who is trying to unseat mayor beverly johnson recently sent out thousands of mailers with the headline city hall corruption and likening that towns manager to the recently arrested city manager of bell, california. >> as voters struggle to make ends meet and they see politicians living large, it creates anger. >> reporter: and it does get people's attention. why would he be making all that money? i think it's crazy. how can somebody in this economy be making that kind of money? >> i think it's one of those things that we are kind of under wraps for a long time but now that the economy is the way it is, we start at looking things like how much the city manager is making. >> everything in san ramon is transparent. we have salary and benefits and we show everything. >> reporter: but buchanan isn't backing down. >> they have 40% of their employees that are paid over $100,000 a year and unfunded pension benefits i think is an important information for people to have. >> this is political season. people often say things that are not true. >> reporter: they say a lot of things in political season. and you can bet we're going to hear a lot more of them in the coming weeks as the races get tighter and the hits get harder. julie? >> phil matier, we'll be looking forward to that. thank you. the home of robert rizzo is a mess. vandals covered the front porch with toilet paper. posted bond last year to get out of jail charged with fraud and corruption in the city of bell scandal. no word on whether rizzo was at home at the time of the vandalism. tonight senate candidate carly fiorina shares her views on the environment and healthcare in a one-on-one interview. terrell brown on why the republican says she want to talk to china. >> reporter: california voters approved the groundbreaking environmental law in 2006. it would cut greenhouse gas emissions in the state by the year 2020. this election day voters will now decide whether to delay that law. it's called proposition 23 sponsored by big oil tallied as a job saver. >> you support proposition 23? >> i do. >> reporter: why? >> because global warming is a serious issue that requires a serious global response. some scientists agree that a single state or a single nation acting alone will have no impact on global greenhouse gas emissions and what i am unwilling to do is put california at a competitive comparative disadvantage and not have any impact. >> reporter: do we go with jobs being more important or is the environment? >> i think it's a balance. they are both important. but here's what i would do specifically. i would engage immediately in very serious bilateral discussions with china because between china and the u.s., our two nations are responsible for more than half of the global greenhouse gas emissions and unless china is willing to play, nothing we do is going to make any difference. >> reporter: fiorina also doesn't believe president obama's healthcare reform bill will make any difference. if elected, she would vote to scrap the president's legislation. so what would do you? >> let's do the things we know work first. let's create real competition for the health insurance industry. they don't have competition today. they exist in regulated oligopolies in 50 regulated markets. we missed the opportunity to create real competition. let's engage in medical malpractice reform. we did it in california. it lowered health insurance premiums. let's do it nationwide. let's create access to more low cost clinics for routine care. all of those things we can do. none of those things did we do in this bill. >> reporter: we have offered a one-on-one interview with senator barbara boxer. we are talking to her campaign well, for the first time ever, a patient with a spinal cord injury has been injected with human embryonic stem cells. the hope is that one day this treatment may help the paralyzed walk again. >> dr. kim mulvihill joins us with details. >> reporter: it's amazing. to think that actually this is now happening. a person from menlo park is behind this groundbreaking study to harness the power to repair an injury in patients with little hope of recovery but the area of research is not without controversy, obviously. there are lots of questions about embryonic stem cells. now u.s. researchers have made a big step getting some answers. on friday, at the shepherd center in atlanta, a patient with a recent spine cord injury made medical history. the paraplegic was injected with two million embryonic stem cells. >> this is the dawn of a new era in medical therapeutics. >> reporter: so far, jarron of menlo park has spent $170 million in developing this treatment. the embryonic stem cells are leftovers. they become specialized nerve cells and directly get into the injured area of the spine cord to regenerate spinal cord tissue this. >> this therapy goes beyond pills and scalpels. >> reporter: in lab animals the results were dramatic. paralyzed rodents moved again. however... >> people are just so different than rodents. >> reporter: this doctor hits up stem cell research at ucsf. he is optimistic but urges caution. >> i think that people looking at the outcome of this trial should really lower their expectations if they are really thinking patients will get out of their wheelchairs. it's highly unlikely. >> reporter: this initial trial is not aimed at curing the patient but to establish if the treatment is safe. now, this study is approved by the fda. but it's privately funded. as for the public financing of embryonic stem cell research, the issue is tied up in federal court. >> what kind of time frame are we looking at to see any kind of progress if there is going to be any? >> it will be difficult. this first patient of 10 that will be treated across country, they are going to be followed very closely for a long time. you want to be sure that these cells don't lead to a growth tumor, don't have nerve pain and aren't rejected. these are all things they didn't see in animal studies. be we're humans. we have check that. if it's deemed safe and the patient do well then the next phase would be higher doses to see if it's effective. right now they want to be sure it's safe. >> thank you. coming up, does sugar really make kids hyperactive?
