berkeley at what could you call a breakfast of champions. just a few minutes ago she arrived in san francisco for lunch. elizabeth wenger has a look at what's on today's menu, i guess. good afternoon. >> reporter: good afternoon. everyone always wants to know what's on the menu. she is here behind me at the merchants exchange building. we are here in the financial district. $2,500 a head that's how much it cost you to get a seat. yeah, she jaws arrived here in san francisco a short time ago, about a half hour ago. we saw her car drive by, police saying they blocked off the streets. but as you mentioned, this has been a busy day overall for the first lady. earlier this morning, michelle obama attended a fundraising breakfast at the claremont hotel in berkeley. she was escorted into the hotel where a small crowd of onlookers and secret service awaited her arrival. tickets for the event ranged from $1,000 to $25,000 for a seat. it is not clear what she came to talk about, but the if i recall has taken up the -- but the first lady has taken up the cause of eating healthy. so right in line with that mission, today's breakfast was catered by alice waters. we understand the chef whipped up some locally grown organic meals. in the crowd of onlookers was naomi. you may remember her. she is the same woman who crashed president obama's bay area fundraiser by singing back in april and got tossed out of the event. she didn't make it inside today. >> i didn't expect it to be easy. i mean, we were really lucky the first time. we had maybe beginner's luck. but we have all kinds of plans. we have a few things cooking. >> it was awesome to see her. i think i caught her on my camera. >> she waved at me. i feel so empowered by her as a mother, career woman, american. >> reporter: so not everyone is happy with the first lady's visit. some republicans have complained about how much this trip is costing and that taxpayers are the ones footing the bill. so she is inside in the merchant's exchange building. we checked in with the campaign and no word on where she is going next. she has been in california since yesterday. she is actually in pasadena all day yesterday. back to you guys. so elizabeth, did the people see her go in? how much did they get to see of the first lady. >> and did you get a glimpse? that suv was moving fast. >> not much. tinted windows. she drove past to the hotel. we felt lucky to catch the glimpse of her that we did seam obvious, some other onlookers were excited, as well. >> all right. elizabeth wenger in san francisco, thank you. >> ah, it is good to be back in puerto rico. >> whoo! meantime, president obama making a rare trip to puerto rico. the last president to visit wa jfk in 1961. he is hoping to drum up support of puerto rican voters on the mainland. [ no audio ] >> another judge who threw out prop 8. during a hearing yesterday, judge james ware sound skeptical that judge vaughn walker's relationship with another man is relevant to the case. he said there is no evidence that he had a stake in the outcome. a wake-up call in san jose. a quadruple shooting, kiet do with the latest on the homicide investigation and the crucial vote today that could take dozens of cops off the street. >> reporter: with 6.5 months left to go in 2011, san jose now has 27 homicides. that is a tie with the average homicide rate in the past decade. the shooting happened on the same day that the city plans to vote on something it never has before, lay off police officers. another day, another fatal shooting in san jose. of the four people shot early this morning on oxton drive near tully and mclaughlin in east san jose, one is dead, and the killers are still out there. >> it's too early to determine motive whether it's gang- related or not but that's something we are looking into. >> reporter: this marks the 27th homicide. year and caps off what has been an unusually violent week in san jose. last thursday a riot broke out downtown and three people were stabbed. business owner say word is getting out that san jose is about to lay off 100 cops. >> maybe out-of-towners are coming because of lack of resources. >> being the crook is a livelihood. >> reporter: just hours after the fatal shooting, san jose police officers voted to approve a 10% pay cut for a year which would save more than 150 additional layoffs. but pink slips have already gone out to 100 officers and crooks are ready. >> no doubt folks are out there seeing it on tv, reading it in the newspaper, reading it on the internet that san jose is going to lay off officers. and now is the time to take advantage of that opportunity. >> reporter: once the council accepts the police concessions it will be up to an arbitrator to determine how long the paycuts will status in this early gop face-off in new hampshire. the debate didn't have a lot of bite since the candidates didn't attack each other. instead, they saved their jabs for the president. >> the obama administration is an antijobs, antibusiness, anti- american energy destructive force. >> reporter: former minnesota governor tim pawlenty even backed away from an earlier swipe at the healthcare reform romney signed as massachusetts governor calling it obamneycare. >> we are united in trying to defeat barack obama. there will be some differences amongst republicans as well but last night the focus was on the president. >> reporter: and the president is waging his own campaign on the road defending his economic policy. while the recovery is the number one issue for all the candidates, what's not clear, the president's reporters say, which republican candidate poses the biggest threat especially since the gop field is still changing. just today, the "associated press" reported that former utah governor john huntsman will run one day after minnesota representative michele bachmann declared her own candidacy. >> i want to announce tonight, president obama is a one term president. >> i'm choosing to run because of the former federal tax lawyer and also as a creator of a successful company in my home state, i see that we have a need now for job creation like no other time. >> reporter: bachmann started the tea party caucus in congress. but she says her decision to run is completely independent of whether another tea party favorite, sarah palin, decides jump into the race. and today the republican house speaker praised bachmann's performance and said she has as good a shot as any of the candidates at winning the gop nomination. so you have heard their positions on [ female announcer ] at&t u-verse: tv like you've never seen before. mission accomp think this they hit the bay hoping to build some excitement for the america's cup race. i would say mission accomplished. i don't think this is what they quite had in mind, though. the oracle racing team capsized the new catamaran yesterday, caught in a gust and did a complete 180. one crew member fell through the sail. he's okay. another suffered a minor rib injury. the team was on the water to draw attention to the 2013 america's cup and i imagine that video has been played all over the world. everyone is okay, though. this is perfect timing for the hot sunny beautiful weather that we are seeing. the federal government has finally issued some new rules for sunscreen. >> good for you and i here. dr. kim mulvihill joins with us what you need to know before you -- the word of the day -- slather up. >> reporter: slather is the right word and so very important today. now, if you buy a product that offers broad spectrum protection you may think it protection against both uva and uvb rays. many products have skimpy uva ray protection. uva and uvb contributes to skin cancer and aging. these new regulations address the problem and should help consumers. so here are the highlights. to carry a broad spectrum label sunscreens will have to passion a test for both uva and uvb ray protection. in addition, companies have to drop terms like waterproof or sweatproof from their labels. they can carry a water- resistant label only if they pass another test. and finally, the maximum spf on any product is 50. that's because the fda says there isn't enough evidence that products with higher spf offer any more protection. now, products that pass the broad spectrum test and have spf15 or higher can state on the product label that they reduce the risk of skin cancer and early aging. what about sunscreens with an spf under 15 in they have -- under 15? they have to have a warning label that it doesn't protect you. >> what we are talking about is the lotion kind. this doesn't apply for the spray-on? >> reporter: the fda plans to address the effectiveness of sprays at a later date. keep that in min. expect to see the changes within a year. >> thank you. lawrence karnow is a spray kind of guy. we found that out during the break. >> yeah. >> he is a little upset about this aren't you? >> i have not had a reason to slather up in a long time but today is the day to do it. >> today is the day. >> next couple of days a lot of sunshine around the bay area. some of the hottest temperatures we have seen in quite some time. let's go out right now and yup, we have blue skies over the bay. we had a couple of patches of fog this morning even some dense fog out along the coastline. but that was only giving you an idea of how strong that ridge is overhead and it compressed that marine air. it is looking sunny all the way inland today. a couple of patches of fog at the coastline right now, not much. that's the quickly breaking up. temperatures could soar into the low 90s in many spots inland and we just haven't seen temperatures like that since about early may. looking inside the bay, 60s and 70s. at the coast 60s for highs there. tonight, well, mostly clear skies. we could see a couple of patches of fog return to the coast but more of a northerly component to the wind. that offshore wind is clearing out the skies right now and you can see looking good toward the afternoon. warmer today all around the bay area. that strong ridge in place. temperatures soaring in the afternoon. 90 degrees morgan hill. 84 in san jose. 83 in milpitas. and about 79 degrees in redwood city. low 90s into pittsburg, antioch and also into brentwood. 80s in toward the tri-valley. 88 pleasanton. 76 in alameda. out at the coast in the north bay you will find some sunshine there, temperatures in the mid- 60s. 80s a few 90s showing up in some of the valleys. so we are going to continue this. looks like high pressure will hold on for a day, maybe slight cooling out toward the coastline. and then those temperatures are going to start to dive heading toward thursday and friday. cooler low clouds and fog going to make a return to the bay area. cool as we head in toward the weekend. that's a look at weather, guys. back to you. >> slather up, right. >> that's right. >> all right. can't say that enough today. well, it looks like not even the senate is safe from cybercrime. senate.gov is under review after hackers broke into the site over the weekend. it's believed they got through a vulnerable point in one of the senators' offices. a spokesman says no account information was compromised though and the glitch has the been fixed. what about the rest of us? the best advice, a password that's a bunch of gibberish. the crazier the better. that way it can't get hacked. >> that's right. she takes care of dozens of stray cats and now an oakland woman has figured out a way to get the government to help foot the bill. >> juliette goodrich on the cat lover's crusade against the irs. reporter: some call her the cat lady. but her name is jan and she takes care of cats. lots of them in her home. as a volunteer for fix our ferrels, her mission is to trap stray cats, neuter them and care for them until they can be adopted or released. >> he is going to get adopted. >> reporter: when she tried to take deductions on her tax return for items like cat food, litter, vet bills and unreimbursed expenses, the irs said no way claiming her cat receipt items were nondeductible. >> the irs was contending that this could only be done regarding cats being housed on the premises of an spca. >> reporter: jan's case wound up in tax court. she represented herself because she couldn't afford a lawyer. after submitting receipt after revote to the tune of more than $12,000, jan the cat lady won. >> i argued that it was no different from a daycare center where you can deduct a portion of the house and a portion of your utilities that are being used for the charitable purpose. >> reporter: jan has asked us not release the address of her cat foster home. she says a lot of people don't understand why she has so many cats in her own home. in fact, just a couple of years ago, someone threw a rock right through the window of her home. she says by releasing her address, she doesn't want to fall victim to that again but she says her court win is a win for all volunteers on a broader scale. the humane society says it has tens of thousands of members who do volunteer work and spend thousands of dollars a year of their own money to help animals in need. this is the first time the court has actually addressed these expenses as tax- deductible. >> for a lot of people, the extra 10% or whatever would make a huge difference because most rescuers would just turn around and spend that right back on cats. >> reporter: juliette goodrich, cbs 5. ,,,,,,,,,,,,,,,,,,,, time for this week's best buys. eat fresh, stay healthy, save money. check the ads and the quality. we are going to start with beautiful summertime peaches in the market right now. the quality is at the peak. look how beautiful these r when you buy them, look for them nice and red like this all the way around, a little yellow okay but no green. $1.49 a pound. when you bring them home, store them on the counter. when they are ready to enjoy, give them a nice squeeze with a nice give. that piece is ready to enjoy. apricots the most nutritional of all summer fruit loaded with vitamin a, betacarotine because of their color. they are fantastic. 1.49 a pound. that's a great deal for apricots this time of year. loaded with flavor and store them on the counter. kiwi fruit, the prices are fantastic right now. you can find some beautiful kiwi fruit in the market for about 33 cents each. now this gives an example of three items here. those are average prices. check your ads, check the quality. and save some money. i'm tony tantillo, your fresh grocer. and always remember to eat fresh and stay healthy. >> are you not getting enough sleep?
