found brutally murdered. a suspect is in custody. someone who new the victims. amy hollyfield is live in the ingleside district and you have dramatic video of the arrest yesterday. >> reporter: we do. a viewer sent it in. look at the scene behind me first. you won't believe they are still here. they are still watching over the house and crime scene tape surrounds the house. the police have said this crime scene was shocking in its brutality. here video you mentioned. it was taken over the weekend. taken yesterday by a viewer. they sent us in to us, it shows the s.w.a.t. team moving in someone on howth street and police held a press conference they had made an arrest. this was not a murder-suicide as one of their original theories. they took 35-year-old binh thai luc into custody and booked him on five counts of murder. police haven't said what the motive was behind the murders and they are just now starting to figure out what happened to the victims. >> there was blunt trauma to the victims. we don't know anything more than that other than -- there was a weapon involved. we don't know circumstances until we get that from the medical examiner. >> reporter: residents on howth street say they feel a bit relieved now that is man is in custody. they want to hear more. they want more answers. police have said that the suspect had prior gang ties and he does have a criminal history. they do think he knew the victims. they are still trying to identify all the victims, no names have been released but officers did emphasize they don't think the murders were random. >> katie: new this morning, san francisco police are investigating a homicide in the city's western addition neighborhood. it happened after 10:00 tonight. they found a person who was stabbed. that person later died from the injuries. it appears to show one man in handcuffs but police are not confirming whether anyone has been arrested in the case. they have given no motive for the killing. also at 11:00 at market street near the ferry building a man was stabbed. he is at the hospital with life-threatening injuries. >> kristen: polly klaas foundation will join the search for sierra lamar tomorrow. a search on saturday turned up no new clues. mother asked the organization to join the search. sierra has been missing for more than a week now. >> think about my own daughter and nieces and stuff, it can happen to anybody anywhere. i don't know what i would do. >> kristen: she was last seen two fridays ago in the morning before she left home for school. investigators have found her cellphone and handbag with dleoz folded up inside. >> katie: united states supreme court begins a hearing on president obama's landmark healthcare law. 26 states argue that it's unconstitutional. it requires almost every american to purchase health insurance by 2014 or pay a penalty. government defends the sweeping reform arguing medical care is not a choice, that every american will need health today at noon in front of san francisco's hall of justice. yesterday in oakland, some kherj and organizations traded their sweatshirts for hoodies. he was wearing a hoodie when he with a killed. >> he was in the a threat yet he still ended up being killed and perpetrator has still not been arrested so an investigation can begin. >> katie: george zimmerman says he was acting in self-defense. his attorney says his client fears for his life after getting death threats. >> kristen: the wife of suspended sheriff ross mirkarimi is in venezuela this morning. she had and the son is visiting with her ailing father. he is undergoing chemotherapy. it was approved by a family court judge. last week mirkarimi pleaded guilty to a misdemeanor count of false imprisonment and was suspended without pay by mayor ed lee. it stems from argument that over her desire to take her son to venezuela for a family visit. >> katie: alameda residents have two opportunities this week to weigh in on the city's new ban on plastic bags. they are holding community meetings tomorrow and thursday to hear opinions on the new ordinance that takes effect january 1st. retailers will charge ten cents for reusable bag and it could go up to 25 cents if the lower fees doesn't make enough of an impact. ordinance requires businesses and apartments to recycle. >> kristen: wet forecast will be recycled but right now enjoy bay, about three degrees warmer. those temperatures in the 30s around santa rosa with fog and visibility down to half a mile. upper 30s in los gatos rest of us in the mid 40s. front is off to our francisco, san mateo and upper 50s to low 60s in the north bay. rest of us in the low to mid-50s. very healthy rain tomorrow into wednesday morning. showers wednesday afternoon. slight chance of some rain across the north bay thursday, really think thursday and friday will be dryñçç before another chance of rain saturday. so far commute is looking okay. we do have slow traffic for 580 leaving the altamont pass. it will be heavy in patches heading to the dublin interchange. mass transit is no delays for the bart system. same story for caltrain and all the local ferries. bay bridge commute, heavy traffic, westbound traffic slow from about the end of the east parking lot. metering lights are still off. heading to the san mateo bridge, westbound traffic certainly getting busier. red taillights. it will be slow approaching this span, no big delays at toll plaza so far. in the east bay, 680 commute, heading through the walnut interchange, that is moving at the speed limit. >> napa to mid to upper 30s along the peninsula into los gatos. low low to mid 40s around the rest of our neighborhoods. heading down to the monterey bay mid to upper 40s. dry today, we'll see a lot of sunshine mixing with afternoon clouds, rain tonight to through wednesday morning. it has two parts to it. saturday, looks like a soaking but that system won't hang around very long. looks like just a saturday event right now. for this monday, you can see by the afternoon hours, i would say mostly cloudy. low to mid-50s around the bayshore. from the coast, san mateo northward through san francisco into the north bay, upper 50s to low 60s. we'll see more sunshine around the monterey bay. monterey at 57, everybody else inland will be in the low to mid-50s. 50 around richmond and san francisco, san mateo, mid to upper 40s, milder conditions tomorrow morning. you can see the rain coming down mainly in the north bay during the overnight hours. here it is. very impressive looking system with a lot of cloud cover which means a lot of moisture. first part of the system pushes clouds into our neighborhoods tonight. then -- i should say this afternoon but the rain sticks in the north bay and slowly sink to the south during the afternoon hours on tuesday and kind of hang around there during the overnight hours. you can see the secondary push of it moving through wednesday morning and into the early afternoon hours. by wednesday evening, completely dry once again with some fog forming by wednesday morning. rainfall, look at the yellows, very impressive, up to 4 inches for you, santa cruz up to 3 inches. rest of us about half of that which means half an inch to an inch. accu-weather seven-day forecast, slightly cooler tomorrow. cooler than average wednesday through thursday. we'll one suspect arrested. countless questions unanswered. this morning, san francisco police remain at the home where a gruesome mass murder was discovered last friday. amy hollyfield is live at the still active crime scene in the ingleside district. >> reporter: hard to believe three days later and it looks very much like a crime scene, still roped off and a pile of flowers that has accumulated here right in front of the home where five people were murdered. it's an indication that this crime tape up they have had a tough crime scene to process. yesterday was big day in the case. here is cellphone video a viewer took yesterday and sent into us. it shows the s.w.a.t. team moving in on a home on the street. they saw police using a battering ram and later in the day, they held a press conference to announce they had made an arrest. they took binh thai luc into custody. the victims knew the man, they haven't said how and they haven't said what the motive behind the murders was but the arrest did make residents on howth street a bit better. >> he got caught, but you still have to be careful over here. >> reporter: police say they are trying to figure out how the five people died. they do know that blunt force trauma was involved. they haven't said how the suspect knows the victims. they haven't even identified all of the victims yet. they still have a lot of work to do in this case. they tell us that luc has a criminal record and may have had prior gang ties. >> katie: weekend search for a missing morgan hill teenager sierra lamar yielded no new clues. they gathered for a vigil last night. she has been missing for more than a week. search and rescue crews will decide how to proceed with the search whether to narrow or expand it or change the focus. >> i think that everyone is trying to have the mindset that until something is said we're going to stay positive. we want to see sierra come home. >> katie: she was last seen a week ago friday before she left home for school. investigators have found her cellphone and handbag with clothes inside. >> an attempted kidnapping suspect is on the loose in san jose this morning. they are looking for a man that used a stun gun willow glen neighborhood and tried to drag her into a car. she did manage to get away and man left the scene in a red compact car with tinted windows. >> kristen: foster city police say a man that shot an intruder doesn't appear to have broken laws. it happened yesterday morning in 600 block of crane avenue. they called 911. they had her gunned shots and found the intruder wounded. 24-year-old suspect a san mateo resident underwent surgery and is recovering in the hospital. turning to presidential politics, mitt romney will be raising campaign cash in the bay area. his campaign is holding a reception at hotel at redwood shores. tickets range up to $2500. he will hold fund-raisers in southern california tomorrow. his rival rick santorum will make his way to the east bay thursday for a fund-raiser in alamo. support for romney is growing in california. according to a new poll, 42% of registered republican voters support him. 19% support rick santorum, with newt gingrich and ron paul a distant third and fourth. >> katie: new poll this morning finds broad support for governor brown's support of raising taxes and sales tax by quarter percent. they say they favor the proposal which brown hoelts hopes to put on the november ballot. 80% of democrats support it. 75% of independents support the plan. just 38% of republicans say they support the governor's proposal. >> kristen: taking a look outside. it is dry. no weather challenges if you are commuting but a little fog is developing. >> katie: kind of ominous, something is coming. >> something is coming but it won't be until the overnight hours we get the rain. good morning. here is a look at live doppler 7-hd. radar returns off the sonoma county coast. those are some of the mid-level clouds and those will be prevalent during the afternoon and evening hours. they will get thicker, no i don't expect any rain today. winds are fairly calm, even to around 3-7 miles an hour for hayward and 6 to 9 in concord and 5 in fairfield. it is pretty quiet this morning. we do have fog up around santa rosa. visibility was half a mile now it's up to five. looks like if we see any fog it will quickly dissipate. a lot of sunshine with some of the high clouds. temperatures running mainly in the 40s, few 30s in the east bay valleys. by noon we're seeing an increase in the clouds and temperatures jumping up to mid 40s. then we'll be partly sunny, north and increasing sunshine south. 50 in fremont, san jose, livermore and antioch. bulk of the rainfalls in the north bay. rest of it get it down just beyond the pay gates that will make the bay bridge commute worse. it's backed up from the macarthur maze. that is biggest hot spot this morning. once you pass the metering lights, traffic does okay across the upper deck heading into san francisco. once you are in the city, no big delays for 280 or 101. other bridge commutes, westbound traffic fine approaching san mateo toll plaza but you will hit some slow traffic westbound direction approaching mid span. traffic picks up heading into foster city. heading to the rest of the commute
