this just in to us on michael jackson. the memorial service now set for tuesday. now set for tuesday at los angeles's staples center. the same arena where jackson spent his last night alive. and federal drug agents are taking the case, looking into the prescription drug angle. could jackson's sudden death soon lead to criminal charges. a neighborhood mom charged in an internet hoax. one so cruel, her daughter's rival, a 13-year-old girl, killed herself. it's the first cyber bullying case to bring criminal charges, and just hours ago, a judge threw out laurie drew's conviction. she won't serve one day in prison. you're an important part of this show. give us a call, 1-877-tell-hln. e-mail us at cnn.com/primenews. or you can text us at hlntv, start your message with the word prime, this is your chance to be heard. -- captions by vitac -- www.vitac.com welcome to "prime news." i'm vinnie politan in for mike galanos. new video showing michael jackson dancing at a concert rehearsal just two days before his death. this never-before-seen footage was recorded june 23rd, just released by concert promoter aeg live. he appears healthy. but now federal drug agents are digging to find out if jackson's death is somehow tied to prescription drugs. plus, plans for jackson's memorial now set for tuesday in los angeles at the 20,000-seat staples center. so many angles to tackle here. let's bring in our expert panel. joining me, we have jim moret, chief correspondent for "inside edition." and clinical psychologist, dr. jeffrey gardere. jim, let's begin with you. this footage of michael jackson on the 23rd, at the staples center, you know what, this doesn't look like a guy who's about to die. yes, he's 50 years old. yes, he's not moving like he was when he was 24, but none of us are moving like we were when we were 24, jeff. he looks okay. >> he did look okay. but he looks okay for one night. i think the problem with those around him were concerned, i think that was he, he could not pull off all the concert tour. the fact is, the dea is involved. that leads you to believe that drugs are involved. >> yeah, that is a major red flag going up. dr. jeffrey gardere, you looked at that video. can someone be hooked, addicted on prescription drugs, and all these things we're hearing rumors, and reports, and people talking about, all these pills and things that michael jackson may have been taking. can someone be ingesting all those drugs, whether prescription or not, and still be able to get up on a stage like michael jackson did on the 23rd and perform with people half his age? >> yeah, absolutely. especially if there is this addiction to the prescription drugs. they use the drugs to perhaps help a person sleep, help a person get up in the morning, and help a person get moving throughout the day. vinnie, one of the things that people don't understand is that this addiction to prescription drugs is a huge problem in the united states. and of course, throughout the rest of the world. the only drug that's used more than prescription drugs is marijuana. so certainly it's not out of the realm of thinking, or possibilities to say that in fact michael may have had an addiction to prescription drugs that may have been enabled by his physicians. >> let's bring in -- go ahead, jim. >> vinnie, when you look at the video. and i'm looking at it again. okay, he was active for one song. maybe he was active for a set. when you turn the lights on michael jackson, he was a brilliant entertainer. i think the adrenaline could pull you through one performance. but just looking at that one snapshot, if you will, doesn't tell you the whole story. >> natisha lance is also joining us. she's the producer for the "nancy grace" show. natisha, what is the buzz out there right now? >> well, the latest, just as you said, vinnie, is there is going to be a memorial for michael jackson at staples center. we're waiting to hear word about this for quite some time. it will be tuesday morning at 10:00 a.m. the staples center seats about 20,000 people. there are probably a -- there will be a long line of people waiting to come in. there are people still coming to the jackson home here. you mentioned the dea is now involved in this case. it is still just a death investigation. it is not any type of criminal investigation at this point. and also, the doctor's car just on wednesday, that car was released. now, if you recall back when michael jackson passed away, his car was impounded. and it was just released yesterday. there may have been possible evidence that was in that car. but we don't know as of yet. >> all right. jim moret, you are a lawyer just like me, and just like me not practicing every day. we found a way out of all of it. the fact that the dea is now involved in all this, as you mentioned, that takes it to a different level now, doesn't it? >> boy, that says a lot to me. you know, obviously this is an investigation where police don't want to say a great deal. we do know police went to the home that michael jackson was renting. we do know that they left after his death with a couple of bags, purportedly of prescription medication. and by bringing the dea in, this is really reminiscent to me of the anna nicole case where it's alleged that anna nicole was in effect enabled by doctors, or there was doctor shopping, or there were aliases used. and there are all of those rumors and allegations swirling around this case as well, that michael jackson, according to his own family members, had a problem, an addiction, and was abusing prescription medication. and we've also heard from close family friend that they sought to stage an intervention, and that when jackson got wind of it, he put the kibosh on it. >> jeffrey gardere, when you talk about enablers of someone of al jackson's stature and power, and even if people around him wanted to do something, how difficult is it to get through to someone who has access to money and power like michael jackson, to get them to listen? >> it seems that as michael had different circles of people working with him, staff members and so on, they would in fact protect michael from everyone. so if you wanted to come in and make an intervention, you couldn't do it. the other problem, of course, if you lean on michael a little too much as anyone who is paying your bills, then you will tend to back off if they tell you, listen, i don't want this intervention. because you don't want to lose your job. but vinnie, the other thing we need to point out, it's not just michael jackson who has the power to be able to take prescription drugs whenever he wants, or to say to his doctor, i really need this, i want you to give it to me now, or say to the nurse. regular americans do it all the time. they have a relationship with their physicians. so whenever they need something, they'll call that physician and most physicians are so busy that they'll just say, okay, i'll write you out another prescription or fill another prescription for you. so this is something that happens when people are addicted to prescription drugs. >> all right. everybody stick around. we're going to have much, much more on the michael jackson case. and we're taking your calls, folks, 1-877-tell-hln. we want to know what you think. you can call us 1-877-tell-hln. shoot us an e-mail at cnn.com/primenews. yes, we do have text messaging. just text your comment to hlntv, that's 45688. start your message with the word prime so we can find it. include your name and state if you have room. we'll be showing your text messages throughout the program. now, some of the big news today on michael jackson, there's always going to be big news as this thing continues to snowball, is that the dea now involved in the investigation. the dea. that's the drug enforcement agency, or administration. natisha lance, producer from "nancy grace" show, some of the things the dea could be looking at here, right, are multiple aliases for prescriptions, and perhaps multiple doctors writing prescriptions? >> that's right. that could be one of the things that they are looking at. i think as jim had mentioned, they had gone to the home, searched the home, then the family had gone into the home. they had taken items out of the home. and then for some reason, the coroner's office and lapd was led back to the home that michael jackson was renting. they left with two large bags. we do know that drugs were removed from the premises. we don't know the quantity, we don't know what kinds of drugs. so the drug enforcement agency being involved now is probably going to shed some light on that. and i'm hearing that the division that is involved, specifically, is the one that tracks down prescription drugs. so they would be able to pinpoint who was writing the prescriptions for these drugs, where they were coming from, and who they were being given to, if there were aliases that were being used by michael jackson. >> now, this whole part of the investigation obviously will be connected to those toxicology results, natisha. any word on when those are going to come out? and when they do in fact get the results, will we necessarily hear those results? do you think that they are -- they're saying they're absolutely going to release them to the public, to the media, so everyone knows what's in those toxicologies. >> they are saying that they will be released to the public. but anything can happen. they could change their mind for some reason. as i said, right now this is a death investigation. it could graduate to the level of being a criminal investigation. however, once again, right now, just a death investigation. those toxicology reports are expected to come back in about four to six weeks. so we are still waiting to find out what is in those. >> all right. let's get some phone calls in here. we've got jill in indiana. jill, you're on the air. >> caller: all right. >> yes, jill? >> caller: hi. >> how are you? >> caller: i'm very well. thank you. i'm finding it hard to believe that the only people around michael jackson were people that wanted him to be high and happy all the time. where are the people who loved him and cared about him? when i was on drugs, there were a lot of people who wanted me to stop. and granted, i wasn't paying anybody's paycheck. but where are the people who cared about him and why didn't they open their mouth before he died? >> jim moret, how about that. i hear jackson's always talking about their family. but it didn't seem he was close to his family. was there anyone that was close to michael jackson who wasn't on the payroll, who could get through to this man? >> jackson surrounded himself with a very small group of people. and he liked people to agree with him. we've talked for days about what a shrewd business person he was. but he was also a child-like individual. and he may or may not have been addicted to drugs. the fact is, talking to people close to the family, you are in a very small circle. and if you got on michael jackson's bad side, you were basically excommunicated. his longtime manager was basically ban issued at one point, brought back in, not too long ago. same with john branca, the person named executor of the will. they split company some years ago and was just brought back into michael jackson's life a few weeks ago. i think it was very, very difficult for people who truly cared about michael jackson to get close to him, and tell him something he didn't want to hear. >> yeah. jeff gardere, i would expect family members to be the first people who would try to attempt to get through to michael jackson. perhaps his sister, janet, who didn't have to look for a handout. she didn't need money from him. but she's someone maybe that he could talk to. what are you seeing when you see a family and you see this iconic figure like michael jackson, but not surrounded necessarily by his family, his family not necessarily able to get through to him. if he had a problem. >> sure. well, from what we know, the family wanted to be around him. it wasn't just the money thing. they really did love him. jermaine gave a very interesting interview this morning, where he basically cried about how he felt that he was the backbone for his brother, and wish he had died instead of michael. and you're right, janet would probably be the sibling who could get through to michael. not just because she wasn't dependent on a paycheck and had her own success, but because he really did respect her. the thing people need to understand is, a lot of times we enable these drug-taking behaviors, not because we're just giving in or because we want to hurt them, or we're afraid of them. a lot of times we think we're helping them, because they reach out to us, and they cry and say they need this to be able to sleep, or to get along. and so that's how we enable them. that's how we think we're helping them. but in fact we are hurting them. >> all right. we're going to come back. much more on michael jackson. and remember, we are taking your phone calls, 1-877-tell-hln. welcome back. of course, we're talking about michael jackson. some new developments today. number one, brand-new video from the 23rd, at the staples center. there he is, michael jackson, just two days before his tragic death. how does he look to you, folks? give us a call. also, the dea now involved in his death investigation. on top of all that, we have more details about the memorial service. i want to go back to natisha lance, producer for the "nancy grace" show. natisha, what can you tell us about this memorial service? is there going to be a vip list? is it open to the public? and who do we expect to speak at this? >> well, the details are still being ironed out. but what we do know so far is that it will be open to the public. the staples stadium -- the staples center seats about 20,000 people. also, we're hearing word that they are still in the works, trying to get a burial confirmed and nailed down as to when that will be. and who will be there. so a lot of things are still in the works. still trying to iron them out. it was just yesterday that we were under the impression that there would be some type of public viewing at neverland. and that ended up changing. and now we're going to be at the staples center for michael jackson on tuesday, 10:00 a.m. local time. >> do you know if there's going to be cameras inside? is this going to be a televised event that will be available for folks to watch? >> don't know those details yet. >> still to come, still to find out. i want to go back to jim moret. you know, we're talking about michael jackson. we're talking about this memorial for this man who was this incredible, incredible icon. yet his death, the end is now -- there's a cloud over it. because we don't know exactly what happened. we don't know for sure how he died. and if anyone else may or may not be responsible. as for the way he led his life, jim, the way that he -- at least in the last many number of years, there was always an air of mystery around everything and anything that michael jackson did. >> certainly you talk about a cloud. there's a cloud over the last decade at least of his life. he dealt with that criminal case, he dealt with the allegations that were settled out of court some years before that. and, you know, a generation knows michael jackson as being somewhat odd or weird or, you know, the guy who said he liked to sleep with kids. i have an 11-year-old and that's really all he knew of michael jackson. i've opened him up to the music of michael jackson that you and i know, and a whole generation grew up with. there are really two sides to him. can you even imagine, you listen to what's being talked about at the staples center. the logistical nightmare, we don't know if there are going to be tickets, you don't know how to get tickets, are there going to be -- having an overflow at the nokia, which is the sister center right next door to staples, what's the traffic going to be like, who is going to pay for this. there are only really a few days to get this all sorted out. >> we've got tammy in tennessee. hello, tammy. >> caller: hello. >> you're on the air, tammy. >> caller: i think it's wrong to exploit michael jackson and talk about how he's on drugs. we don't know really that he was on drugs. and if he was, who's to say it wasn't the doctors that got him addicted, overmedicating him. my mother, for instance, she's been overmedicated for years. that's the problem in the country now, is the doctors. they overmedicate. they don't take the time to look and see what's best for you as a person, or your situation. >> you make a great point, tammy. thanks so much for the call. we're trying to figure out how did michael jackson die. and should anyone be held responsible here. we saw it in the anna nicole smith case. we saw indictments come down in that case. so it's an issue that i think is bigger than michael jackson. there is another story that we've been keeping an eye on. a mom was convicted for creating a fake myspace page. she was harassing her daughter's friend. well, now, that whole case has been thrown out. details coming up. then, unbeliee is thrown out. >> well, i don't think it's so unbelievable, vinnie. i'm going to take issue with you. what laurie drew did was terrible, there's no question about that. but how many of us when we sign up for websites, i'm very active on facebook, for example -- >> i noticed that. >> okay. i'm an attorney. i don't read those terms of usage, i just click agree because i want to get on my facebook page. that's what everybody does. this judge was concerned that she was convicted of violating terms of use, she was facing up to three years in jail, then what could happen next. i mean, is anybody who violates those terms of use provisions going to be imprisoned? are we going to imprison millions of people? the judge was concerned about the precedent. and that's why he made this ruling. >> but wasn't this a verdict? people listened to the evidence and they decided this was the verdict in the case. >> that's true. but judges, as you know, have the power to be the 13th juror. and really the all-powerful 13th juror and say, you know what, we sat through the whole trial, the jury reached a decision. but as a matter of law, as a matter of fact, i as judge will overturn it and dismiss the case. the defense made the motion. the judge considered it for a period of time. he says, by the way, this is a tent tiff ruling. but he'll probably stick to it. that's what the judge held. i have to give him some respect for it. i think he's right on the merits of it. >> this is highly unusual. generally speaking judges don't sit through a whole drive, have a verdict delivered and say, by the way, that verdict, disregard it, throw it out. >> the prosecution itself was unusual. keep in mind what lori was prosecuted for is access to the system. the government really had to stretch it to say that the violation of the terms of use constituted an authorized access. the judge is 100% correct. by the way, she should be prosecuted, even though the law didn't allow for it as it stood at the time she did her act. they are changing the law. >> so maybe some good will come out of this case if we change the law. but the way the law stands now. dr. jeff gardere, this has got to be some blow to the family, to the mom. you know what?
