this morning but it is not as widespread as it was yesterday. we do have some patches of fog. we'll have to see if it gets revised a little bit later on this morning but foggy patches here and there. and relatively mild temperatures. let's take a look at what is going o we'll start with the temperatures across the region. currently in washington, the temperature is 45 degrees. 47 out at dulles airport. baltimore, 46 up there. frederick, maryland at 45 degrees. in fredericksburg, it is 50 degrees at this hour so pretty mild compared to yesterday. here is a look at the cloud cover. satellite-radar, no precipitation. i wouldn't rule out a stray sprinkle or two here and there. for the most part, we will be dry with alet of clouds hanging around here as well. your forecast for today, mostly cloudy. becoming breezy with winds oust west to the northwest five to 10, maybe 15 miles per hour later today. balmy. 55degrees for your high in town. 54 in front royal and then change trip out of 70 and 15. i know the trip out of gaithersburg for me wasn't like this. it was a better shot as you continue down towards the lane divide but something to make note of and allow yourself some extra time out on the roads. we can see across the bridge headed into the district. nice easy ride off of 395 from the beltway headed north. no problems reported between an an del and merrifield. that's a check of your fox 5 on-time traffic. -- between annanle and more i had field. gay marriage supporters ay victory is closer than they ever imagined. today, the district appears on track to approve same-sex marriages. the d.c. council is expected to give the final approval today. mayor fenty has agreed to sign the bill. excitement filled the air at a rally yesterday in northwest washington where supporters said it is a long time coming but they're still cautious. >> i'm excited. i think it is a historic moment for d.c. and i feel really lucky to be here, a d.c. resident, where i can see this moment. >> this is all about equality and although some people have said this isn't a civil rights issue, it is quite clear from the discussion going back deck eatdz that arriage is a civil right. it's fundamental civil right and that is what we're addressing here is equality. >> if the bill passes, it will head to capitol hill for a 30- day congressional review before marriages can actually begin. a group opposed to same-sex marriages is still fighting to stop the bill from passage. 18-year-old dominic turner claims he and a friend were running from police in an alley in northeast saturday night whn an officer hit him cr w. his cruiser and then took off. the police chief said the officer remained on the scene. turner who is now recovering from broken ribs, internal bleeding and a damaged lung says the incident has him living in fear. >> it was sad. it caused me to vomit. that was the impact. i'm just glad i'm still here. >> you don't hit young children. >> it is unclear why police were chasing turner and his friend. another story making headline on this tuesday more than, a fox 5 exclusive. he always claimed he was innocent and now after 28 years in prison, donald gates could be a free man thanks to dna evidence. in 198 1-rbgs he was convicted of the rape and murder of a georgetown student. sherry ly picks up the story from there. >> katherine chilling was raped and murdered in rock creek park and within days, police arrested a man they say confessed to a paid police informant. at trial donald gates said it wasn't true. now, dna evidence no one knew even existed appears to clear him and today, the same d.c. superior court judge who sentenced gates is being asked to set him free. schilling a georgetown university student had left her job at the watergate and never showed up at home. her roommate had warned her not to take the shortcut through rock creek park. police found her books scattered, her purse untouched she had been shot five times. at trial, donald gates was linked to the murder by two hairs that an investigator testified belonged to gates. at sentencing, gates said he didn't kill schilling and in 1998, schilling asked the judge for help saying the sperm cells in schilling's body didn't match. police found some of the old dna edence from the crime scene and had it tested. the results came back last week. gates can be excluded from the dna evidence found at the crime scene. as gates is now 57 years old, serving his time in a federal prison in arizona as best as we can determine, this is the first time that dna evidence has apparently exonerate a convicted killer in the district. sherry ly, fox 5 news. back to you. >> stoi. two loudoun county firefighters are under investigation suspended without pay after a fellow firefighter says he found a noose inside his car. that firefighter is black. the suspended firefighters are white. the sheriff's office says charges are not likely but the fire department is still investigating. turning now to the battle over health care. senate democrats looking to finalize a deal on health care reform holding a rare caucus meeting with president obama at the white house. while the president supports the medicare buy-in proposal, connecticut independent joe lieberman whose vote is needed to break a republican filibuster says he doesn't support it. democrats are pushing for passage by the end of the year. the u.s. financial system continuing to take steps toward recovery as citigroup and wells fargo are last two major national banks returning $45 billion in today. i know, tony o my way in, i know you were saying the fog wasn't as bad today but for me, it felt really bad. >> if it was, it was out to the west. that is a shot from o tower cam so here, it look pretty bad as well. even though there is no advisory in effect, i would behave as if there was one. there is patchy dense fog across portions of the viewing area this morning. as you are getting the kids ready for school, let's take a look at the bus stop forecast. you will find milder temperatures than we had yesterday. temperatures in the low to mid- 40s. some fog and a lot of clouds around. sunrise this morning will be at 7:19. that is more than two hours away. you know it will take some time to get that fog out of here. let's take a look at the current temperatures around the region. we've gone up a little bit. 46degrees here in the distct 47 in quantico. them really near yesterday's high in some places. we got up to 49 degrees yesterday in washington. 46degrees now in baltimore. 48 in annapolis, culpeper coming in at 43 degrees. a look at the satellite-radar, we'll show you that we do have clouds to deal with this morning. no precipitation. the precip is up to our north. that is part of the leading edge of a cold front that will be working its way through here today. as is always with these cold fronts, the cold air lags behind so the fnt comes through today. those winds shift to out of the northwest. that pushes the cold air in tonight and you will feel it tonight overnight and then tomorrow and for the next several days much cooler temperatures. so for today, here is what the forecast looks like. early fog, mostly cloudy and mild. high about 55 degrees. that is above normal. we'll take that. not too bad. for tonight, the cold air work its way in. the winds shift to out of the northwest, five to 10, maybe even 15 miles per hour. overnight low about 31 degrees in town. perhaps in the 0s in parts of the suburbs. big difference there. check out town. we tried to find some cameras out to the west. here we are live, 66 out in manassas just east of the virginia visitors center. for you guys traveling eastbound on 66 trying to get past 234 south and continue in towards centreville, this particular camera doesn't show the fog as much as what gurvir was talking about. as you continue eastbound, lanes are open as you travel from fair oaks to 123. all lanes are open on the beltway now. overnight construction cleared traveling between anen dale and merrifield. that's a check of your fox 5 on-time traffic. >> there is thrais new way to get initiative blocking the d.c. council from turning it into law. >> nobody has looked at this legislation in a decade. so the first step is going to be for us to figure out what, if anything, the council or the executive needs to do to implement this law. >> reporter: d.c. council member phil mendelsohn says city lawmakers will need time to work out the details. >> some details with regard to who can distribute marijuana for medical purposes, more details about who may qualify for use of medical marijuana. i'm speaking without having had the chance yet to sit down and look at what the organic law is, that which was passed by the voters. >> reporter: right now, 13 states have legalized marijuana ormedicinal purposes. california was the first in 1996. michigan the latest, just last year. the green light for the district to join at list comes with congressional passage of a d.c. funding bill. >> no one can remember when there has been a d.c. propping without some harmful anti-home rule rider. it is a great home rule win on the way for many others. >> president obama is expected to sign the appropriation bill later this week but one d.c. lawmaker says it may take up to five places in the entire country where same-sex marriages can be performed legally. supporters gathered at a rally in northwest yesterday saying they are ready for council to approve the bill. councilmember are set to take a final vote on the bill today and little likely to pass. soapily gay councilmember david capt an i can't pushed the bill saying it is long overdue. >> ai, a member of reporter: good morning. as you mentioned, today, the same d.c. superior court judge that sentenced donald gates for murder is being asked to set him free. it would be the first time as far as we can determine that a convicted killer in the district has been exonerated by dna evidence. that is dna evidence that no one knew existed that now appears to clear him. gates was convicted in the 1981 rape and murder a georgetown university stay tuned. cath rip schilling had left her job at the water game on the way home when she waskilled in rock creek park. she was shot five times. within days, police arrested gates saying he had confessed to a paid police performant. at trial, gates said he didn't do it. an fbi lab technician testified that two hairs found at the crime scene belonged to gates. he was convicted. years later, the unspktor general uncovered problems with that man technician and the defense claims the technician fabricated evidence. in 1998, gates asked the judge for help saying the sperm in schilling's body was not a match to his and that dna testing available today could clear him. he apparently was right. d.c. police found six slides last year with evidence from the crime scene and had it tested. the results came back last week excluding gates. now, he is going to court today asking for his conviction to be thrown out. gates is now 57 years old having served 28 years in prison if crime he has always maintained he did not commit. during his sentencing, while claiming his innocence, gates said he hoped to return to society, raise a family and have a place of his discuss the latest in health care. the rare caucus meeting come as lawmakers aat t present time to final as a a deal on health care reform which includes a proposed expansion of the medicare program for the elderly. connecticut independent joe lerp says he does not support the medicare buy-in proposal. his vote is needed to break the republican filibuster. the present does support the proposal. lawmaker are pushing to get the legislation passed bit end of the year. the president met with the heads of the biggest banks hoping to get them to loosen their purse springs and offer more loans especially to small businesses. citigroup and wells spark owe are the last two major banks returning $45 billion in aid to taxpayers freeing them from relation as a stipulation of the troubled asset we'll tell you what one couple is accused of leaving under a christmas tree that has them behind bars. >> need to warn you. it is very disturbing. volcano concerns as thousands flee their homes. we are checking headlines coming up next on fox 5 morning news. thousands he evacuated their homes for fear a volunteer khan owe might erupt in the philippines. it is a more than 8,000-foot volcano. nearly 50 now people live within a five-mile radius. experts say magma had been rising at the volcano over the past two week and the situation could get even worse. a very disturbing story coming out of texas where a couple is behind bars accused of stashing their aborted fetus in a gift bach under a christmas industry. police say the woman may have used pills to abort the fetus. she called 911 and said she didn't nowhere it was. asking on a tip, police found the sent-month fetus in a gift box. the white house plans to announce today that the federal government will take over a nearly empty prison in illinois to become the new home for a limited number of guantanamo bay detainees. president obama has directed the government to acquire thompson correctional center which is in a small town about 150 miles outside of chicago. sources say the facility will house federal inmates and no more than 100 detainees. an inmate in the maryland prison system is still on the run this morning. this temperatures that cold. across the nation, here is a look at the sat-rad, satellite- radar, for the uninitiated. the eastern half of the nation is cloudy. we do have rain showers across the east including all across louisiana into southern portions of mississippi, alabama and georgia. we have a little storm system. we saw the beginning of that yesterday making its way inland across the five milnow. nowhere near where it was yesterday when it was about half a mile. a cold front comes through. it will be blustery behind that front. so once it comes through, those winds, the winds that we have will shift to out of the northwest and they'll pick up in intensity, 10, 15, 20 miles per hour or show. forecast for washington for today, early fog, mostly cloudy, mild, high about 55 degrees. that is about eight degrees above normal. we'll take that. your five-day forecast, those temperatures drop tonight and then tomorrow, only about 41 degrees and breezy. thursday, friday, survey of business executives done by the greater washington board of trade shows 32% plan to hire more workers, up from just 12% in february. saw warns the competition for job opening will still be
